ORDINANCE NO. 88-0-32
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGE -
WATER, FLORIDA, AMENDING SECTION 606.04 (d) "B-5
PLANNED SHOPPING CENTER DISTRICT", OF THE CODE OF
ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY
ALLOWING INDOOR FLEA MARKETS AS A SPECIAL EXCEPTION IN
B-5, CONTAINING A REPEALER PROVISION, A SEVERABILITY
CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. _
WHEREAS, the Land Development and Regulatory Agency of the
City of Edgewater, at a meeting held on the 29th day of November,
1988, recommended revisions to the B-5 Zoning District.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. Appendix A, Section 606.04 (d) of the code of
Ordinances of the City of Edgewater, Florida, is hereby amended
as follows:*
ARTICLE VI. DISTRICT USE REGULATIONS AND REQUIREMENTS
Section 606.04 - B-5 Planned Shopping Center district
(d) Special Exceptions
Indoor Flea Markets with the following minimum criteria:
1. Operate only Fridays, Saturdays and Sundays and legal
holidays from the hours of 7:00 A.M. to 5:00 P.M.
2. Adecuate refuse containers are provided for each space/
booth.
3. The area is completely clear of litter and other refuse
after each day of operation.
4. The minimum lot size shall be 2 1/2 acres.
5. Shall provide at least three off-street parking spaces,
10 feet by 20 feet in size for each rental space or structure;
all parking areas to be paved.
6. Shall not offer for sale: automobiles, motorcycles,
watercraft, or any type of personal services, or any item which
is prohibited by local, state or federal law.
7. Compliance with all applicable fire and building codes
must be obtained prior to occupancy.
*Deleted language has been lined threagh and new language
underscored.
8. No more than one permanent advertising sign and no more
than two removable advertising signs displayed during actual
operation. (Signs must comply with the City of Edgewater Sign
Ordinance)
9. A floor plan signed and sealed by an architect
registered in the State of Florida must be provided to the
Planning Department demonstrating compliance with State, County
and local requirements at the time of application.
10. A letter of compliance with the applicable health
department regulations shall be submitted at the time of
application.
11. There shall be a minimum of fourteen thousand square
feet of gross floor area.
12. Before granting a special exception the Agency may
attach any other conditions as may be deemed necessary to protect
the health and welfare of the citizens of the City of Edgewater
or to accomplish any of the conditions hereinabove set forth.
SECTION 2. That all ordinances or parts of ordinances and
all resolutions in conflict herewith, be and the same are hereby
repealed.
SECTION 3. If any section, part of a section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
SECTION 4. This Ordinance shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, and approval as provided by law.

This Ordinance was read on first reading and passed by a
vote of the City Council of the City of Edgewater, Florida, and
approval as provided by law, at a regular meeting of
said Council held on the llth day of January 1989.
The second reading of this Ordinance to be at a regular
meeting of the City Council of the City of Edgewater, Florida, to
be held on the 6th day of February , 1989.
