ORDINANCE NO. 30,
AN ORDINANCE AMENDING ORDINANCE NUMBER
768 AND PROVIDING FOR A SIX MONTH EXTENSION
OF THE ZONING CLASSIFICATION OF THE FOLLOWING
DESCRIBED PROPERTY AND PROVIDING AN EFFECTIVE
DATE THEREFOR.
W HE REAS , the Mike Caldwell Property in the City of Edgewater
has been zoned R-R PUD by Ordinance Number 768 and
W HE RE AS , Mr. Caldwell is presently negotiating for the
financing of the development of the the following described property,
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That the zoning classification of Resort Residential
Planned Unit Development (R-R PUD) shall be extended for a period of
six (6) months past the termination date previously established for this
zoning classification.
SECTION 2. That the property to which said extension is applied
is more particularly described as follows:
Part of the SW 1/4 of the NE 1/4 of Section 2 T 18 S; R 34 E
being more particularly described as follows: Commence at
the NW corner of the SW 1/4 of the NE 1/4 of Section 2 T 18
S; R 34 E; thence S 00 06' 01" E along the W line of the said
SW 1/4 of the NE 1/4, a distance of 472.0 feet for the Point
of Beginning. Said Point of Beginning also being the SW comer
of Lot 10, SILVER RIDGE SUBDIVISION UNIT NO. 2 as recorded
in Map Book 27, Page 50 of the Public Records of Volusia County,
Florida; thence continue S 0" 06' 01" E along the said W line of
the SW 1/4 of the NE 1/4 a distance of 848.08 feet to the SW
comer of the said SW 1/4 of the NE 1/4; thence N 89" 32' 29"
E along the South line of the said SW 1/4 of the NE 1/4, a
distance of 1344. 60 feet to the SE comer of the said SW 1/4 of
the NE 1/4; thence N 10 5' W along the East line of the said
SW 1/4 of the NE 1/4, a distance of 651.48 feet; thence N 260
41' 41" W a distance of 353 feet to the SE comer of Lot 37,
SILVER RIDGE SUBDIVISION UNIT NO. 1, as recorded in Map
Book 25, Page 87 of the Public Records of Volusia County,
Florida; thence S 56" 33' 19" W a distance of 207. 25 feet;
thence S 73" 20' 09" W a distance of 73.43 feet; thence S 86"
49' 39" W a distance of 145.88 feet; thence N 78" 52' 01" W
a distance of 145.88 feet; thence N 81" 36' 01" W a distance of
140.80 feet; thence N 85" 59' 20" W a distance of 150. 14 feet;
thence N 88" 56' 20" W a distance of 173.64 feet; thence S 7"
20' 00" E a distance of 39.81 feet; thence S 81" 31' 29" W a
distance of 60.00 feet; thence S 89" 53' 59" W a distance of
126. 12 feet to the Point of Beginning. All lying and being
part of the SW 1/4 of the NE 1/4 of Section 2 T 18 S; R 34 E
containing 26.45 acres more or less.
SECTION 3. That the six (6) month extension of the zoning and
classification shall begin on February 7, 1974
SECTION 4. That all Ordinances or parts of Ordinances and all
Resolutions or parts of Resolutions in conflict herewith be and the same
are hereby repealed.
SECTION S. That this Ordinance shall take effect immediately
upon its adoption by the City Council and approval by the Mayor at
second reading.
SECTION 6. The City Clerk is hereby directed to advertise this
Ordinance as required by law.
The first reading of the above Ordinance was read in full and passed
by vote of the City Council of the City of Edgewater, Florida at a regular
meeting of said Council held on the I R+h day of February, A.D. , 1974
and approved as provided by law.
The second reading of said Ordinance to be at a Reaul ar
meeting of the City Council to be held on the IAth day of
A.D., 1974, roll call vote being as follows:
