AN ORDINANCE SETTING FORTH THE PROPOSED CHARTER
REVISIONS TO BE PLACED ON THE BALLOT FOR THE GENERAL
ELECTION IN NOVEMBER FOR THE REGISTERED VOTERS OF THE
CITY OF EDGEWATER TO VOTE FOR OR AGAINST, PROVIDING
THAT THE CITY CLERK SHALL CAUSE SAID PROPOSED CHARTER
REVISIONS TO BE PLACED ON THE BALLOT FOR THE GENERAL
ELECTION IN NOVEMBER, AND FURTHER PROVIDING AN
EFFECTIVE DATE THEREFOR.
WHEREAS, The Charter Study Commission has made certain recommendations
for revisions in the City Charter and,
WHEREAS, the City Council of the City of Edgewater is desirous of
having registered voters of the City of Edgewater determine whether or not the
proposed charter revisions should be adopted,
NOW THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
SECTION 1. That the following proposed City Charter Revisions are
hereby directed to be placed on the ballot for the general election to be held
on November 6, 1973, to -wit:
Charter Section 39 (A) Merit Board The City of Edgewater shall have a Merit
Board, consisting of five (6)Memebers, four of whom shall be appointed by the
,kb City Council from the electorate of the City and the fifth member shall be
nominated and appointed by the employees of the City of Edgewater. No elected
official of the City of Edgewater, while in office, shall be eligible for
membership on the Merit Board. The terms of appointment for the fifth member
of the Merit Board shall be for one year, and term of appointment for the other
four members shall be for three (3) years and shall be staggered.
The City Council shall establish by Ordinance the duties and functions of the
Merit Board, which shall include but not necessarily be limited to Classification,
Qualifications of employees, grievance procedures, rights of appeal for
disciplinary action. The decisions and recommendations of the Merit Board
shall be final, unless appealed to the City Council, which may reverse such
decisions or recommendations only by the unanimous vote of the City Council.
The establishing Ordinance shall further state that no person in the employ
of the City, nor any person seeking employment with the City shall be appointed,
promoted, reduced, removed or in any way favored, or discriminated against
for reasons of politics, religion, race or sex.
Charter Section 26 Section 26 of the present City Charter shall be replaced
by the following:
There shall be established the office of City Manager. The City Manager shall have
the sole supervision over the following Departments:
Water Department
Sewer Department
Department of Garbage, trash disposal, roads and parks
Police Department
Fire Department
City Clerk and Deputy City Clerk
The supervision of these departments, together with the compensation, duties
and powers of the City Manager shall be prescribed by Ordinance passed
by the City Council.
Charter Section 20 (A) Recall Procedure

Paragraph (a)tof the present City Charter shall be replaced by the following:
(a) Upon the presentation to the City Council of said City of a petition or
petitions signed by registered voters of the voting district of said City from
which the Councilman so petitioned against was elected or in the case of the
Mayor by registered voters of the entire city, in number equalling twenty percent
of the registered voters of the said voting district or of the entire City respectively,
asking for a recall of any councilman or mayor; it shall become the duty of the
City Council to call an election within 30 days after the presentation of the
petition or petitions to fill place or places or (of) any officer or officers, so
petitioned against, such election to be held in accordance with the provisions
for regular municipal elections. Petitions may be circulated through the City to
secure necessary signatures. Signatures on said petition or petitions shall be
verified and petitions shall be filed in such order as to fulfill all requirements
for election.

Charter Section 10 (A) City Council - Qualifications of Members
Section 10 of the present City Charter shall be amended by adding the following
paragraph:
Officers and employees of the City shall not hold any other public office,
except Notaries Public, and shall not be interested in the profits or emoluments
of any contract with the City, nor service to the City, and any such contract
which any officer or employee is, or may become interested in, shall be void.
Charter Section 31 (A) Functions and Powers of Mayor - Selection of
Vice Mayor and Acting Mayor
That portion of Section 31 referring to the selection of a member of the City
Council to serve as Mayor in the absence of the Mayor shall be amended by
adding the following statement:
The selection of Vice Mayor and Acting Mayor shall take place at the first
regular meeting of the City Council after the election in November.
Charter Section 19 (A) Nomination and Election - Primary Elections
Where a candidate for the office of Mayor or Councilman receives more than
50% (fifty percent) of the votes at the Primary Election, he shall not then be
required to run in the general election against the candidate receiving the
second largest number of votes in the Primary Election. Name of the
candidate receiving more than 50% of the votes at the Primary Election shall be
the only name placed on the ballot for the General Election for election to the
office for which said candidate received more than 50% of the votes in the
Primary Election.
SECTION 2. That said proposed Charter Revisions shall be voted
on by casting a vote either for or against the proposed revision.
SECTION 3. That the City Clerk is hereby directed to cause said
proposed Charter Revisions to be placed on the ballot for the general election
to be held November 6, 1973.
SECTION 4. That all Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 5. That this Ordinance shall take effect immediately upon
its adoption by the City Council and approval by the Mayor. 't"D�D

The above Ordinance was read in full and passed by vote of the
City Council of the City of Edgewater, Florida at a meeting of
said Council held on the 1st day of October, A.D. 1973.
Upon motion duly made, seconded and carried, the requirement of
reading said Ordinance upon second reading was waived and the Ordinance
was ordered put upon final passage.
Passed by vote of the City Council of the City of Edgewater, Florida
at a meeting of said Council held on the 1st day of October,
1973, and approved as provided by law; the vote of said Council upon roll
call being as follows:
