AN ORDINANCE RELATING TO OCCUPATIONAL
LICENSE TAXATION; LEVYING AN OCCUPATIONAL
LICENSE TAX FOR THE PRIVILEGE OR ENGAGING
IN OR MANAGING ANY BUSINESS, PROFESSION OR
OCCUPATION WITHIN THE CITY OF EDGEWATER;
REGULATING THE TERM OF OCCUPATIONAL
LICENSES, PROVIDING FOR THE REVOCATION OR
SUSPENSION OF SUCH LICENSES; PROVIDING A
SCHEDULE OF OCCUPATIONAL LICENSE TAXES;
PROVIDING EXEMPTIONS; REQUIRING CERTIFICATES
OF COMPETENCY FOR CERTAIN OCCUPATIONS;
PROVIDING FOR THE REPEAL OF ALL OTHER
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR PUBLIC NOTICE OF THE
SECOND READING OF THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ENACTED 13Y THE PEOPLE Or THE CITY OF FDOEWATER, FLORIDA
``
SECTION 1. Levy of tax.I An occupational license tax for the
privilege of engaging in or managing any business, profession or
occupation within the City of Edgewater, Florida, is hereby levied on the
following persons;
Ia. Any person who maintains a permanent business location or
branch office within the City, for the privilege of engaging in or managing
any business within the City.
�,b. Any person who maintains a permanent business location or branch
office within the City, for the privilege of engaging in or managing any
profession or occupation within the City.
jc. Any person who does not qualify under the provisions of a. or b.
above and who transacts any business commerce where such license tax is
not prohibited by Section B of Article I of the United States Constitution.
SECTION 2. License requirement. It shall be unlawful for any person
described in Section 1 above to engage in or manage any business, profession
or occupation in the City of Edgewater unless he holds a current occupational

license to do so, which license shall be issued by the City Clerk Upon
payment of the license tax required therefor. Provided, however, that
no license for a business relating to the sale, processing, serving or
canning of foods, the building to house same being under construction,
shall be granted until the plans for construction thereof have been approved
by the Volusia County Health Department and the City Council; provided
further that the applications for licenses for home occupations must be
approved by the City Council and shall be reviewed each year by said
board prior to renewal of said home occupation license.
SECTION 3. Tenn or licenses; fee for licenses issued after April
1st; delinquency charges. No license shall be issued for more than one
year, and all licenses shall expire on September 30 of each year, except as
otherwise provided by law. For each license obtained for any new business,
occupation or profession after April let of each year, one-half the applicable
annual occupational license tax shall be paid. Licenses which are not
renewed on or before the expiration date may be reinstated thereafter
upon payment by the holder of the license of the applicable license tax
plus a delinquency charge in the amount of ten percent of such tax. A new
license shall not be issued to any person for the privilege of engaging in
or managing the same business, profession or occupation except upon
payment of all past due license taxes and delinquency charges applicable
thereto.

SECTION 4. License limits; transfer, transfer fee. IAny occupational
license issued shall be good only for the particular business, profession or
occupation and at the particular place of business designated in the license
and only for the person to whom the license"was issued. Provided, however,
that all business licenses may be transferred to anew owner upon a bona fide

sale of the business upon payment of a transfer fee of $2.50 and presentation
of evidence of the sale and the original license; provided further that upon
written request and presentation of the original license, any license may
be transferred from one location to another location in the City upon payment
of a transfer fee of $2.50. Each such license transfer shall be made within
thirty (30) days after such sale or removal; otherwise the license involved
shall become null and void and of no effect. No portion of any occupational
license tax shall be rebated unless such license tax was collected in error.
SECTION 5. Revocation or suspension or license - grounds for.
Any license issued for any business, profession or occupation which the
City Council, in its discretion, shall determine is being operated in a manner
that is not for the best interest, welfare, health, morals and safety of the
community shall be suspended for a period of time or revoked by the City
Council. Provided, however, that prior to revocation or suspension of a
license, the licensee shall be given at least five days' notice to appear
before the City Council to show cause why sa id license shall not be
suspended or revoked.

_SECTION 6 License tax schedule. The amount of the occupational
license tax hereby levied for the privilege of engaging in or managing any
business, profession or occupation within the City of Edgewater, pursuant
to Section 1 above is set forth in the following schedule. Whenever any
business, profession or occupation shall fall into more than one of the
classifications contained in this schedule, the person engaging therein shall
be required to pay the tax required for each classification.

SECTION 7. Exemptions. All persons exempt by statelawfrom
securing state and county occupational licenses shall be exempt from
securing licenses under this ordinance.

SECTION 8. Certificates of competency required for certain occupations.
All individuals required by the Code of Ordinances of the City of Edgewater
to demonstrate qualifications as a prerequisite to engaging in any business,
profession or occupation within the City, including but not limited to
plumbers and electricians (who are mentioned herein for purposes of illustration),
are hereby required to obtain a certificate of competency which shall be
issued by the City Clerk upon presentation by the applicant of satisfactory
evidence:
A. That he meets all requirements of the Code of Ordinances of
the City of Edgewater, Florida, which are applicable to such business,
profession or occupation.
I b. That he has paid the applicable current occupational license
tax to and holds a current occupational license issued by a city or county
or both, as the case may be, where he maintains a permanent business
location or branch office, unless no such taxes are levied by such city
and county.
a A certificate of competency is required as a prerequisite to engaging
in any such business, profession or occupation without regard to whether
the person seeking to engage in such business, profession or occupation
is required to pay an occupational license tax to the City of Edgewater.
A fee in the amount of One Dollar ($1.00) shall be paid by the applicant
for the cost of issuing each certificate of competency. It shall be unlawful
for any individual to engage in any such business, profession or occupation
without complying with the provisions hereof.

SECTION 9. Definition of "person" . For the purposes of this
Ordinance, the word "person" means any individual, person, firm,
corporation, association, executor, administrator, trustee, Joint adventure,
estate, trust, business trust, syndicate, fiduciary, and all other business
groups or combinations.
SECTION 10. Public Notice. At least fifteen (15) days public notice
between the first and second reading of this Ordinance shall be given by
publishing such notice in a newspaper of general circulation within the City
as defined by law. Said public notice shall contain the proposed
classifications and rates applicable to the occupational license taxes levied
by this Ordinance.
SECTION 11. That all Ordinances or parts of Ordinances and all
Resolutions or parts of Resolutions in conflict herewith be and the same
are hereby repealed.
SECTION 12. Effective date. This Ordinance shall become effective
immediately upon adoption at second reading.

held on the City of Edgewater, Florida, on the 7th day of August, 1972.
