AN ORDINANCE DECLARING THE CITY OF EDGEWATER'S
INTENT TO FULFILL THE REQUIREMENTS OF THE LOCAL
GOVERNMENT COMPREHENSIVE PLANNING ACT OF 1975;
ESTABLISHING THE CITY OF EDGEWATER'S AREA OF
JURISDICTION UNDER THE ACT; ESTABLISHING A
LOCAL PLANNING AGENCY; ESTABLISHING THE MANNER
IN WHICH THE LOCAL PLANNING AGENCY SHALL CHOOSE
ITS MEMBERS AND OFFICERS, CONDUCT AND HOLD
MEETINGS AND EXPEND FUNDS; REPEALING ALL ORDINANCES
AND RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING
AND EFFECTIVE DATE THEREFORE.
WHEREAS, the 1975 Florida Legislature has enacted the Local
Government Comprehensive Planning Act of 1975 (hereinafter
referred to as the Act); and
WHEREAS, the Act requires mandatory comprehensive planning by
cities and counties prior to July 1, 1979; and
WHEREAS, the Agency is responsible for the preparation of
comprehensive plan elements prior to July 1, 1979; and
WHEREAS, the Agency may be a local planning board or commission.
BE IT ENACTED BY. THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That the requirements of the Act will be completed
to July 1, 1979.
SECTION 2.. That the City of Edgewater will exercise its authority
granted by the Act throughout all of its incorporated area.
SECTION 3. That the Edgewater Planning Board (hereinafter referred
to as the Board) is hereby designated as the Agency.
SECTION 4. That the Board is authorized to prepare the comprehensive
plan elements in accord with the requirements of the Act.
SECTION 5. That upon adoption of the comprehensive plan the
Board has the continuing responsibility for monitoring the
effectiveness of the Plan and making recommendations for change.
SECTION 6. That the Board's by-laws and rules -of -procedure
shall set out the duties and responsibilities of the Agency and
govern its methods of choosing its members and officers.
SECTION 7. That the City Council will appropriate funds for
salaries, fees, and expenses necessary for the preparation of
the comprehensive plan elements.
SECTION 8. That the Board is authorized, after approval of the
City Council, to expend all funds appropriated for fulfilling
the requirements of the Act.
SECTION 9. That all meetings of the Board will be open to the
public and all.records will be public records.
SECTION 10. That all Ordinances or parts of Ordinances and all
Resolutions or parts of Resolutions in conflict herewith be and
the same are hereby repealed.
SECTION 11. This Ordinance shall take effect immediately upon
its adoption by the City Council and approval by the Mayor at
second reading.
SECTION 12. The City Clerk is hereby directed to advertise this
Ordinance as required by law.
The first reading of the above Ordinance was read in full
and passed by vote of the City Council of the City of Edgewater',,/
Florida at a regular meeting of said Council held on the 'aka �1
