932ORDINANCE NO. 70.2
AN ORDINANCE AMENDING SECTIONS 2-35, 2-36,
2-38 AND 2-5 OF THE CODE OF ORDINANCES OF
THE CITY OF EDGEWATER, FLORIDA, REPEALING
ALL ORDINANCES AND RESOLUTIONS IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE THEREFORE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION I. That Section 2-35 of the Code of Ordinances of the
City of Edgewater, Florida is hereby amended by amending paragraph (A-1)
of Section 2-35 to read as follows: The City Council shall hold regular
meetings every second and fourth Thursday of each and every month at
7:30 P.M.. If either a second or fourth Thursday shall be a national
holiday, then the regular meeting shall be held on the preceding Wednesday,
all other provisions as to time and place to apply as above.
SECTION 2. That Section 2-35 of the Code of Ordinances of the
City of Edgewater, Florida is hereby amended by creating paragraphing
A-3 of Section 2-35 to read as follows: Place: All regular meetings of
the Council shall be held in the Council Chambers at City Hall, Community
Center Building or Shuffle -board Clubhouse or any other place designated
by the Mayor.
SECTION 3. That Section 2-36 of the Code of Ordinances of the City of
Edgewater, Florida is hereby amended by amending Section 2-36 to read as
follows: Special Meetings: The Mayor, Vice -Mayor or Acting Mayor shall call
special meetings of the Council whenever, in his opinion, the public business
may require it. Whenever a special meeting shall be called, a summons or a
notice in writing signed by the Mayor, Vice -Mayor or Acting Mayor shall be
served upon each member of the Council either in person or by notice left
at his place of residence, stating the date and hour of the meeting and the
purpose for which such meeting is called, and no business shall be transacted
thereat, except such as is stated in the notice.

SECTION 4. That the Code of Ordinances of the City of Edgewater,
Florida is hereby amended by adding the following section to be titled
Section 2-35 (c-1): Agenda Sessions: All agenda sessions shall be held
at 7:30 P. M. on the Monday preceeding any regular council meeting. If
any agenda session shall be on a national holiday, such agenda session
shall be held on the Tuesday following said Monday so effected. The
purpose of the agenda session will be to establish an agenda for the
ensuing regular Council meeting and public participation in said agenda
meeting shall be kept to a minimum in order that the City Council may
carry out the business at hand. Public participation may take place
after the agenda for the following regular meeting has been formulated
and such public participation shall be subject to termination by the
Mayor.
SECTION 5., That Section 2-38 of the Code of Ordinances of the City
of Edgewater, Florida is hereby amended by adding the following language
to Section 2-38: Presiding Officer: The presiding officer of the Council
shall be the Mayor ( or Vice -Mayor or Acting Mayor, who shall be elected
annually at the first meeting in November, by the members, from their
membership.)
The presiding officer shall preserve strict order and decorum at all
regular and special meetings of the Council. He shall state every question
coming before the Council, announce the decision of the Council on all
subjects and decide all questions of order, subject however, to an appeal
to the Council, in which event, a majority vote of the Council shall govern
and conclusively determine such question of order.
He shall vote on all questions, his name being called last. He shall
sign all ordinances and resolutions adopted by the Council during his
presence. In the event of his absence, the Vice -Mayor or Acting Mayor
shall sign ordinances or resolutions as they are adopted.

SECTION 6. That Section 2-38 of the Code of Ordinances of the City
of Edgewater, Florida is hereby amended by adding paragraph A-4 to Section
2-38 to read as follows: The Mayor, Vice -Mayor or Acting Mayor shall take
the chair precisely at the hour appointed for the meeting and shall
immediately call the Council to order. Upon the arrival of the Mayor or
Vice -Mayor, the Acting Mayor shall immediately relinquish the chair upon
the conclusion of the business immediately before the Council. The
Vice -Mayor shall relinquish the chair in the same manner upon the arrival
of the Mayor.
SECTION 7. That Section 2-5 of the Code of Ordinances of the City of
Edgewater, Florida is hereby amended by amending paragraph (A-1) of Section
2-5 to read as follows: Almv
Preparation or Ordinances:ances shall be prepared for presentation
to the Council unless ordered by a majority vote of the Council. If municipal
business warrants the immediate preparation of an ordinance, the presiding
officer shall give direction to the City Attorney to prepare same at the agenda
session immediately preceding the regular meeting atwhich said ordinance
shall be read.
SECTION B. That Section 2-5 of the Code of Ordinances of the City of
Edgewater, Florida is hereby amended by amending sub -paragraph (2) of
paragraph (A-3) of Section 2-5 to read as follows: No ordinance shall be
passed by the City Council o° the City of Edgewater, Florida that is not in
accordance with Chapter 166.041 of Florida Statutes dealing with procedures
for adoption of ordinances and resolutions.
SECTION 9. That all Ordinances or parts of Ordinances and all
Resolutions or parts of Resolutions in conflict herewith be and the same
are hereby repealed.
SECTION 10. This Ordinance shall take effect immediately upon its
adoption by the City Council and approval by the Mayor at second reading.
SECTION 11. The City Clerk is hereby directed to advertise this
Ordinance as required by law.
