Dear Ms. Storey, Mr. Karet, and Mr. Dunn:
I have been advised by Mr. Dibenedetto that the buildings at 411 S. Ridgewood Avenue
were demolished by The City of Edgewater on May 14. Mr. Dibenedetto also advised me
that the concrete slab was removed from the property contrary to what was represented to
me and to Mr. Dibenedetto prior to the demolition. In fact, the work order proposal
submitted by Doug Cole Construction, Contractor, specifically provided that the concrete
be left on the site.
Mr. Dibenedetto had every right to preserve the concrete slab for potential later use. I am
determining the value of a concrete slab in the dimensions of what existed prior to the
demolition and will look to the City of Edgewater to compensate Mr. Dibenedetto for his
loss.

Dear Mr. DiBenedetto:
Sections 19-14- (Water), 19-35 (Sewer), 19-63 (Refuse &
Recycl ing ) , and 9.5 -7 2 (Stormwater Management.) of the Edgewater
Code of Ordinances authorize a minim~~ monthly utility bill as
well as a penalty of 10% for nonpayment.
,According to our records, water and sewer services ~"ere
terminated on April 18, 1996 due to the building being declared
unsafe. ,From 'about April I, 1996 (normal read date) until April
18, 1996 your property' at 4-11 S. Ridgewood was connected to the
,,,ater and sewer system. Therefore, the May 14-, 1996 bill is owed
by you. I am returning to you the May 1996 bill so that you may
pay it on or before June 3, 1996 to avoid a penalty of 10% of
$12.71.
In the future, starting with the June 1996 bill, ~"e will bill you
for only one unit for water and sewer services to maintain your
capacity availability - no refuse or stormwater billing. The
significance of this is that on redevelopment you will not have
to pay water or sewer impact fees for the nUmber of fixture units
that you are presently entitled to. You can certainly request
that both water and sewer capacity be abandoned, we will not bill
you a monthly minimum for water and sewer in the future. But,
under this scenario, you will have to pay the appropriate water
and sewer impact and connection fees at time of redevelopment.

has been declared unsafe by the Building Official in accordance
with Section 901(J) of the Land Development Code of the City of
Edgewater, and the Standard Unsafe Building Abatement Code, 1985
Edition. See attached inspection report.
You are hereby notified that the building or structure must be
repaired or demolished within sixty (60) days. Applicable
building, electrical, mechanical, plumbing and/or demolition
permits must be obtained from this office prior to the starting of
any repairs or demolition of the building or structure.
In the interest of the health, safety, and general welfare of the
residents of the community, the building or structure must be
adequately secured to prevent the entrance of unauthorized persons.
The premises must be properly maintained to prevent the overgrowth
of weeds and accumulation of trash and debris. These actions must
be accomplished within twenty (20) days from the date of this
notice.
You may appeal this notice within thirty (30) days of the date
written above by filing a written request with the secretary of the
Construction Regulation Board. Such request shall state the
location of the property by street address or legal description;
the specific section or order being appealed; a statement
identifying the legal interest of each appellant; a statement
detailing the issues on which the appellant desires to be heard,
and the legal signature(s) of all appellants and their official
mailing addresses.

INSPECTION REPORT
411 S. RIDGEWOOD AVENUE
EDGEWATER, FL 32132
The following is a detailed report documenting the conditions we
have found at 411 S. Ridgewood Avenue, Edgewater, FL:
1) The structure has been damaged to the extent that the
structural integrity of the building or structure is less than
it was prior to the damage and is less than the minimum
requirement established by the 1994 Standard Building Code
Chapter 16 for new buildings.
2) The exterior appendage of the structure is not securely
fastened, attached or anchored such that it is capable of
resisting wind or similar loads as required by the 1994
Standard Building Code Chapter 16 for new buildings.
3) 1994 Standard Building Code section 103.5 Unsafe Building or
Systems All buildings, structures, electrical, gas,
mechanical or plumbing systems which are unsafe, unsanitary,
or do not provide adequate egress, or which constitute a fire
hazard, or are otherwise dangerous to human life, or which in
relation to existing use, constitute a hazard to safety or
health, are considered unsafe buildings or service systems.
All such unsafe buildings, structures or service systems
are hereby declared illegal and shall be abated by repair and
rehabilitation or by demolition in accordance with the
provisions of the Standard Unsafe Building Abatement Code.
4 ) The building, structure or portion thereof as a result of
decay, deterioration or dilapidation is likely to fully or
partially collapse.
5) The,structure is in such a condition that it constitutes a
public nuisance.

together with my wife Mllrie, I own the real estate propert)' at 411 South Ridgewood A venue
here in Edgewater. I have been advised ,by the Building Department that my buildings are
sub-standard and need to be brought up to code regulations.
I am attempting to negotiate with contractors to get the required permits and make the

necessary repairs. We know that this property is in a prominent midtown location and you
shouid know that I am at least as concerned as The City, that my buildings ar~ both safe xnd
attractive.
This person that appears before you, first came to this country from his native Italy as a very
young man with nothing but empty pockets and dreams of a better life in America. I have
lived the American Dream of honest hard work and respect for the law. I have owned this
property for 14 years and have just about everything in my name invested in it. As I .,'
consider my options, I would ask the City Officials for their understanding and co-operation
in terms of time to work out these problems and for their consideration of any reasonable
