1017L- ORDINANCE NO. 10 t 7 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, REQUIRING THE USE OF A LATERAL SYSTEM FOR SEPTIC TANK DRAIN FIELD SYSTEMS IN ACCORDANCE WITH CHAPTER 10D-6 OF THE FLORIDA ADMINISTRATIVE CODE; REQUIRING THE USE OF SPECIFIED PIPE IN SAID DRAIN FIELD SYSTEM; AUTHORIZING THE BUILDING INSPECTOR TO GRANT VARIANCES FROM THE USE OF THE LATERAL SYSTEM IN HIS DISCRETION; REQUIRING /1'pt A BOND OF ALL INDIVIDUALS, PARTNERSHIPS, OR t:--'.L COPORATIONS ENGAGED IN THE INSTALLATION v� OF SEPTIC TANKS AND DRAIN FIELDS IN THE CITY Fi OF EDGEWATER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1: All Septic tanks and drain fields hereafter constructed in the City of Edgewater, Florida shall be required to be of the lateral system as set forth in Chapter IOD-6 (3) of the Florida Administrative Code. SECTION 2: The use of an absorption field for the disposal of effluent in the City of Edgewater, Florida is hereby unauthorized unless the installation of said absorption field shall be authorized by the building inspector in the City of Edgewater. The building inspector of the City of Edgewater shall not authorize the use of an absorption field in the City unless the person requesting same can show an extreme hardship in constructing the lateral system required. SECTION 3: All drain field pipe used in the installation of drain fields within the City of Edgewater shall be Scheduled 160 Rigid PVC Perforated ASAF approved. SECTION 4: All individuals, partnerships, or corporations installing drain fields within the City of Edgewater, Florida shall comply with all other rules and regulations for the'.installation of Septic tanks and Drain fields as con- tained in the Florida Administrative Code. /C/% r. SECTION 5: Before any individual firm,i partnership, or corporation engaged in the business of installing Septic tanks or Drain fields within the City, they shall first obtain the proper license and deposit with the City of Edgewater, a good and sufficient bond in the amount of One thousand ($1,000.00) dollars, to be approved by the City Attorney, conditioned that the individual firm, partnership, or corporation engaged in the Septic tank or Drain field business will faithfully obserie all the laws pertaining to the in- stallation of Septic tanks and Drain fields, and further that the City of Edgewater shall be indeminified and saved harmless from all claims arising from accidents and damages of any character whatsoever caused by the negligence of such in- dividual firm, partnership, or corporation engaged in the Septic tank or Septic tank drain Meld business. SECTION 6: That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby rescinded. SECTION 7: This Ordinance shall take effect immediatelyupon its adoption by the City Council and approi al as provided by law. SECTION 8: The City Clerk is hereby directed to advertise this Ordinance as required bylaw. The first reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the --z yl" day of , 1978 and approved as provided by law.
