994ORDINANCE NO. AN ORDINANCE AMENDING SECTIONS 2-5, 2-35, 2-36 AND 2-38 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, RELATING TO THE MEETING PLACE OF THE CITY COUNCIL, THE CALLING AND NOTICE OF SPECIAL MEETINGS, THE DESIGNATION AND DUTIES OF THE PRESIDING OFFICER OF THE COUNCIL AND THE PREPARATION ®/, AND ENACTMENT OF ORDINANCES; REPEALING ALL 40iiii//9 ORDINANCES AND RESOLUTIONS IN CONFLICT HERE- �� WITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance 932 of the Code of Ordinances of the City of Edgewater, Florida, enacted on June 12, 1975, has been declared by the Circuit Court of Volusia County, Florida, to be invalid because it does not clearly state the subject matter of the Ordinance in the title, and therefore it does not comply with the requirements of Section 166.041 (2) of the Florida Statutes, and WHEREAS, it was and is still the intent of the City Council to enact a valid ordinance incorporating substantive provisions of Ordinance 932. NOW, THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Section 2-35 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended by adding paragraph A-3 of Section 2-35 to read as follows: Place. All regular meetings of the Council shall be held in Council Chambers at City Hall, Community Center Building or Shuffle -board Clubhouse or any other place designated by the Mayor. SECTION 2. That Section 2-36 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended to read as follows: Special Meetings. The Mayor, Vice -Mayor or Acting Mayor shall call special meetings of the Council whenever, in his opinion, the public business may require it. Whenever a special meeting shall be called, a summons or a notice in writing signed by the Mayor, Vice -Mayor or Acting Mayor shall be served upon each member of the Council, either in person or by notice left at his place of residence, stating the date and hour of the meeting and the purpose for which such meeting is called, and no business shall be transacted thereat, except such as is stated in the notice. SECTION 3. That Section 2-38 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended by adding the following language to Section 2-38: Presiding officer. The Presiding Officer of the Council shall be the Mayor (or Vice -Mayor or Acting Mayor, who shall be elected annually at the first meeting in November by the members from their membership). The Presiding Officer shall preserve strict order and decorum at all regular and special meetings of the Council. He shall state every question coming before the Council, announce the decision of the Council on all subjects and decide all questions of order, subject, however, to an appeal to the Council, in which event, a majority vote of the Council shall govern and conclusively determine such question of order. He shall vote on all questions, his name being called last. He shall sign all ordinances and resolutions adopted by the Council during his presence. In the event of his absence, the Vice -Mayor or Acting Mayor shall sign ordinances or resolutions as they are adopted. SECTION 4. That Section 2-38 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended by adding paragraph A-4 to Section 2-38 to read as follows: Upon the arrival of the Mayor, or Vice -Mayor, the Acting Mayor shall immediately relinquish the chair upon the conclusion of the business immediately before the Council. The Vice -Mayor shall relinquish the chair in the same manner upon the arrival of the Mayor. SECTION 5. That Section 2-5 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended by amending sub -paragraph (2) of paragraph A-3 of Section 2-5 to read as follows: No ordinance shall be enacted by the City Council of the City of Edgewater, Florida, that is not in accordance with Chapter 166.041 of the Florida Statutes relating to the procedures for adoption of ordinances and resolutions. SECTION 6. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed. - 2 - SECTION 7. This Ordinance shall take effect immediately, upon its adoption by the City Council and approval as provided by law. SECTION S. The City Clerk is hereby directed to advertise this Ordinance as required by law. The first reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the day of �L we er/ , 1977, and approved as provided by law.
