979W � y ORDINANCE NO.91'� AN ORDINANCE AMENDING ORDINANCE 880 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, TO ADD THREE ADDITIONAL CLASSIFICATIONS OF PERMITTED USES IN THE B-2 NEIGHBORHOOD BUSINESS DISTRICT ZONE IN THAT AREA OF LAND WEST OF THE FLORIDA EAST COAST RAILROAD TRACKS FROM 21ST STREET TO 30TH STREET PRESENTLY ZONED B-2 ��,�,�, IN THE CITY OF EDGEWATER, FLORIDA: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a public hearing was held on February 28, 1977, in the City of Edgewater, Florida, regarding changes to Ordinance 880, and WHEREAS, it was the recommendation of the Zoning Board that three new classifications of permitted uses be added in the B-2 zoning district on land west of the Florida East Coast railroad tracks from 21st Street to 30th Street, and WHEREAS, the City Council of the City of Edgewater, Florida, has approved the addition of three new classifications as permitted uses in the B-2 district west of the Florida East Coast railroad tracks from 21st Street to 30th Street in the City of Edgewater, Florida. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Ordinance 880 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended to permit three new classifications of permitted uses in the B-2 zone in that area of land west of the Florida East Coast railroad tracks extending from 21st Street to 30th Street in the City of Edgewater, Florida, presently zoned B-2. These new classifications of permitted uses are as follows: Auto body shops, mini shops, and tool and grinding shops. A mini shop is hereafter defined as follows: A small shop, the use of which is devoted primarily to the sale of a service or a product or products, but the service is performed or the produce to be sold is prepared in its finished form on the premises. The only permitted use of a mini shop shall be those permitted uses as set forth in the B-2 Neighborhood Business District in Ordinance 880. WOO 979 SECTION 2. That all applicants for occupational licenses to conduct auto body shops, mini shops or tool and grinding shops in the above -referenced B-2 zone shall comply with all applicable Federal, state and local laws prior to the issuance of an occupa- tional license. SECTION 3. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed. SECTION 9. The City of Edgewater, Florida, is hereby directed to advertise this Ordinance as required by law. SECTION 5. This Ordinance will become effective immediately upon its final passage as provided by law The first reading of the above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida, at the /meeting of said Council held on the day of 1977, and approved as provided by law.
