AN ORDINANCE AMENDING ARTICLE IX,
SECTION 901.04 OF ORDINANCE 880
OF THE CITY OF EDGEWATER, FLORIDA
PERTAINING TO VOTING BY THE BOARD
OF ADJUSTMENTS OF THE CITY OF �°#►
EDGEWATER, FLORIDA; REPEALING ALL
ORDINANCES OR RESOLUTIONS IN CON-
FLICT HEREWITH AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, Florida has determined
that it is in the best interest of the City to amend Article IX, Section 901.04 of
Ordinance 880 of the City of Edgewater, Florida.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER,
FLORIDA:
Section 1. That Article IX, Section 901.04 of Ordinance 880 of the City of
Edgewater, Florida is hereby amended to read as follows:
901.04 Majority Vote
The concurring vote of a majority of all the members of the Board shall be
necessary to reverse any order, requirement, decision or determination
of the Enforcement Official, or to decide in favor of the applicant any matter
upon which it is required to pass under the provisions of this Ordinance.
Every decision of the Board of Adjustment shall be subject to review by the
Courts by proceedings in the nature of certiorari.
Section 2. That all Ordinances or parts of Ordinances and all Resolutions
or parts of Resolutions in conflict herewith be and the same are hereby repealed.
Section 3. That the City Clerk is hereby directed to advertise this Ordinance
as required by law.
Section 4. That this Ordinance shall become effective immediately upon its
final passage as provided by law.
The first reading of the above Ordinance was read in full and passed by vote of the
City Council of the City of Edgewater, Florida, at themeeting of said
Council held on the_=day of , 1977, and approved as provided
by law.
