ORDINANCE NO. 43
AN ORDINANCE ABOLISHING THE MUNICIPAL
COURT OF THE CITY OF EDGEWATER, FLORIDA,
IN ACCORDANCE WITH ARTICLE V OF THE
CONSTITUTION OF THE STATE OF FLORIDA;
PROVIDING FOR PUBLICATION OF THIS ORDINANCE
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Article V of the Constitution of the State of Florida (1968)
provides for the abolishment of all municipal courts on January 3, 1977, and;
WHEREAS, the City Council finds that it would be in the best interest
of the citizens of the City of Edgewater and in the best interest of the orderly
administration of justice for the municipal court of the City of Edgewater to
be phased out and terminated December 31, 1976, and all duties, powers,
responsibilities and cases transferred to the county court on said date.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
EDGEWATER, FLORIDA:
SECTION 1. That the municipal court of the City of Edgewater be and
the same shall hereby be abolished and terminated on December 31, 1976.
SECTION 2. That upon its abolishment and termination, all functions,
duties, responsibilities, obligations and cases shall be turned over to the
County Court in and for Volusia County, Florida.
SECTION 3. That the City Clerk be and she is hereby authorized to
submit a copy of this Ordinance to the Chief Justice of the Supreme Court of
the State of Florida, and to the Chief Circuit Judge in and for the Seventh
Judicial Circuit, in and for the State of Florida.
SECTION 4. That all Ordinances of the City of Edgewater, Florida
or parts thereof, that are in conflict with this Ordinance be and the same are
hereby repealed.
SECTION 5. That the City Clerk is hereby directed to advertise this
Ordinance as required by law.

SECTION 6. This Ordinance shall become effective immediately
upon its final passage as provided by law.
The first reading of the above Ordinance was read in full and passed by
vote of the City Council of the City of Edgewater, Florida at the,

approved as provided by law.
The second reading of said Ordinance to be at the Lj,meeting of the
