HEARINGS, FINDINGS OF CUNSISTENCY; PROVIDING
F4R CONFLICTING PROVISI4NS, SEVERABILITY AND
APPLICABILITY AND PR4VIDING AN EFFECTIVE DATE.
WHEREAS, Ernest V. and Gail LaCour, applicant, has applied far an amendment ta the
Comprehensive Plan Future Land Use Map to include property located at 144 Flamingo Road,
within Volusia Caunty, Florida as Medium Density Residential. Subject property contains
appraximateIy .25� acres.
WHEREAS, the Planning and Zaning Baard, sitting as the City's Loca! Planning
Agency, held a Public Hearing pursuant to 163.31'74, Fla. Stat., an Wednesday, August 11,
2021, and by a vote of 5-0 recommended that the City Council approve the praposed Plan
Amendment;
WHEREAS, the City Council feels it is in the best interests of the citizens of the
City of Edgewater to amend its Cornprehensive Plan as more particularly set forth hereinafter.
NOW, THEREFURE, BE IT ENACTED BY TI-iE CITY COUNCIL UF THE
CITY OF EDGEWATER, FLORIDA:

PART A. AMENDMENT.
Ordinance No. 81-0-10, as amended and supplemented, adapting the Comprehensive
Plan of the City of Edgewater, Florida, regulating and restricting the use of lands lacated
within the City of Edgewater, Florida, shall 6e amended to inctude property described in
Exhibits "A" and "B" on the Future Land Use Map as Medium Density Residentiat.
PART B. PUBLIC HEARINGS.
It is hereby found that a public hearing held by the City Council to consider adaption af
this ordinance on Octaber 4, 2021, at 6:00 p.m. in the City Council Chambers at City Ha}1, 104
N. Riverside Drive, Florida, after notice published at least 14 days priar ta hearing is deemed ta
comply with 163.31$4, Fla. Stat.
PART G CUNFLICTING PROVISIONS.
All ardinances and resolutions, or parts thereof that are in conflict with this ordinance, are
hereby superseded by this ordinance to the extent of such conflict.
PART D. EFFECTIVE DATE.
The effective date of this plan amendnnent, if the amendment is not timely challenged,
shaIl be 31 days after the state land planning agency notifies the local government that the plan
amendrnent package is complete. If timely challenged, this amendment shall become effective
on the date the state land planning agency or the Administration Commission enters a final order
determining this adapted amendment to be in compliance. No development orders, development
permits, or land uses dependent on this amendment may be issued or commence befare it has
become effective. If a fnal order of noncampliance is issued by the Administration Commission,

this amendrnent may nevertheiess be rnade effective by adoption af a resolution affirming its
effective status, a copy af which resolution shall be sent to the staie land planning agency. The
arnendment shall aiso not be effective until certification is received from the Volusia
Growth Management Commission.
PART E. SEVERABILITY AND APPLICABILITY.
If any partian of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the rernaining portions of this ordinance. If
this ordinance or any provisions thereof shall be held to be inapplicable to any person, property,
ar circumstance, such holding shall not affect its applicability to any other person, with
property, ar circumstance.
PART F. AD4PTION.
After Motion to apprave by Councilwarnan Bennington, with Second by
Councilwoman O'Keefe the vote on the first reading af this ordinance held an September 13,
2021, was as follows:
