AN ORDINANCE AMENDING SECTIONS 715.00, 715.01,
715.02, 715.03, 715.04 AND 716.00 OF THE CODE OF
ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA FOR
THE PURPOSES OF CLARIFYING THE WORDING IN SAID
SECTIONS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR ADVERTISEMENT OF THIS
ORDINANCE BY THE CITY CLERK AND PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA:
SECTION 1. That Section 715.00 is hereby amended to read as
follows:
Application for rezoning. Site plan approval. Amendments
to approve site plan and enforcement.
SECTION 2. That Section 715.01 is hereby amended by correcting
the second paragraph of 715.01 to read as follows:
The Zoning Board shall review the outline development plan
and recommend within thirty (30) days that the rezoning be
approved or disapproved. After the City Council receives
the Zoning Board's recommendation, the City Council shall
schedule a public hearing. If, after the public hearing,
the City Council approves the outline development plan, the
Zoning Map shall be amended to show the appropriate rezoning
district. After the zoning has been granted and prior to
the issuance of a building permit, the developer must prepare
a site plan.
SECTION 3. That Section 715.02 is hereby amended to read as
follows:
Site plan approval. Prior to the issuance of a building
permit a site plan drawn at a scale no smaller than one (1)
inch equals fifty (50) feet (1"=50') must be submitted to
and approved by the Zoning Board and Planning Department
and Building Official for all R-4, R-5, R-5A, R-6, B-1, B-2,
B-3, B-4, B-5, B-6, I-1, I-2 and I-3 zoning districts. The
site plan shall be in substantial compliance with the concept
of outline development plan and shall show the following in-
formation:
(1) Existing and proposed topography at a two (2) foot con-
tour interval for one (1) acre of land or more.
(2) Lot and project boundary dimensions.

(3) Dimensions of all street systems, walks, entrance
ways, and off-street parking areas.
(4) The locations and dimensions of all buildings,
structures and improvements.
(5)
Common open space areas and their
treatment.
(6)
Drainage, landscaping and
utility
plans.
(7)
Elevation and perspective
drawing
displaying the
typical building character.
(S) Screened garbage collection area.
(9) Any legal instruments, as an attachment, that are
required under the deed covenants section.
After the site plan has been approved by the Zoning Board
and Planning Department the Chief Building Official is
authorized to issue a building permit.
SECTION 4. That Section 715.03(1) is hereby amended to read
as follows:
Minor changes in the location, siting, and height of
buildings and structures may be authorized by the Zoning
Board and Planning Department if required by engineering
or other circumstances not forseen at the time the site
plan was approved.
SECTION 5. That Section 715.03(2) is hereby amended to read
as follows:
All other changes in the use or any rearrangement of parking
areas, buildings, lots or any changes in the provisions of
common open spaces must be made by the Zoning Board and
Planning Department. No amendment may be made in the
approved site plan unless the changes are shown to be
required by changes in conditions that have occurred since
the site plan was approved or by changes in the development
policy of the community.
SECTION 6. That Section 715.04 is hereby amended to read as
follows:
Enforcement. Following the issuance of a building permit,
the Chief Building Official shall be informed at each stage
of construction at such times as inspections are made by
any other department and shall inspect the project site to

determine if there are any variations between the approved
site plan and actual construction. Any variations shall
be brought immediately to the attention of the project super-
visor, and if the variation is significantly different from
the site plan, the Chief Building Official shall immediately
stop construction, notify the City Council and direct the
project supervisor to submit new plans, showing the variations
and present the same to the City Council for approval before
the construction can take place. The City Council may approve
the variations or refer the same back to the Zoning Board and
Planning Department for appropriate action.
SECTION 7. That Section 716.00 is hereby amended to read as follows:
Zoning and Planning Department recommendations. An affirma-
tive vote of not less than four (4) City Council members shall
be required to adopt or amend an ordinance contrary to any
decision or recommendation submitted by the Zoning Board and
Planning Department.
SECTION 8. That all Ordinances or parts of Ordinances and all
Resolutions or parts of Resolutions of the City of Edgewater, Florida,
that are in conflict herewith be and the same are hereby repealed.
SECTION 9. That the City Clerk is hereby directed to advertise
this Ordinance as required by law.
SECTION 10. That this Ordinance shall take effect immediately
upon its adoption by the City Council and approval as provided by law.
The first reading of the above Ordinance was read in full and
passed by vote of the City Council of the City of Edgewater, Florida,
at the Regular meeting of said Council held on the -v day of Jfrr
1980, and approved as provided by law.
