PAGE 017750 ORDINANCE NO. p O- 0- y°2 AN ORDINANCE VACATING A PORTION OF A FIFTEEN FOOT ALLEY LYING NORTH OF INDIAN RIVER BOULE- VARD, AND LYING BETWEEN FERN PALM DRIVE AND GUAVA DRIVE; IMPOSING ADDITIONAL CONDITIONS Nye q 8 29AN '80 FOR THE GRANTING OF SAID VACATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ADVERTISING BY THE CITY CLERK AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Magnuson Corporation has requested that the City of Edgewater, Florida vacate one hundred sixty (160) feet of a fifteen (15) foot alley, lying north of Indian River Boulevard, and lying be- tween Fern Palm Drive and Guava Drive, and, WHEREAS, a public hearing was held regarding the vacation of said alley, NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That the City of Edgewater, Florida hereby vacates one hundred sixty (160) feet of that certain fifteen (15) foot alley- way, lying north of Indian River Boulevard, and being contiguous to Lot 433, 434, 435 and 436, inclusive, in Block 16, Florida Shores Unit No. 1, as per map in Map Book 33, page 57, of the Public Records of Volusia County, Florida. SECTION 2. That as a condition for vacation of a portion of the fifteen (15) foot alley, the Magnuson Corporation will convey to Arthur Wright and Charlotte Wright, his wife, and to Leonard Peterson and Grace Peterson, his wife, a fifteen (15) foot perpetual easement for purposes of ingress and egress across Block 16, Florida Shores Unit No. 1, as per map in Map Book 33, page 57, of the Public Records of Volusia County, Florida, in order that said parties may have a means of perpetual ingress and egress to the rear of their lots lying in the said Block 16, Florida Shores Subdivision. SECTION 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions of the City of Edgewater, Florida, that are in conflict herewith be and the same are hereby repealed. SECTION 4. That the City Clerk is hereby directed to advertise this Ordinance as required by law. SECTION 5. That this Ordinance shall take effect immediately upon its adoption by the City Council and approval as provided by law.
