79-O-21im ORDINANCE NO. AN ORDINANCE AMENDING SECTION 606.00 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, BY CHANGING THE B-1, CENTRAL BUSINESS DISTRICT, TO B-3, HIGHWAY SERVICE DISTRICT; BY ADDING THOSE PERMITTED USES PREVIOUSLY EXIST- ING IN THE B-1, CENTRAL BUSINESS DISTRICT, AS ADDITIONAL PERMITTED USES IN THE B-3, HIGHWAY SERVICE DISTRICT; BY ADDING NEW ADDITIONAL USES IN THE B-3, HIGHWAY SERVICE DISTRICT; DE- FINING THE TERMS "FRANCHISE" AND "NEW AUTO- MOBILE DEALERS"; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That Section 606.00 of the Code of Ordinances of the City of Edgewater, Florida, is hereby amended by changing the present zoning classification of B-1, Central Business District, to B-3, Highway Service District. SECTION 2. Thin all permitted uses previously existing in the B-1, Central Business District, shall hereafter be permitted uses in the B-3, Highway Service District. SECTION 3. That, in addition to the permitted uses now allowed in the B-3 zoning district; the following are hereby added as additional permitted uses: Automotive service center Automotive electrical repairs Banks, including branch banks Cabinet shops (maximum building size shall be 5, 000 sq. ft. ) Franchised new automobile dealers (dealers in the sale of used cars must apply as a special exception) Greenhouses and nurseries, garden supplies and equipment Hobby stores Home improvements and repairs Laboratories (biological, dental, medical, excluding manufacturing) Medical and dental clinics Offices (general) %9-D--2/ Title Insurance Companies Retail and wholesale stores Service Stations, A, B, and C Wholesale Distributors of parts SECTION 3. That for purposes of this Ordinance the term "franchise" is hereby defined as the written agreement between any automobile manu- facturer engaged in commerce and any automobile dealer engaged in the sale of new automobiles which purports to fix the legal rights and liabilities to such agreement or contract. In addition, the term "new automobile dealer" is hereby defined as any person, partnership, corporation, associa- tion, or other form of business enterprise resident in the United States or in any territory thereof, or in the District of Columbia, operating under the terms of a franchise and engaged in the sale or distribution of new passenger cars, trucks, vans, and station wagons. SECTION 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 5. This Ordinance shall take effect immediately upon its adoption by the City Council and approval as provided by law. SECTION 6. The City Clerk is hereby directed to advertise this Ordinance as required by law. The first reading of the above Ordinance is read in full and passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held on the _//_ day of 1979, and approved as provided by law.
