CITY COUNCIL OF THE CITY OF EDGEWATER
REGULAR MEETING HELD
February 14, 1977
ROLL CALL:
The City Clerk stated that the tape was not working, and the record
should show that Mr. Opal was interrupting the whole time she was
calling the roll and explaining that the Mayor and Mrs. Webber are
in Daytona, Mr. Riggs and Mr. Sikes answered the roll. Mr. Dietz
attended a meeting this afternoon and evidently is not back either.

The City Clerk stated that the meeting will have to be recessed until
7:30 P.M. tomorrow evening in the Mayor's office which is according to
the City Charter. Not the Code, but the Charter which states that you
recess from day to day and compel the attendance of the absent members.
Councilman Sikes asked the City Clerk to be sure to have the Chief of
Police deliver notification of the meeting.

Mayor Armstrong called order to the meeting of the City Council of the
City of Edgewater, Tuesday, February 15, 1977 at 7:30 P.M.

At this time Mayor Armstrong asked for the attorney's oplnlon as to whether
this is a legally recessed meeting,since the Ordinance reads that we will
hold our meetings on Monday nights, except holidays. He explained that last
night there were only two members of the Council present none of them being
the mayor, vice mayor or the acting mayor, and the City Clerk recessed the
meeting until tonight.

Attorney Gillespie stated that he does not think that they are legally
constituted tonight, however if they want to hold a meeting go ahead.
He said that there was not a legal meeting last night, there was no
guorum present and you have to follow your Code of Ordinances on having
a meeting. He stated that he does not understand the constant problems
that go on in this municipality with the petty things that he keeps hearing
about. He suggested that the Council not have this meeting tonight that they
hold their regular meeting next Monday and then they select another attorney.
He added that he is giving notice that he wants to terminate his relationship
with the Council as soon as he can.
Mayor Armstrong stated that he did not want to conduct a meeting that was
not in accordance with the law.
Attorney Gillespie stated that if the Mayor and the Councilmen called the
meeting, it is a legal meeting, however it is his understanding that the
meeting was called by the City Clerk. The Charter is clear on who shall
call a special meeting. He asked the Mayor if he called the meeting?
Mayor Armstrong answered no.
Attorney Gillespie stated that there is no meeting.
Mayor Armstrong stated that the meeting is adjourned.
