EMERGENCY RESOLUTION NO. 2016-R- 36
AN EMERGENCY RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF EDGEWATER, FLORIDA, CONFIRMING A
DECLARATION OF A STATE OF EMERGENCY IN THE CITY
OF EDGEWATER, FLORIDA.
WHEREAS, a State of Emergency in the State of Florida was proclaimed by GOVERNOR
RICK SCOTT on OCTOBER 4, 2016 due to HURRICANE MATTHEW; and
WHEREAS, a Federal Emergency Declaration was proclaimed by PRESIDENT BARRACK
OBAMA on OCTOBER 6, 2016 due to HURRICANE MATTHEW; and
WHEREAS, on 7th October 2016, the City Council approved Resolution No. 2016-R-35 which
placed a curfew between the hours of 12:00 AM and 7:00 AM daily and effective until it is declared
safe to terminate such curfew; and
WHEREAS, the majority of the City has had electricity restored, residents have returned home
and the roads have been opened for traffic; and
WHEREAS, the Police Chief has deemed it safe and recommends that the curfew be
rescinded.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, AS FOLLOWS:
Section 1. The threat of HURRICANE MATTHEW has passed and most residents have
returned home to safe guard their property. Daily police operations have returned to normal and the
conditions requiring the need for a curfew no longer exist.
Section 2. The curfew as enacted on 7th October 2016, with Resolution 2016-R-35 shall be
rescinded.
Section 5. This resolution shall take effect immediately upon adoption.

SUMMARY:
HURRICANE MATTHEW has caused damage to numerous properties rendering them unsafe or marginally habitable
forcing residents from their residences and business and commercial activities to remain closed. The following deferral
of certain building regulations, fees and procedures shall remain in effect for sixty (60) days:
•Permit fees for hurricane-related work shall be waived for sixty (60) days beginning Monday, Oct. 10, 2016;
•Tree removal permits for storm damaged tree removal shall be suspended for sixty (60) days beginning Monday,
Oct. 10, 2016;
•Temporary sign permit fees shall be waived and issued for storm related destroyed/damaged or otherwise
illegible signs for sixty (60) days beginning Monday, Oct. 10, 2016.

EMERGENCY RESOLUTION NO. 2016-R-37
AN EMERGENCY RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF EDGEWATER, FLORIDA,
CONFIRMING A DECLARATION OF A STATE OF
EMERGENCY, AND SUSPENDING CERTAIN LOCAL
BUILDING REGULATIONS UNDER EMERGENCY
CONDITIONS.
WHEREAS, a State of Emergency in the City of Edgewater was proclaimed by
GOVERNOR RICK SCOTT on OCTOBER 4, 2016 due to HURRICANE MATTHEW; and
WHEREAS,HURRICANE MATTHEW has caused extensive damage to public and
private property within the City of Edgewater; and
WHEREAS, the expeditious restoration of property to pre-existing conditions is vital to
enable the re-establishment of shelter for residents, businesses and public activities; and
WHEREAS, adherence to certain local established building regulations and procedures
can delay the process of restoring properties to conditions existing prior to the emergency; and
WHEREAS, Chapter 8 of the City of Edgewater Code of Ordinances authorizes the
suspension of local building regulations during a state of emergency.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF EDGEWATER, FLORIDA, AS FOLLOWS:
Section 1. A declaration of a State of Emergency proclaimed on OCTOBER 4, 2016 is
hereby confirmed.
Section 2. HURRICANE MATTHEW has caused damage to numerous properties
rendering them unsafe or marginally habitable forcing residents from their residences and
business and commercial activities to remain closed.
Section 3. The following deferral of certain building regulations, fees and procedures
shall remain in effect for sixty (60) days:

Section 4. Contractors and businesses seeking permits for residential and commercial
emergency repairs related to HURRICANE MATTHEW must report to the Development
Services/Building Department office (104 North Riverside Drive) to provide their license and
proof of insurance to prove they are eligible to perform the work intended. Residents are

cautioned to hire Florida licensed contractors only and to be wary of door-to-door solicitors
asking for large deposits or who promise to speed up the permit process.
Section 5. This resolution shall take effect immediately upon adoption.
