Mayor Armstrong called the special meeting of the City Council of the City of
Edgewater to order, December 31, 1975, at 3:00 P.M..

Mayor Armstrong stated that the first order of business is the Bond Resolution.
RES. NO. 627
A RESOLUTION PROVIDING FOR THE ACQUISITION, CONSTRUCTION AND ERECTION OF EXTEN-
SIONS AND IMPROVEMENTS TO THE MUNICIPAL WATER AND SEWER SYSTEM OF THE CITY OF
EDGEWATER, FLORIDA: AUTHORIZING THE ISSUANCE BY THE CITY OF NOT EXCEEDING
$700,000 WATER AND SEWER REVENUE BONDS TO FINANCE A PART OF THE COST THEREOF,
PLEDGING THE NET REVENUES OF SAID SYSTEM, CERTAIN MUNICIPAL EXCISE TAXES, AND
ALL MONEYS OF THE CITY DERIVED FROM SOURCES OTHER THAN AD VALOREM TAXATION
AND LEGALLY AVAILABLE FOR SUCH PURPOSE, TO SECURE PAYMENT OF THE PRINCIPAL
OF AND INTEREST ON THE BONDS: AND PROVIDING FOR THE RIGHTS OF THE HOLDERS
OF THE BONDS, REPEALING ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT
HEREWITH, SPECIFICALLY REPEALING RESOLUTION NO. 607, AND PROVIDING AN EFFEC-
TIVE DATE THEREFORE.
City Attorney Weaver read the above Resolution by title only.
Councilman Dietz made a motion to adopt this Resolution, being seconded by
Councilman'Sikes.
For the Councils information, the tape jammed and some of the discussion was
missed.
Mayor Armstrong stated that he feels that doing this this way we will .be
thinking of all the people in Edgewater. He stated that we have to go to
a secondary system.
Councilman Dietz stated that we should also remember that we were told that
even though we apply for the $700,000 we are only going to get the portion~
that we spend, and we will only pay interest on the amount of money that we
get.
Mayor. Armstrong explained that we are rescinding the Resolution that applied
for a $900,000 loan, and we are only putting back into effect the $700,000.
Councilwoman Webber stated that she is not against the sewer, of course she
didn't want to obligate the people of Edgewater, and she added that she doesn't
understand these sudden changes and she feels that we need further investigation.
She stated that she feels that we should have a group of citizens to investigate
this before we obligate the City any further.

Councilman Dietz stated that this is the Council's responsibility
Councilman Sikes stated that he doesn't know that this is a sudden change, because
we have been discussing this for the past two years.
Councilwoman Webber stated that when something has been voted on and then the
following week rescinded, it leaves you wondering.
Mr. Walter Gross spoke to the Council that he agrees that we have not looked
into this enough to decide what we really need.
Councilman Cairnie stated that we have a deadline to meet.
Councilman Dietz called for the question.
Mr. Wharton asked several questions which Mayor Armstrong answered.
Councilman Cairnie stated that our engineers have a set of plans for us, and
we have to pay for them whether we use them or not, so we are stuck.
Mayor Armstrong explained that this is true, so we have to pick up the pieces
10 min. and try to put them back together, doing what we feel will be to the best
interest of the citizens of Edgewater.
Mr. Gross asked if Mayor Armstrong really feels that we will not need another
rate increase to pay for this loan.
Mayor Armstrong answered that he very carefully went over the rate structure
on this and we should still make a reasonable profit with a cushion to build

Councilwoman stated that before we vote on this she would like Mr. Weaver to
read something about the water and sewer from the Resolution.
Attorney Weaver read from the title that this is for the acquisition, con-
struction and erection of extensions and improvements to the municipal water
and sewer system of the City of Edgewater.
Councilwoman Webber stated that that has been no provision made on this what-
soever.
Mayor Armstrong stated that when we talk about the system we have to talk about
water and sewer, and this is the only way we can word it.
Mrs. Woodard asked if the $700,000 is going to effect Florida Shores?
20 min. Mayor Armstrong stated that this will provide a 1 million gallon a day plant
at the sewer plant and under the 201 program we may be able to impliment a
plan to run lines to Florida Shores. This will be the starting place for
the service, and if we don1t have the facility plant there will be no way to
put the lines out there.
Councilman Dietz called for the roll call. Said motion CARRIED:
Councilwoman Webber stated that she is not ready to vote, but she understands
that she must vote, and she stated ,that she is voting NO, although she feels
that this needs further investigation.
Councilman Cairnie stated that he feels the questions that he has asked have
satisfied him that we have to do something, so he will have to vote YES.
Councilman Sikes, Councilman Dietz and Mayor Armstrong also voting YES.
25 min. Mayor Armstrong stated that he has a letter from Judge Mann, which the City
Clerk read. Mr. Mann wrote that his services will not be available after
December 31, 1975.

Mayor Armstrong stated that he has spoke with Mr. Mann and he was agreeable to
stay with the City of Edgewater until we can find a suitable City Judge if we
will compensate him $400.00 a month.
Councilman Dietz made a motion that we send Mr. Mann a letter asking him to
stay on and increase his compensation to $400.00 a month and ask him to stay
on as judge protem until we can find a Judge, being seconded by Councilwoman
Webber. Upon roll call vote said motion CARRIED.
Mayor Armstrong stated that he was served a summons relative to Mr. Corbett
Smith in a petition against the City of Edgewater. The case being relative
to his occupational license which the Council denied because of the Zoning.
He stated that he would recommend that we direct the City Attorney to file
a motion for dismissal, because there are a number of errors in his petition.
Mr. Smith hasn't even exhausted an effort to the Zoning Board or the Board of
Appeals to ask for a change in Zoning.
Councilman Cairnie made a motion to instruct the City Attorney to file a
motion for dismissal, being seconded by Councilman Dietz. Upon roll call
vote said motion CARRIED.
Mayor Armstrong stated that we have 35 applicants for the Chief of Police to
date, and since we have so many of them he recommends to the Council that
they individually go over all of the applications and list the names that
you feel is best qualified. Perhaps a list of twelve or fifteen names from
each Council member, then we could cut the number down in order to have
personal interviews.
Mr. Walter Gross asked if George Katez is receiving his unemployment insurance,
which is $80 some a week, if we could get a good Police Chief for that much
less than what we would pay another Police Chief that should be considered
as good business for the City.
Mayor Armstrong stated that each applicant will be given the same opportunity.
Mayor Armstrong stated that the only other item which has come up is allowing
the bars on New Years Eve to stay open two extra hours.
Councilman Dietz made a statement that if we do not allow our bars to stay
open people will just go to New Smyrna.
There was general agreement about this being a good idea.
There was discussion about the overtime in the Police Department, and that
the City of Edgewater should hire another patrolman instead of paying all
of the overtime.
Mr. Shell stated that on behalf of the Edgewater Shuffleboard Club he would
like to thank the cooperation that was received at the tournament when Mr.
McDougle was taken ill. If it hadn't been for the officers we may have
lost Mr. McDougle.
Councilman Dietz made a motion to adjourn, being seconded by Councilwoman
Webber. Upon roll call vote said motion CARRIED.
