CITIZEN COMMENTS Page 1City of Edgewater Printed on 7/21/2021 January 11, 2021City Council Meeting Minutes Glenn Powers, 2628 Yule Tree Drive, spoke about the Wreaths Across America ceremony that was recently held and thanked everyone who participated and assisted with the event. He also indicated that the 2021 ceremony will be held on December 18th. Libby Lavette, 1820 Hibiscus Drive, spoke about the utility bills, the petition that was circulated and provided residents with information about contracting with Armitage Plumbing to have a second meter installed for a month to compare with the city readings. Tommy Armitage, Armitage Plumbing, provided additional information on the program he is offering. There was additional discussion regarding the process, type of meter and cost of said service. 5. APPROVAL OR CHANGES/MODIFICATIONS TO THE AGENDA Item 10(a) pulled at the request of Mr. Irby. 6. CITY COUNCIL REPORTS Councilwoman Power commented on the recent TPO Executive Committee meeting. Councilwoman Bennington requested the City Managers contract be placed on the February agenda for discussion. Discussion ensued about the reasoning behind the request. Councilwoman Bennington clarified that she had received complaints and would like to discuss them openly as an agenda item so that citizens comments can be included; Councilwoman O'Keefe stated that any issues should be discussed, despite Council already approving the contract. Councilwoman Bennington also asked to see the individual evaluations of the City Manager. Council agreed to put the discussion regarding the City Manager on the February 1st agenda. Councilwoman Bennington also requested Council be given Quarterly Reports again and was informed that they are still being provided. Councilwoman O'Keefe stated that she attended Wreaths across America and recognized Glenn Powers for putting the event together; she also attended the drive-thru light up event and commended staff on a job well done despite complications. Councilman Powers had nothing additional to add. Mayor Thomas thanked everyone for attending the events and apologized for his absence due to illness. He spoke about attending the Mayor's Round Table with Mr. Irby and updated Council on the various speakers; he provided the election certificates to Councilman Powers and Councilwoman Bennington. Mayor Thomas stated he would like to see the Environmental Advisory Committee up and running; Mr. Irby stated he was going to discuss that under his report. Mayor Thomas commented on getting raises for the CDL drivers. He would also like to have another utility workshop in the near future; there was additional discussion on the utility issues and how residents can try to address their issues. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS a.2nd Reading - Ordinance No. 2020-O-33 Police Pension Changes City Attorney Wolfe read the Ordinance into the record. City Manager Irby advised Council that there was no additional information on the request. Mayor Thomas opened and closed the public hearing A motion was made by Councilwoman O'Keefe, second by Councilwoman Power, to approve Ordinance No. 2020-O-33. The MOTION was APPROVED by the following vote: Yes:Mayor Thomas, Councilwoman Power, Councilwoman Bennington, Councilwoman O'Keefe and Councilman Powers 5 - b.2nd Reading - Ordinance No. 2020-O-37 - Amending and restating Chapter 19 (Utilities and Services), Article V (Solid Waste Collection and Disposal) Division 1 (Generally) and Division 2 (Recyclable Materials) due to scriveners errors City Attorney Wolfe read the ordinance into the record. City Manager Irby stated that the changes were to clean up scriveners errors and that staff recommended approval. Mayor Thomas opened the public hearing. Libby Lavette, 1820 Hibiscus Drive, stated she was unable to find the changes in the agenda documents; she also asked about the $35 disconnect fee being reworded and if that was on the current agenda. City Attorney Wolfe read the Ordinance into the record. Mayor Thomas asked for clarification that there are going to be duplexes added to the existing ones, Mr. Irby confirmed and stated that the city is also the applicant. Mayor Thomas opened and closed the public hearing. A motion was made by Councilwoman Power, second by Councilwoman O'Keefe, to approve Ordinance No. 2020-O-41. City Attorney Wolfe read the Ordinance into the record. No staff report provided. Mayor Thomas opened and closed the public hearing. A motion was made by Councilwoman O'Keefe, second by Councilwoman Power, to approve Ordinance No. 2020-O-42. The MOTION was APPROVED by the following vote: Yes:Mayor Thomas, Councilwoman Power, Councilwoman Bennington, Councilwoman O'Keefe and Councilman Powers 5 - h.Second Reading Ordinance 2021-O-01 Chapter 12 Offense Section 12-2 Trespassing City Attorney Wolfe read the Ordinance into the record. Mr. Irby provided a staff report and recommendation. Mayor Thomas opened the public hearing. Page 6City of Edgewater Printed on 7/21/2021 January 11, 2021City Council Meeting Minutes Councilwoman Power inquired if it was possible to have both the City Manager and the Police Chief make the decision together to determine if trespassed individuals are allowed reentry into parks, Councilwoman O'Keefe agreed with the proposition and Mr. Irby stated that it could be added for the second reading. Mayor Thomas closed the public hearing. A motion was made by Councilwoman Power, second by Councilwoman O'Keefe, to approve Ordinance No. 2021-O-01 to include changing paragraph i (14) to read "... police chief and city manager...", . The MOTION was APPROVED by the following vote: Yes:Mayor Thomas, Councilwoman Power, Councilwoman Bennington, Councilwoman O'Keefe and Councilman Powers 5 - 9. BOARD APPOINTMENTS None at this time. 10. OTHER BUSINESS None at this time. 11. OFFICER REPORTS a.City Clerk Ms. Brown stated that she had the advisory boards that a Councilperson sits on, as discussed last month. Discussion continued on to decide who would be Mayor Thomas' alternate for the Elected City Officials Roundtable, with Councilwoman Bennington taking the position; Councilwoman Bennington also volunteered to be the alternate for the TPO; Councilman Powers was appointed to the YMCA board; Councilwoman O'Keefe stayed on the School Concurrency Advisory committee. Council then proceeded to discuss Team Volusia; Councilwoman Power recommended Councilman Powers for the position, with Councilwoman O'Keefe stepping in as his alternate. Ms. Brown provided a reminder about the Council photos. b.City Attorney Mayor Thomas asked about the Marina Litigation, with City Attorney Wolfe providing an update on the case. City Attorney Wolfe had no other comments. c.City Manager Mr. Irby discussed the Environmental Advisory Board; he stated that either Council could conduct the interviews or that the City Staff could do the interviews and then Council would be presented with the staffs chosen applicants. After discussion, Council decided that the City Staff conducting the interviews would be the most efficient plan. CITIZEN COMMENTS Libby Lavette, 1820 Hibiscus Drive, stated she was happy with how the Council Meeting went and provided a suggestion for the appointment process for the Environmental Advisory Board. She then discussed the Edgewater Marina and the violations that have happened concerning construction, permits and the contractor. 14.
