09-29-1975 - Special . ~"'" v v CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA SPECIAL MEETING HELD SEPTEMBER 29, 1975 The Special meeting of the City Council of the City of Edgewater, was called to order at 7:30 P.M. September 29, 1975, by Mayor David C. Severance. ROLL CALL Mayor David C. Severance Councilman Jacob Lodico Councilman William Cairnie Councilman Walter B. Sikes Councilman Calvin R. Dietz City Manager Dale Bryant City Attorney Joseph Weaver City Clerk Sue Blackwell Acting Chief McCall Present Present Present Present Present Excused Present Present Present Mayor Severance read the notice which gave the purpose for this meeting: 1) Certify candidates for election 2) Adopt a resolution naming clerks and inspectors for Primary election, if necessary, and the General Election to be held on November 4, 1975 3) Okay bills that need to be paid before the end of this fiscal year 4) Take care of any and all business concerning the fiscal year 1974-75 The City Clerk read the bills and accounts. Mr. Armstrong asked a question about the Brown's Air Conditioning bill and if it was for a burned out engine shouldn't the insurance pay for it? Mayor Severance stated that this could be checked into. Councilman Cairnie made a motion to pay the bills, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. COMMUNICATIONS Certificati:on RESOLUTIONS RES. NO. 599 A RESOLUTION DECLARING THE CANDIDATES FOR THE OFFICE OF COUNCILMAN FROM ZONE 1 AND THE CANDIDATES FOR THE OFFICE OF MAYOR TO BE NOMI- NATED AT A PRIMARY ELECTION TO BE HELD ON THE 21ST DAY OF OCTOBER, 1975 AND DECLARING THE CANDIDATES FROM ZONES 1 AND 3 AND DECLARING THE CANDIDATES AND NOMINATIOnS FOR MAYOR TO BE VOTED UPON CITY WIDE AND PROVIDING FOR THE PREPARATION AND PRINTING OF BALLOTS FOR SAID ELECTION, AND PROVIDING AN EFFECTIVE DATE THEREFOR. Attonney Weaver read the Resolution in full. o v Councilman Cairnie made a motion that this Resolution be adopted being seconded by Councilman Dietz. Mr. Gross asked if Mr. Sikes has any profit sharing or does he own any securities in the bank where we have our business? Mayor Severance stated that this is not a question directly in- volving the Resolution. Mr. Odell asked if Mr. Lodico and Mr. Sikes have to submit a resignation in order to run for office? The City ~lerk stated that the City Council sits in judge of its 10 min. own elections and the results of the election are posted the night after the election. Mrs. Woodard spoke in regard to the conflict of interest which is what she read in the paper. Attorney Weaver stated that this has already been discussed. Upon roll call vote said motion CARRIED. ORDINANCES None OLD BUSINESS The City Clerk stated that she has not been able to get enough people to serve, however she will continue to work on this and will get the list to the Council at the next workshop. Mr. Taylor stated that he was in the City Hall today and learned that two people in there have been threatened with death, and he would like to know what the City is doing about this. ( Mayor Severance stated that this is the first he has heard of this, however he knew that Mr. Bryant's family and wife were threatened a while back. , Councilman Dietz stated that he was called this morning by Mr. Tucker and was informed of this, and he stated that he instructed Mr. Tucker to contact the States Attorney office to find out what he should do. He stated that he instructed the acting Chief of Police to take re- ports from Mr. Tucker and Mr. Bryant and they are proceeding from 15 min. there. Mr. Taylor stated that when he came into City Hall two Councilmen were meeting with Mr. Tucker, and he was told that he had been fol- lowed on the night of the Chief's hearing and so on. Mayor Severance called a hault to the conversation by stating that according to Mr. Dietz the police department is involved with the situation and so is the States Attorney office. Mr. Taylor stated that it seems to him that these men should be guarded. Councilman Dietz stated that it would be a breach to explain what steps are being taken. Councilman Lodico stated that this is not on the agenda. -2- Q o Mayor Severance stated that we will go on to the discussion of the budget. Councilman CAirnie asked the City Clerk about adjusting the departments. The City Clerk stated that she got in touch with the auditors and although the budget is going to be overexpended, they said there was no need to adjust it, because if they did to cover anything we would have to raise the amount of the budget which would require a Public Hearing and there is not sufficient time to give notice on it. The Auditor said that taking the emergencies which has a balance in it, Fire Dept. and various others, it would not help the overall picture of the budget so there was no point in doing it. Councilman Lodico asked that according to the auditors books are we going to have a balance? The City Clerk explained that Mr. Cunningham said that there would be a surplus and it would be approximately $62,000. 20 min. The City Clerk explained that she has eleven names of people who said that if they were asked, they would serve for the election. She read her list. There were several people from the audience who gave their names as being interested in working. Tape 1 Side B MISCELLANEOUS Councilman Dietz gave a report on this meeting with Mr. Kelly in regard to selling water to Indian Harbor Estates. He stated that they were very interested. He stated that we are hoping to have this all lined up for the workshop of the County Council on October 14. He stated that we should also have a report from Mr. Fernandez about this. Mr. Mackie had a question about the rates for the City and the County. Councilman Dietz stated that the County is going to pay higher rates.
