Results were received from the Department of Elections with the following results for District 2 - Councilwoman Kimberly Klein-Yaney. City of Edgewater Printed on 4/11/2019Page 1 of 1 powered by Legistar™ 1 Resolution #2019-R-05 RESOLUTION 2019-R- 05 A RESOLUTION OF THE CITY COUNCIL OF EDGEWATER, FLORIDA, ACCEPTING AND ADOPTING THE ELECTION RESULTS OF THE APRIL 2, 2019 SPECIAL GENERAL ELECTION, PROVIDING FOR INTENT AND PURPOSE OF RESOLUTION; PROVIDING FOR SEVERABILITY; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, District 2 Councilwoman Amy Vogt resigned effective January 4, 2019. Pursuant to Resolution No. 2019-R-02, City Council called a Special Election to fill the vacancy for the unexpired term. Council selected February 19, 2019 for the Special Primary Election and April 2, 2019 for the Special General Election. WHEREAS, on February 19, 2019, the Special Primary Election was held within the City of Edgewater for determination of City Council for District 2. Three candidates qualified as follows: 1) Gigi Bennington, 2) Jennifer Parker and 3) Kimberly Klein-Yaney. The results from the February 19th determined that the following candidates would go forward to the Special General Election held on April 2, 2019: 1) Jennifer Parker and 2) Kimberly Klein-Yaney. WHEREAS, the City Council of the City of Edgewater, Florida, has determined that all votes have been tabulated and confirmed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, as follows: Section 1. The candidates in the February 19, 2019 Special Primary Election received the number of votes as set forth below: DISTRICT 2 Gigi Bennington 313 Jennifer Parker 621 Kimberly Klein-Yaney 690 2 Resolution #2019-R-05 Section 2. The candidates in the April 2, 2019 Special General Election received the number of votes as set forth below: DISTRICT 2 Jennifer Parker 1,138 Kimberly Klein-Yaney 1,319 Section 3. The Council member elected for the remainder of term of office for District 2, beginning on May 6, 2019 and ending November 2020, is set forth below: DISTRICT 2 Kimberly Klein-Yaney Section 4. Acceptance and Adoption of Election Results. The results of the February 19, 2019 Special Primary Election and of the April 2, 2019 Special General Election are hereby accepted and adopted by the City Council. The Official Election Results and Certificate of the City Canvassing Board are attached hereto and incorporated herein as Exhibit “A”. Section 5. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 6. All resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. Section 7. Effective Date.
