JUNE 26, 1975 '~.~.~lt , ' The regular meeting of the City Council of the City of Edg~~ater was called to order Thursday, June 26,1975, at 7:30 P.M., by Mayor David C. Severance. Katez Present Excused Present Excused Present Present Present Present Present INVOCATION SALUTE TO FLAG APPROVAL OF MINUTES Councilman Cairnie made a motion to accept the minutes of the special meeting, May 27, 1975, being seconded by Councilman Dietz. Upon roll call vote said motion CARRIED. Councilman Cairnie made a motion to accept the minutes of the Public Hearing, June 12, 1975, being seconded by Councilman Dietz. Upon roll call vote said motion CARRIED. Councilman Dietz made a motion to accept the minutes of the regular meeting, June 12, 1975. Councilman Cairnie stated that there should be a correction on page 3, the "Federal Government" should be changed to read "County". Councilman Cairnie seconded Councilman Dietz's motion including this correction. Upon roll call vote said motion CARRIED. AUDITOR'6 REPORT At this time the floor was given to Mr. Cliff Cunningham of May, Zima and Company to discuss the comments dated March 31, 1975 of the mid year audit. Tape 1 Side A 10 min. 20 min. 25 min. Tape 1 Side B o min. 5 min. ~ '. . u ~ Mr. Cunningham went page by page explaining the figures on the report. Councilman Dietz asked Mr. Cunningham about the cash on hand. Mr. Cunningham stated that the amount of tangible money that you can spend is about $~5,800.00 Councilman Dietz asked if any of this money has been spoken for or commitments against it? Mr. Cunningham stated no, you have this much money to spend, if you need to dip into it, you can, without getting into trouble. If you collect the $35,000.00 which the Water and Sewer System Construction Fund owes, you will have approximately $90,000.00. Mr. Cunningham stated that the six month's review indicates that the City is going to be pretty well on budget at the year's end. A lot of expenses were paid the first part of this year which will not need to be paid the second half of the year. He stated that basicly all you have to payout is your operating costs. Councilman Dietz stated that we have $21,000.00 for a garbage truck and $40,000.00. for the barn. Mr. Cunningham asked if this money appropriated from the Fund balance? City Manager Bryant stated that this is in the Capital Improve- ment. Mr. Cunningham stated that the City had an excess on the col- lections on what was estimated. Councilman Dietz stated that he feels that it is not right at this time to raise the peoples rates and taxes, and he wants to know exactly where we stand financially and how we can run this City, the programs that we have started we should finish but we have got to know we have the money to do it. He stated that if we have the money in surplus, lets use the surplus. Mr. Cunningham stated that he certainly does not suggest carrying a large surplus. He stated that the most economically thing to do is to have the administrative personnel draw up a trial balance and send it to him, and they can pretty well tell the City what the fund balance is and how much money you are going to have to spend next year. Councilman Dietz stated that we shouaa instruct the City Clerk and the City Manager to draw this up and get it by the first meeting in August and discuss it them. Councilman Dietz asked if we over collected and we spent that amount, where is it going to be shown on this report or budget if you dont change the bottem line figure? Mr. Cunningham stated that it would be shown in the actual expenditure column. If you did not know that you were going to spend this money or collect it, then you could not have allowed for it in the budget. There was some confusion in regard to this matter. -2- 15 min. 20 min. 25 min. Tape 2 Side A o min. 5 min. ~ Q Councilman Cairnie stated that he feels that the Government programs should be kept in a seperate column, because from looking at the report we do not know that the government is paying for any of these things. There was some conversation about the reports being more detailed and listing every expenditure. Mr. Cunningham stated that it is almost impossible to have this more detailed than it already is. Mr. Wharton asked Mr. Cunningham a question in regards to the cash figure on his report. Mr. Cunningham explained this to Mr. Wharton. Councilman Dietz stated that in regards to the Water and Sewer the review report is very clear, he asked Mr. Cunningham what he means by the comment that a review in updating the City's accounting and financial reporting procedures be made. Mr. Cunningham answered that specifically the State has required that each municipality prepare and Rave on file written accounting and bookkeeping procedu~es. Mr. Cunningham stated that in regards to the Water and Sewer a real good job was done. Mayor Severance thanked Mr. Cunningham for coming to the meeting and answering the questions. BILLS AND ACCOUNTS Councilman Cairnie made a motion to pay the bills, Councilman Dietz stated that this includes the May, Zima bill which was marked held, and seconded the motion. Upon roll call vote said motion CARRIED. At this time Mayor Severance stated that Mr. Weaver has to catch a plane and fly to see his father who has recently had a stroke and he would like permission from the Council to let Mr. Weaver report at this time on the judg~~s qualifications. There being no objections from the Council, Attorney Weaver did so. He stated that there are no qualifications established for a municipal judge. A man does not have to be a lawyer to be a judge. City Attorney Weaver stated that he would like to be put on the agenda for the next workshop to discuss the annexation question. City Attorney Weaver stated that he would like to explain the one Ordinance which is coming up for first reading, This is adopting the building, electrical, plumbing and mechanical code of the County, which is the Southern Standard Code plus County amendments and also it will be the policy of Edgewater to set its own Ordinances which are more stringent. -3- . " ~ Q COMMUNICATIONS Certification of posting Clerk's Cash Statement, May 1975 General Fund Budget Report, May 1975 10 min. City Clerk read a recommendation from the City Manager and the Merit Board in regards to a raise for Mr. Sigurd Ohrwall, Super- intendent of the Sewer Department. This raise being from $3.86 to $4.05. Councilman Cairnie made a motion to accept the recommendation of the Merit Board, being seconded by Councilman Dietz. Upon roll call vote said motion CARRIED. City Clerk read a memorandum from the Merit Board requesting amendments to Ordinance 874, that the Merit Board be allowed to look at the work reviews and evaluation sheets when an employee comes to the board for a raise, and that all depart- ment heads be evaluated by the City Manager. Mayor Seve~ance stated that the second item is already in effect. Mayor Severance read the ballot which elected the Merit Board for the City of Edgewater. 15 min. Councilman Dietz stated that only in the case of grievances should the Merit Board see the evaluations, not in the case just for an individual's raise. Councilman Cairnie made a motion to deny the request of the personnel records at this time and that at the next workshop meeting we look over this, that is except for a gri~vance case, being seconded by Councilman Dietz. Mr. Fredericks asked if this means his personal records or his work records. He aksed how the Merit Board could decide whether an individual deserves a raise if they can not see his work records? 20 min. Councilman Dietz stated that it is not up to the Merit Board whether an indivudual has a raise, it is up to the City Manager. The Merit Board does not control wages or increase in salaries. Upon roll call vote said motion CARRIED. The City Clerk read a memorandum from the Board of Adjustments in regard to the variance requested by Mr. Eugene W. Barnes on the required setbacks on Lot 15, and all the remaining portions of Lot 16 and 17 east of State Highway HI, all being in Block 11, Totem Park in the City of Edgewater. The board granted Mr. Barnes this variance. Councilman Dietz made a motion to accept the recommendation of the Board of Adjustments and grant the variance, being seconded by Councilman Cairnie. Upon roll call vote said motion CARRIED. The City Clerk read a letter of thanks for the recreation program, and request to abandon the plans for the new water plant. This was read as a matter of information. -4- o o There was a question from the audience in regard to this and Mayor Severance stated that if we don't improve the quality and quantity of our water we are going to be forced to hook up to the nearest community who can serve us and the rates will be very hight Tape 2 Side B o min. Mrs. Webber asked if F.H.A. is not only for farming communities? City Manager Bryant answered that F.H.A. works with any comg munity with less than 10,000 people. 5 min. Mr. Armstrong spoke to the Council in regard to the water improvements, in regard to the location of the new plant and in regard to the system itself. He stated that he does not see how the full plan of the sewer plant operation and the water plant operation all at one time. The City Clerk read a petition in regard to "Dial a Ride". Mayor Severance stated that the reason this communication was sent to the Council was to get a favorable decision from the Council. Councilman Dietz made a motion that the mayor write a letter to the appropriate parties stating that the Council of Edge- water is on record as supporting this petition, being seconded by Councilman Cairnie. Upon roll call vote said motion CARRIED. The City Clerk read a letter from Mr. John Whatton requesting permission to speak at this meeting. Mr. Wharton was given the floor at this time. Mr. Wharton stated that he is referring to the $44,000.00 in parks and pier. He stated that Mr. Bryant said that the auditor's made a note in their report in regards to this amount. He asked where is that note? 10 min. City Manager Bryant stated that he doesn't think he made the statement that the auditor's made a note, he did however say that we had taken money in through the CETA program in the general fund. He explained how this system works. Mayor Severance explained how this figure was shown in Capital Improvements. 15 min. After much confusion as to where certain figures can be found on the report, Mayor Severance stated that he is hoping that by changing or revising the format that we use in preparing the budget will elliminate all the confusion. Mr. Taylor asked how many people are hired under the CETA program? City Manager Bryant stated that there are twenty employees. 20 min. RESOLUTIONS RES. NO. 580 A RESOLUTION COMMENDING MURIEL IHNKEN, LIBRARIAN OF THE CITY OF EDGEWATER, FLORIDA, AUGUST 1971-JUNE 1975 AND AS ASSISTANT LIBRARIAN OCTOBER L969-AUGUST 1971 AND FOR HER MANY CONTRIBUTIONS AND VALUABLE SERVICES TO THE CITY OF EDGEWATER. Mayor Severance read this Resolution in full. -5- Q u Councilman Cairnie made a motion to adopt this Resolution, being seconded by Councilman Dietz. Upon roll call vote said motion CARRIED. RES. NO. 580 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA TO SUPPORT THE NATIONAL GUARD AND RESERVE. 25 min. Mayor Severance read this Resolution in full. Councilman Cairnie made a motion to adopt this Resolution, being seconded by Councilman Dietz. Upon roll call vote said motion CARRIED. ORDINANC~S Second Reading ORD. NO. 933 AN OREINANCE AUTHORIZING THE CITY MANAGER TO SIGN ALL CHECKS AND VOUCHERS ON ALL ACCOUNTS OF THE CITY OF EDGEWATER, FLORIDA, REPEALING SECTIONS OF THE CITY CHARTER AND CODE OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE THEREFORE. Mayor Severance read this Ordinance by title only. Tape 3 Side A o min. Councilman Dietz made a motion to adopt this Ordinance, being seconded by Councilman Cairnie. Upon roll call vote said motion CARRIED. First Reading ORD NO. 934 AN ORDINANCE ADOPTING THE 1973 EDITION OF THE SOUTHERN STANDARD BUILDING CODE, THE 1971 EDITION OF THE NATIONAL ELECTRIC CODE, THE 1971 EDITION OF THE SOUTHERN STANDARD PLUMBING CODE AND THE 1973 EDITION OF THE SOUTHERN STANDARD MECHANICAL CODE AND ALL AMENDMENTS AND ADDITIONS THERETO AS ADOPTED BY THE VOLUSIA COUNTY COUNCIL, TOGETHER WITH ALL ADDITIONS AND AMENDMENTS AND REVISIONS THERETO AS MAY BE ADOPTED FROM TIME TO TIME IN THE FUTURE, FURTHER PROVIDING THAT ALL ORDINANCES DEALING WITH BUILDING, ELECTRIC, PLUMBING AND MECHANICAL THAT PRESENTLY EXIST IN THE CITY OF EDGEWATER, FLORIDA, SHALL BE ENFORCED IF SAID ORDINANCES CREATE STANDARDS THAT ARE HIGHER AND MORE STRINGENT THAN THOSE STANDARDS ADOPTED BY THE COUNTY ORDINANCES, AMENDMENTS AND REVISIONS AND FURTHER PROVIDING AN EFFECTIVE DATE THEREFORE. Mayor Severance read this Ordinance by title only. Councilman Dietz made a motion to adopt this Ordinance, being seconded by Councilman Cairnie. Mr. Brown asked the Council why they are going this route rather than the route that the Building Code committee recommended. Councilman Dietz stated that they have check this with the County codes and with the County Inspector and there are not that many differences with their codes, and rather than get involved with the long lengthy ordinances of our own and the prob~em of enforcing them we decided to go this way. -6- . , . Q o Mr. Brown stated that the County's codes are out dated. Councilman D~etz stated that as long as we are going to use the County Inspector, we should use their laws, however he stated that our rates are different. 5 min. Mr. Brown stated that he feels we should not depend on the County. There was some discussion about whether the City of Edgewater should have their own Building Inspector. 10 min. Upon roll call vote on the motion to adopt this Ordinance, said motion CARRIED. Mayor Severance voting NO. Mayor Severance stated that he voted no because he feels the City of Edgewater needs their own code. OLD BUSINESS Mayor Severance read the City Manager's report on the cost of material to repair Indian River Boulevard. The approximate cost of this is $679.40. 15 min. Councilman Dietz made a motion to instruct the City Manager to go ahead with this project, being seconded by Councilman Cairnie. Upon roll call vote said motion CARRIED. NEW BUSINESS Councilman Cairnie reported on the VCOG meeting. He stated that the methods used on the waste for landfills was very interesting. He stated that Ormond Beach only makes zoning changes once a year. He stated that there was a lot of discussion about House Bill # 782, which provides that all municipalities must have a Planning Board. At this time Councilman Dietz reported on the prospects for the City Judge's position. He stated that Mr. McKinney is not available for the job, however he spoke with a Mr. Lyle B. Quick. City Manager Bryant spoke to the Council in regard to Mr. Quick's qualifications. Mayor Severance stated that he would like to wait until the second regular meeting in July to make any kind of decision on this. Tape 3 Side B o min. Mayor Severance asked the City Manager to get in touch with Mr. Quick and have him attend the second workshop in July. Chief Katez reported on the sub standard buildings around the City. He stated that action will be taken on all of these buildings. -7- .... ,.Jt. . o o MISCELLANEOUS City Manager Bryant spoke to the audience that if anyone who might have questions in regards to the City's operations, the budget, or whatever, please come into the City Hall and we will be glad to explain these things to you.
