Riverside Drive Edgewater, FL 32132 File #:2020-R-10,Version:1 COUNCIL AGENDA ITEM SUBJECT: Emergency Resolution No.2020-R-10 -Confirming a Declaration of a State of Emergency -Coronavirus (COVID-19) and associated Proclamation DEPARTMENT: City Clerk/Paralegal SUMMARY: Due to the Coronavirus (COVID-19),the State of Florida has approved Executive Order Number 20-52 (Emergency Management -COVID -19 Public Health Emergency)that went into effect on March 9,2020 for a period of sixty days. The County of Volusia entered into a Declaration of State of Local Emergency Related to Coronavirus Disease (COVID - 19) on March 13, 2020 for a period of seven days. Attached please find the City of Edgewater’s Emergency Resolution No.2020-R-10 Confirming a Declaration of a State of Emergency -Coronavirus (COVID-19)and the Proclamation authorizing the Emergency whereby the City Council determines that there is in fact an emergency and approves the City Manager to take necessary actions to protect the citizens and employees. WHEREAS, a State of Emergency for the State of Florida was proclaimed by GOVERNOR RON DESANTIS on MARCH 9, 2020 due to Coronavirus (COVID-19) (The Executive Order shall expire sixty days from this date unless extended); and WHEREAS, Edgewater citizens must be moved from harm’s way; and WHEREAS, Chapter 8 of the City of Edgewater Code of Ordinances authorizes the declaration of a curfew and the designation of areas as off limits during a state of emergency. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, AS FOLLOWS: Section 1. A confirmation that GOVERNOR RON DESANTIS declared a State of Emergency for the STATE OF FLORIDA, which includes the City of Edgewater, was proclaimed on MARCH 9, 2020 is hereby confirmed. Section 2. Coronavirus (COVID-19) may seriously affect and threaten the lives and property of residents of the City of Edgewater that requires emergency actions that protect the lives and property of citizens. Section 3. The County of Volusia issued a Declaration of State of Local Emergency Related to Coronavirus Disease (COVID-19) at 6:00 pm on March 13, 2020 for a period of seven (7) days. Section 4. Coronavirus (COVID-19) may seriously affect and create conditions which threaten the safety and security of the lives and property of the citizens of Edgewater and thereby the Volusia County Sheriff’s Office may institute a curfew if needed for the safety of citizens and to discourage loitering and prevent looting. If the Volusia County Sheriff’s Office does enact a curfew this hereby authorizes the City of Edgewater Police Department to enforce said curfew. Law enforcement officers will use discretion when enforcing the curfew. Section 5. Coronavirus (COVID-19) may seriously affect and create conditions which may threaten the safety and security of the lives and property of the citizens of the City of Edgewater and potentially may affect City of Edgewater employees doing business for the City. Pursuant to approval of City Council, the City Manager may make day to day decisions on behalf of the safety and wellbeing of the citizens and employees of the City of Edgewater pursuant to the State of Florida, Office of the Governor Executive Order Number 20-52 (Emergency Manager - COVID-19 Public Health Emergency). City Council has determined that there is in fact, an emergency and has approved that the City Manager take necessary actions to protect the citizens and employees. Any curfew, action may stay in place until March 31, 2020 unless rescinded/extended 2 #2019-R-10 by the City Manager or City Council. Section 6. This resolution shall take effect immediately upon adoption.
