was called to order Thursday, May 22, 1975, by Mayor David C.

INVOCATION
SALUTE TO FLAG
APPROVAL OF MINUTES:
Councilman Lodico made a motion to approve the minutes of the
meeting May 8, 1975, being seconded by Councilman Cairnie.
Upon roll call vote said motion CARRIED.
BILLS AND ACCOUNTS:
Councilman Cairnie made a motion to pay the bills, being seconded
by Councilman Lodico. Upon roll call vote said motion CARRIED.
PROCLAMATION:

Mayor Severance read a Proclamation setting forth May 24th as
Poppy Day in the City of Edgewater, Florida.
COMMUNICATIONS:
Certification of Posting
The City Clerk read a letter from the Planning Board in regard to
the following changes to the Cameron Trailer Park: (1) the closing
of the entrance to Industrial Road and Eaton Road (2) the realign-
ment of the mobile homes (3) relocation of the clubhouse.
Councilman Dietz made a motion that we accept the recommendations
from the Planning Board, being seconded by Councilman Lodico.
Upon roll call vote said motion CARRIED.

The City Clerk read a memorandum from the City Manager in regard
to a platform and table for the City Council. Councilman Lodico
made a motion to forget this project, being seconded by Council-
man Cairnie. Upon roll call vote said motion CARRIED.
Councilman Dietz stated that we should go ahead about the acoustics
in this room and some chairs for the-Council.

The City Clerk read a letter from the Board of Governors in
regard to a six weeks summer recreation program starting
June 16 and ending July 25. Also the board would like to
see benches erected around the tennis court~.
Mayor Severance stated that in regard to the request for
the benches, he thinks the City Manager should be advised
to carry this out.
In regard to the recreation program, Mayor Severance read
a memorandum from the City Manager in regard to what the
recreational director of New Smyrna Beach and the County
had to say.
Mayor Severance stated that the County has not formulated
their entire program as of yet, however there is a chance
that the County could help us financially by paying one of
the supervisors.
Councilman Sikes stated that he would like to suggest that
we set a dollar amount that we will pay and let them set a
registration fee from that.
Councilman Dietz stated that he has a question as to how New
Smyrna Beach got $9,000.00 from the County for their recrea-
tional program, and why doesn't Edgewater get some of this?
Councilman Sikes stated that this was to include Edgewater.
Mayor Severance stated that if this is tabled tonight it
might as well be canceled because in order to publicize it
we will have to start it before the first of July and our
next meeting will not be in time.
Councilman Cairnie made a motion that this be postponed
until we find out what the County is going to do, being
seconded by Councilman Lodico.
Councilman Dietz questioned how many people are expected
to be involved in this?
Mayor Severance stated that with all of the facilities that
we have available there will be close to 500 involved.
Councilman Dietz questioned why this program cannot be
financed by the people?

and the supervisors could be paid from this. He stated that
we are supplying the utilities and let them supply or pay for
the supervision.
Mayor Severance stated that this would be good, however there
are some people in Edgewater who could not afford the $3.00
per child and these are the children whom we should get involved.
Councilman Dietz stated that if they are a welfare case let them
come into the City Hall and state so, but if they can afford to
pay it, let them pay.
Councilman Sikes stated that he feels $2.00 would be enough.

Councilman Sikes stated that why couldn't we tell the Board
of Governors that we have $1,000.00 to go toward this and
let them go to the County and see what they can get from them,
and build their program around this.
Councilman Cairnie stated that the reason for his motion was
to see what we can get from the County before we go ahead
with our plans.
Councilman Dietz stated that if we get a favorable statement
from the County then call a special meeting and we will
handle the situation.
There was more discussion about the different categories that
have users fees.
Upon roll call vote to table this matter, said motion CARRIED.
Councilman Sikes and Mayor Severance voting NO.
The City Clerk read a copy of a letter from Mrs. Ihnken to
Mr. Kanter, the head of the Library program stating that
she is retiring.

The City Clerk read a letter from Mr. Kanter to Mrs. Ihnken
commending her on her services and accepting her letter of
retirement.
The City Clerk read a memorandum from the Merit Board which
Mr. Bryant asked be brought up. This was in regard to salary
increases for Mr. Allen Thomas and Mr. Everett Wilcox.
Councilman Dietz asked if this was brought up at the workshop
meeting.
Mayor Severance stated that it had not, the Merit Board did
not meet until last night.
Councilman Cairnie made a motion that this be tabled until
we have time to discuss it at a workshop, being seconded by
Councilman Dietz.
Councilman Dietz asked who:.made this recommendation besides
the Merit Board.
Mayor Severance stated that in regard to Mr. Wilcox, Mr.
Martine and Mr. Bryant made the recommendation to the Merit
Board jointly, and since Mr. Thomas is a Department Head,
the City Manager made the recommendation himself.
Mayor Severance read the recommendations from the City Manager
to the Merit Board.
Upon roll call vote on the motion to table this matter, said
motion DIED. All Councilmen voting NO.

Councilman Dietz made a motion to accept the recommendations
of the Merit Board and the City Manager, being seconded by
Councilman Sikes. Upon roll call vote said motion CARRIED.

SPONSE IN A CRITICAL SITUATION ON ARPIL 26, 1975.
Mayor Severance read this Resolution in full and presented
it to Phillip Read.
Councilman Lodico made a motion to adopt this Resolution
being seconded by Councilman Cairnie. Upon roll call vote
said motion CARRIED.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA TO SUPPORT LEGISLATION POSTPHONING THE IMPLEMENTATION
OF ARTICLE V OF THE FLORIDA STATED CONSTITUTION AS IT APPLIES
TO ABOLISHMENT OF MUNICIPAL COURTS AND PROVIDING FOR THE CON-
TINUANCE OF MUNICIPAL COURTS TO BE PRESIDED OVER BY A CDNSTI-
TUTIONAL MUNICIPAL JUDGE.
City Attorney Weaver read this Resolution in full.
Councilman Lodico made a motion to adopt this Resolution being
seconded by Councilman Sikes. Upon roll call vote said motion

AN ORDINANCE AUTHORIZING THE CITY MANAGER TO SIGN ALL CHECKS
AND VOUCHERS ON ALL ACCOUNTS OF THE CITY OF EDGEWATER, FLORIDA,
REPEALING SECTIONS OF THE CITY CHARTER AND CODE OF ORDINANCES

LUTIONS IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE

City Attorney Weaver read this Ordinance by title only.
Councilman Cairnie made a motion to adopt this Ordinance being
seconded by Councilman Lodico. Upon roll call vote said motion
CARRIED.
OLD BUSINESS:
Mayor Severance stated that a motion is needed to direct the
attorney to draw up and prepare for the Council at the next
workshop the Subdivision and Sign Ordinances.
Councilman Dietz stated that before we go to all of this
expense, do we have copies of these Ordinances? Why don't
we have a workshop to discuss this?
City Attorney Weaver stated that the drafts have been prepared
as they came out of meetings last year.
Councilman Dietz stated that he didn't feel the Ordinances should
be drawn up before the Council decides how they feel.
City Attorney Weaver stated that these Ordinances were drawn
up a year ago and brought to the Council and sent back to the
boards for corrections and they came back with the amendments
made to them, and this is what you have here.

Mr. Weaver stated that the purpose of bringing the drafts
is so that copies can be made now and the Council can dis-
cuss them at the next workshop.
Councilman Cairnie stated that his objection is that what
if we don't like it as it is now, why go to all that work?
City Attorney Weaver stated that he was directed by the
Council to prepare the drafts in accordance to the amend-
ments as made by the Zoning and Planning Board and now it
is up to the Council to look over them.
Mayor Severance stated that he wants the City Attorney to
be told as a matter of record to give the Sign Ordinance
and the Subdivision Ordinance to the City Clerk so that
copies can be made for the City Council's review.
Councilman Lodico stated that he would make that motion
being seconded by Councilman Sikes.
There was a question from the audience in regard to this.

Mayor Severance explained that originally this was prepared
in draft form out of Public Hearings held by the Zoning and
Planning Board pertaining to signs and subdivisions, they
prepared these ordinances in draft form with the assistance
of the City Attorney, and this is the point we are at right
now. We have now directed the City Attorney to turn those
draft forms over to the City Clerk so that copies can be
made for the Council, and we will sit down with the City
Attorney and go over the ordinances. If any changes are to
be made other than the amendments coming out of those Public
Hearings, tfiere will have to be another Public Hearing.
Mayor Severance stated that this Council decided that any
action that the City Attorney takes in preparing any ordinance
will come from the Council at a regular meeting.
Councilman Cairnie stated if we have the draft of the ordinance
now, why don't this Council look over that draft and see if we
like it before it is given to the attorney to draw up the
regular ordinance.
Mayor Severance stated that this is the intent.

Councilman Dietz stated that this could go on all night, and
he asked the City Attorney if there is any charge for the
draft?
City Attorney Weaver stated that other than drafting the
amendments to it that is it. He stated that redrafting this
to put amendments into it there will be a charge for that.
There was still much controversy in regard to this.
The previous motion and second were withdrawn.
Councilman Dietz made a motion to direct the attorney to
present to the Council the Subdivision and Sign Ordinances
for the next workshop, being seconded by Councilman Bodico.
Upon roll call vote said motion CARRIED. Councilman Cairnie
voting NO.

NEvl BUSINESS:
Mayor Severance stated that the only new business is what
was discussed at the Public Hearing in regard to allocating
the $50,000.00 as Federal Revenue Sharing.

Councilman Dietz made a motion to allocate the $50,000.00
of Federal Revenue Fund to the Water and Sewer Department
until such a time that we find out exactly what this expan-
sion is going to cost us, this to go on others and capital
improvement expenditures, being seconded by Councilman Sikes.
Upon roll call vote said motion CARRIED.
MISCELLANEOUS:
Councilman Dietz stated that unfortunately the Shunshine Law
makes us wash our dirty linen out in public and we can not
sit down and work our problems out anymore. He stated that
something is bothering him which he wants to get off of his
mind and it pertains to the letters that the Mayor has been
writing to the Senate~ Congress, Legislature without prior
knowledge or approval of the Council. He stated that he
understands that there has been some interference with some
of the Department Heads, and we passed an Ordinance stating
that the City Manager is ahead of all departments and he is
the only one who can make any changes and the third thing is
that the Mayor has been attending some of the board meetiijgs
of which the Council gets no knowledge of what is going on
until after we get a letter directing us as to what has come
up as to spending money or something like that. He stated
that he doesn't know any other way of stopping this, so in
order to bring this before the Council and see how everybody
feels he stated that he is going to put this in the form of
a motion that the Mayor be sensored for these acts and hope
that you will not do it again.
Councilman Sikes asked for what acts?
Councilman Cairnie stated that to bring this out for discussion
he will second the motion.
Councilman Lodico asked Councilman Dietz if he would be more
specific. He stated that he feels that no one member of the
Council should go in and tell the City Manager what they want
without the majority vote of the Council. Councilman Lodico
stated that the City Manager is the boss.
Councilman Sikes stated that the Mayor, Vice Mayor or Acting
Mayor have a certain amount of authority and supervising that
he must exercise to some length, and it is their responsibility
as elected by the people to oversee and see that certain things
are done, and it might be times that none of us can go to the
board meetings.
Councilman Dietz stated that if you go back to the Charter
it states ",that the Mayor shall carry out the .lishes of the
Council.
Councilman Sikes stated that he feels you are insulting the
Mayor's intelligence as far as writing a letter in regard to
the passing of certain bills.
Councilman Dietz stated that what if the majority of the
Council disagreed with what the Mayor wrote in his letter,
then the Mayor would have done this against the Council's
wishes.
Councilman Cairnie stated that as an individual, the Mayor
can write to whom he pleases.

Councilman Sikes asked then does the City Manager have the
authority to write them?
Councilman Dietz stated No, not without the prior approval
of the Council.
Councilman Lodico stated that there are so many rumors that
there is dissatisfaction among the police force and the dis-
patchers, and this is getting out of hand.
Councilman Dietz stated again that the Sunshine Law causes
this to be said at a public meeting.
Councilman Sikes stated that nevertheless he does not like
the word sensored.
Councilman Dietz stated that sensor means nothing more than
a reprimand and that is all it means.
Councilman Sikes stated that he has lived in Edgewater probably
longer than anyone here and he feels that Mayor Severance has
been one of the best Mayors we have had and he does not like
the word reprimand for anyone at a public meeting.
Councilman Dietz asked how can this be brought out publically?
The Councilmen cannot talk to each other except at a public
meeting, and the only way I can get your opinion is by a vote.
Councilman Sikes stated that it could be brought up to the
Council and ask how we feel about it but not the way it was
done.
Councilman Lodico stated that he knows that there are things
going on that only the City Manager should know about and
handle. He stated let's be specific, if someone in the
Police Department does not like something that is going on
he goes and reports to our Mayor, that is not the way it
has to be, he should report to the boss.
Councilman Sikes stated that for years the procedure here
was to go tb the different Councilmen and the Mayor, and it
will take some time to work this out, and he believes that
the Mayor is trying to do this.
Councilman Lodico stated that he feels that the Mayor is
doing a good job, however, he feels that the Chief of Police
will not listen to the City Manager.
Councilman Lodico asked Councilman Dietz to change the wording
of his motion.
Councilman Dietz made a motion that we instruct the Mayor not
to do these things again, without the consent of the Council.
Councilman Cairnie stated that he feels that the point has
been made at this time he would like to ask Councilman Dietz
to withdraw his motion.
Councilman Dietz withdrew his motion.
Councilman Dietz made a motion that we instruct the Mayor in
the future if he has any correspondence he wishes to draw up
to inform the Council and let them know what he is doing and
get their approval, and see if it is acceptable to the Council
to do it that way, and also not to interfer with any of the
Department Heads and if he has any problems to bring it to the
Council and to the City Manager, as I look at it we are a board
of directors, the City Manager is the president of the concern
and he is the gentleman who runs this organization if he don't
do the job, we replace him, but he is the guy who has all the
answers, and if he doesn't have all the answers he doesn't work
here and we are the board, we give him the instruction and he
carries them out, and he answers to the whole board and not to

one individual and none of us has the right to go to the
Department Heads or the Attorney and give instructions as
to how we want things done.
Councilman Lodico stated that it will be hard to change the
routine, however we should not go and tell someone how to
do something, we should report anything being done wrong to
the City Manager.
Mayor Severance stated that he would like to say something.
Councilman frietz stated that there is a motion on the floor.
There was some confusion here, and Councilman Cairnie stated
that he would second it so that Mayor Severance could say
what he wishes.
Mayor Severance stated thet in regard to him attending the
board meetings and not reporting back to the Council and
he stated that he assures the Council that there has only
been two board meetings that he has attended in the last
two years, one being the Planning Board which all Councilmen
were present at. The other meeting being the Library Board
Bicentenial presentation which was advertised and each Council
member was invited to be there and only Mr. Cairnie and Mayor
Severance attended.

As far as Article V. goes, he stated that he believes that the
City Clerk has been making copies of the Florida League of
Municipalities Bulletin for the Council to review pertaining
to issues for the legislature and there has been ample time
for the Council to discuss this Article V also at the Volusia
League of Municipalities meeting, whioh Councilman Dietz and
Councilman Cairnie attended there was discussion among the
Mayors, in regard to the Article V situation and in regard to
the fact that the Volusia County League of Municipalities was
going to write a letter to the State Legislature in regards
to requesting an extension. There was also a meeting held in
New Smyrna Beach which was called by the Florida League of
Municipalities and there was a presentation solely discussing
the Artivle V and what it will do to the municipalities if we
have to abolish our municipal courts, this is going to cause
a great expenditure on the City's part and we would have to
raise taxes to compensate.
Mayor Severance stated that he feels that Article V has been
discussed with the opportunity for all the Council members
to be present and at various Council meetings at which the
Council has expressed its opinions.
Mayor Severance stated that the only other letter he wrote
was on the H.E.W. proposal that there was grant money avail-
able for the small cities, when articles came out in the
paper that there were no monies available except for the
larger communities, therefore he wrote to the Federal and
State level pro~estigg on the City's behalf because we ex-
pended some $1400.00 which the Council voted on and approved
and we were not elligible for the funds.
In regard to the Police Department, Mayor Severance stated
that there is a problem in this department and Mr. Bryant
asked the Mayor if he would, along with him, discuss these
problems with the department people and the Department Head.

There will be a meeting next week between Mr. Bryant, the
Chief of Police and the Mayor. Mr. Bryant felt, as well
as I myself, that we should exercise every effort to solve
the problem without having to bring it out in the open and
wash the dirty linen as Edgewater has had a long history
of doing. If this doesn't work, then it will have to come
to the City for their action. He stated that he was doing
what he felt was best for the City; trying to solve the
problem before it became very embarrassing not only for
the employees but the Council and the citizens of the
community.
Mayor Severance stated that he respects Councilman Dietz
for bringing these things out, and he realizes that he
could not do it other than in the public.
However, he stated that he plans to remain in the City of
Edgewater the rest of his life, and raise his family here,
and his interest is with providing the community with what
he wants his children and other children and the present
citizens to live by and he would not write a letter that
would be of a controversial issue and use the title of
Mayor for his own personal benefit, and if the Council does
not believe that then he feels that the action they are
taking is adequate.
Councilman Lodico asked how long is the trouble in the Police
Department going to go on before something is done about it?
Someone should clean it up or wipe it out.
Mayor Severance stated that the City Manager has the authority
to do that, however he did not go to Mr. Bryant, Mr. Bryant
came to him.
Councilman Lodico stated that the other party is approaching
the Mayor. Mayor Severance stated that the other party has
called him on different occasions, however he should go to
the City Manager.
Councilman Lodico stated that the point is that the other
party knows the City Manager is his boss, and that's where
he should go.
Councilman Sikes asked why don't you reprimand the Chief of
Police instead of the Mayor.

Mayor Severance called for a roll call on the motion so that
Mr. Lodico could leave the meeting as he earlier requested.
Councilman Cairnie stated that he feels that there is no
need for a motion and he asked Councilman Dietz to recall
his motion.
Councilman Dietz recalled his motion.
Councilman Dietz stated that he did go to the League of
Municipalities meeting, however he did not know what was
going on, and the Mayor did not report it to the Council.
If the Mayor made a statement at that meeting and tonight
we_had three members of the Council that were against the
extension, then the Mayor would have been going against
the wishes of the Council.
Mayor Severance stated that all the letters he has written
has been discussed among the Council to some extent, however
if you wish in the future the City Manager can be directed
to write the letters.

CITY HALL CLOSED - MONDAY - MAY 26, 1975. Monday garbage
pickups will be made on Tuesday and Tuesday pickups will
be made on Wednesday. The regular schedule will be carried
out Thursday and Friday.
ADJOURNMENT:
Councilman Cairnie made a motion to adjourn being seconded
