Upon roll call vote said motion CARRIED. OFFICERS REPORTS Certification of Posting General Fund Budget Report Clerk's Cash Statement Library Report Police Department Report COMMUNICATIONS Councilman Lodico joined the other members of the Council. The City Clerk read a letter from Briley, Wild amd Assoc. stating that the existing water plant is capable of supplying the City. A moritorium on water connections does not appear to be necessary at this time. Mayor Severance and the Council members acknowledged this letter. The City Clerk read a letter form the Building Code Committee stating as in the code that a journeyman or a man with competency card should be on the job at all times. They requested that the Council enforce this. The City Clerk stated that she talked to Mr. Knox, County Inspector about this and he said that any time that they make an inspection on a home that a contractor is building they do check for these cards. Even though someone is building their own homes they do need to pass the test to pass the inspection. City Attorney Weaver stated that the Council should forward copies of this letter to the Inspectors and explain the situation to them. Mayor Severance stated that the Inspectors basically have the authority to enforce this. He instructed the City Clerk to make a copy of this letter with a note attached and sent it to the Inspectors. The City Clerk read a letter from the Zoning & Planning Board requesting the City Council to instruct the City Attorney to research the coarse of action required to be taken on the 40' commercial lots in Florida Shores. -2- o o Councilman Bevel duly made a motion that the Council instruct the City Attorney to research the request made about the 40' commercial lots, by the Zoning and Planning Board, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. The Mayor t~en gave this letter to the City Attorney. The City Clerk read a letter from the Board of Governors stating that they had a special meeting and the main concern at this meeting was safety. They would like to see the wooden door at the back of the Community Center replaced by a metal door, two more fire extinguishers purchased, and other doors in the Community Center placed so that they open out. Mayor Severance stated that this board can go ahead and contact the City Clerk in ordering these items mentioned in this letter. The City Clerk read a letter from the Edgewater School Safety Patrol Mothers requesting a donation from the City to send the safety patrols on a trip in May. Councilman Clinton duly made a motion to give the School Safety Patrol $150.00 for this trip, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. The City Clerk read a letter from the Environmental Protection Agency stating the amount of payment that they have approved, and wishing the City continued success with their project. Mayor Severance stated that this letter is covered in a Resolution. The City Clerk read a letter from McMahan Construction Company requesting sewer co~stru~tion payment. Mayor Severance stated that this is also covered in a Resolution. The City Clerk read a letter from Thomas O'Malley stating that there will be a discussion of LP gas emergency control and live for demonstrations in the Communtiy Center, April 24, 1974 at 7:00 P.M. Mayor Severance and the Councilmen acknowledged this letter. The City Clerk read a letter from Charles Broddle from Florida Power & Light, concerning the proposed street lights. Councilman Clinton duly made a motion to instruct the City Clerk to write a letter to Florida Power & Light, adding the two street lights on U.S.#l, one at Carters Trailer Park and one aththe Fire Station. Being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. PROCLAMATION A PROCLAMATION DESIGNATING THE WEEK OF APRIL 21ST THROUGH APRIL 27TH AS NATIONAL LIBRARY WEEK IN THE CITY OF EDGEWATER, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above proclamation was read in full by City Attorney Weaver. Councilman Lodico duly made a motion to adopt said Proclamation as read, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. -3- o o RESOLUTION RESOLUTION NO: 514 A RESOLUTION AUTHORIZING THE LOAN OF THIRTY FIVE THOUSAND and nO/100 ($35,000.00) DOLLARS FROM THE GENERAL FuND OF THE CITY OF EDGEWATER, FLORIDA TO THE CITY OF EDGEWATER WATERWORKS AND SEWER SYSTEM CONSTRUCTION ACCOUNT AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Resolution was read in full by City Attorney Joseph E. Weaver. Councilman Lodico duly made a motion to adopt said Resolution as read, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. ORDINANCES NONE OLD BUSINESS Coun~ilman Bevel duly made a motion that the City's Volunteer Fire Department answer fire calls to the Waterway Park area being seconded by Councilman Clinton. There was much discussion on this certain topic. Councilman Clinton withdrew his second and Council- man Bevel withdrew his motion. Counc~lman Clinton duly made a motion to instruct the Attorney to draw up the necessary amendment to the Fire Prevention Code p,ertaining:, to inflammable vehicles parked in a residential area, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. Councilman Bevel duly made a motion to instruct the City Clerk to write the individuals that have contracts with the City to utilize the City Dump, being seconded by Councilman Clinton. Upon roll c call vote said motion CARRIED. Councilman Bevel duly made a motion that the Council instruct the Attorney to draw up a contract with Waterway Park for mutual fire protection, in compliance with the existing Ordinance, $25.00 annually to be presented to the Council in draft form, being seconded by Councilman Clinton.. Upon roll callvvote said motion CARRIED. Councilman Lodico voting no. CERTIFICATION OF BIDS RECEIVED - TENNIS COURTS - no bids received Councilman Clinton duly made a motion to extend the bid period on the tennis courts until May 20th, and have the City Clerk advertise in the Orlando Sentinal, being seconded by Councilman Sikes. Upon roll call vote said motion CARRIED. CERTIFICATION OF BIDS RECEIVED -FENCE-no bids received Councilman Clinton duly made a motion to extend the bid period for the fence for the tennis courts until May 20th, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. CERTIFICATION OF BIDS RECEIVED - MANHOLES - Councilman Bevel duly made a motion to allow L & M Paving Co. to raise the manholes on Riverside Drive at a rate of $125.00 per manholes, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. -4- o o CERTIFICATION OF BIDS - HANDBALL COURTS Councilman Lodico duly made a motion to return the one bid that was turned in for the Handball Courts and extend the bidsperiod to May 20th, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Sikes duly made a motion that we advertise for the tennis courts, fence and handball courts all together in one package or single, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mayor Severance stated that he did not think that it was necessary to go into the certification of funds at this time since bids were no turned in. NEW BUSINESS Councilman Lodico duly made a motion to authorize the City Attorney to settle the lawsuit with Faith Brothers Construction CO., being seconded by Councilman Sikes. Councilman Sikes withdrew his second and Councilman Lodico withdrawing his motion. Councilman Bevel duly made a motion to authorize the City Attorney to settle the lawsuit with Faith Brothers Construction Co. for the amount of $579.00, being seconded by Councilman Sikes. Upon roll call vote said motion CARRIED. Councilman Clinton duly made a motion to appoint Lee Sayres architect for the Police Department contingent upon contract and approval, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. Councilman Bevel duly made a motion to authorize the City Attorney to check into going to county garbage system, being seconded by Councilman Clinton. Upon roll call vote saiddmotion CARRIED. Councilman Lodico duly made a motion to appoint Delbert W. Thomas to the Merit Board being seconded by Councilman Clinton. Mayor Severance stated that due to the fact that we do not have enough information on Mr. Thomas, the motion is disregarded. Councilman Clinton duly made a motion to appoint Douglas Cole to the Building Code Committee, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. MISCELLANEOUS The City Clerk stated that she didn't know what to tell people when they ask to use the dump. Mayor Severance stated that anybody that has debris that is not picked, up in the normal trash pickup can transport it to New Smyrna Beach then New Smyrna Beach can trans- port it to Tomoka. The City Dump is closed tp everyone except City vehicles. Mayor Severance asked the City Clerk to make a note to contact Sam Taylor about taking his tires to the dump. ANNOUNCEMENTS Mayor Severance stated tat the Zoning & Planning Board will hold a meeting April 16, 1974 at 7:30 in the Mayor's Office. -5- u <.) Mayor Severance announced that the Merit Board will meet Wednesday, April 17, 1974 at 7:30 P.M. in the Mayor's office. Councilman Lodico duly made a motion to purchase an engine for the truck in the Street Department costing $60.00, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Lodico duly made a motion that the Council advertise for bids on a small tractor, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Clinton stated that we should have some kind of fire alarm to caution people in Edgewater that there is a tornodo coming. Mr. Christy then spoke about Civil Defense and how the City shou~d be warned when a tornado comes.
