04-01-1974 - Regular J Q o THE CITY COUNCIL OF THE CITY OF EDGEWATER REGULAR MEETING HELD APRIL 1, 1974 The Regular Meeting of the City Council of the City of Edgewater, Florida was called to order by Mayor David C. He will be back within the next few days. APPROVAL OF MINUTES Councilman Clinton duly made a motion that the minutes of the Regular Council Meeting held March 18, 1974 be approved as read and the motion was seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. OFFICERS REPORTS Certification of Posting COMMUNICATIONS The City Clerk read a letter from the Indian River Baptist Church requesting permission to place a double-wide mobile home on the south west end of the church property. It will be used tempori1ary by the chur.ch as the parsonage until a home is constructed, then used as part of the church's day school. Councilman Bevel duly made a motion that the Council does not accept this request, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mayor Severance stated that the City has an Ordinance disallowing this sort of thing about trailers. The City Clerk read a letter from Robert G. Howard, Architect stating the Architect's Fee Estimate for the additions to the Library. Councilman Bevel duly made a motion that we withhold taking action at this time until we have confirmed that there will be money avai1ab~e to make the addition, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. -2- o o Mayor Severance stated that he would write a letter to the Friends of the Library requesting confirmation fo funds. The City Clerk read a letter from the Zoning & Planning Board, in reference to the letter from the City concerning land for recreation. They stated that the Menard property was offered to the City in the resent past and the offer was turned down. This property might still be available at this time, asking the Council to check into this property. Mayor Severance stated that the Council acknowledges this letter. Councilman Bevel duly made a motion that we instruct the Attorney to contact Mrs. Menard concerning possible purchase of the property, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. The City Clerk read a letter from the Zoning & Planning Board directing the Council IS attention to problem areas in the north end of the City, which are violations of the existing zoning in this area. (1) An abandoned house trailer on Knapp Avenue. They are recommending that this trailer be removed form this area. (2) A canal that runs north and south between Palmetto Street and Perdita Street, which is infested with mosquitoes, snakes and water mocassins and has become a collection place for debris and shopping carts. They are recommending that it be cleared fo debris and covered over or filled in. (3) The owner of the house at the end of Perdita Ave have apparently got a kennel with approximately 10 dogs. The nuisance Ordinance concerning animals may not be being inforced. Wbey recommended that appropriate action be taken. (4) The recent car and brush fire at the end of West Knapp Avenue might have been prevented if a barracade had been placed at the end of this street. They are requesting that new barracades be installed with lock chains stretched across and opening at the end of Knapp,P.almetto and Perdita Streets with keys being provided to City crews, Police Department, and the Fire Department. Mayor Severance stated that action has been taken on the trailer. The Police Department has contacted the owner, but they have received no reply. It is to be moved within 10 days. Mayor Severance stated that we can instruct the City Attorney to draft an Ordinance on removing abandoned trailers, for our next Workshop Meeting. Mayor Severance stated that Councilman Lodico went out and checked the canal, and that he will contact the Mosquito Control Company about this. Mayor Severance stated that we have discussed the apparent kennel at the end of Perdita Street. If these people that these dogs are bothering will sign an affidavit or a complaint then action will be taken. But until they sign this we can't do anything. Councilman Clinton asked why can't these people be made to keep a limit on dogs. We should have the Attorney check into the limitation of dogs. City Attorney Weaver stated that this is one of the weakness of the animal control ordinance, it doesnlt specify how many dogs a person can own. He stated that when he updates the Code of Ordinances he will look into this situation. This Ordinance requires for every dog to be 1isenced. This is something that the Police Department should check out and enforce. -3- o o Mayor Severance and the Council talked about the barracades but nothing was settled on this as yet. Mayor Severance stated that while the press was here, there was something that he would like to bring up in regards to the water situation, and try to get some cooperation with the citizens of Edgewater. Last year we had on two occasions water problems, which ended in us borrowing water from New Smyrna. We are presently headed in the same course. He stated that he wants to ask the public to begin now this month in setting up their own water conservation program, to try to help the City alliviate the problem of water usage. One particular way that would really help is not to water lawns with the City water, and using the wells. Another would be cutting down on leaving your taps running. We are in d'scussion with our engineers and also talked with the County in regards to increasing our water. There is no way that we will have this problem alliviated by this summer. We are having to }ower the pressure to keep water in our tanks. As soon as we get something back from the engineers, we will go out for specifications and bids. If the people will start now conserving the water it will help us to get through this time. Councilman Bevel stated that we only have two other alternatives. If we don1t get volunteer cooperation, we will have to pass an ordinance putting a fine to anyone caught washing cars and etc. We are trying to avoid this kind of stuff. Another way is that we will just turn the water off for two hours every afternoon. We are going to be at the point where we have to do something. Mayor Severance stated that he has talked to New Smyrna Beach and Mr. Havelock stated that as far as a permenant hook up with New Smyrna for emergency use, that is impossible at this time, because of the bond issue that they presently have going in their water system. But he did say that anytime that an emergency existed where we are completely out of water that his department, Utilities Commission, will work 100% with Edgewater in supplying of emergency water in the same manner that we received it last year, if they have it. RESOLUTIONS RESOLUTION NO: 513 A RESOLUTION PROVIDING FOR THE SUPPORT OF FULL FUNDING OF PUBLIC LIBRARIES IN THE STATE OF FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Resolution was read in full by the City Attorney Joseph E. Weaver. Councilman Bevel duly made a motion to adopt said Resolution as read, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. ORDINANCE ORDINANCE NO: 875 AN ORDINANCE RELATING TO NOISE: MAKING LEGISLATIVE FINDINGS THAT THE PUBLIC INTEREST AND WELFARE REQUIRE REGULATION OF NOISE: PROVIDING FOR DEFINITION AN MEASUREMENTS OF NOISE: FIXING MAXIMUM NOISE LEVELS: REGULATING NOISE FROM MOTOR VEHICLES AND AIRCRAFT: PROVIDING EXEMPTIONS: PROVIDING FOR SPECIAL PERMITS: PROVIDING PENALTIES: PROVIDING FOR INJUNCTIVE RELIEF: PROVIDING FOR MANNER OF CONSTRUCTION: AND PROVIDING AN EFFECTIVE DATE. -4- o o The above Ordinance was read by title only by City Attorney Joseph E. Weaver. Councilman Clinton duly made a motion to adopt the second read- ing of said Ordinance as read, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. Mr. Bradley stated that the Council should do something about the noise and trash that is at the Atlantic Machine Company. Mayor Severance stated that the Attorney is looking into this portion of the Ordinance. Mayor Severance instructed Police Chief Katez to go down to Atlantic Machine Company and talk to Mr. King, advising him to clean up in back of his place of business. If he refuses to clean it up, then we will have more grounds to take further action. OLD BUSINESS Certifi~ation of Bids: for a truck for the Sewer Department. Inc. 3,638.29 3,831.74 3,737.40 3,916.22 3,528.70 4,025.00 3,689.00 After much discussion between the Mayor and the Council, Council- man Bevel duly made a motion to accept the John Lamb Chevrolet Inc. bid of $3,528.70, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Certification of Funds NE\~ BUSINESS Councilman Bevel duly made a motion to authorize Councilman Lodico to order the street signs and,contact the company in regards to how they are to be ordered and delivered, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Bevel duly made a motion to enter into a contract with Mr. Sauers of Carter's Trailer Park, for the installation of water and sewer, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. Councilman Clinton duly made a motion to give fire protection to residents south of Edgewater, until after the meeting of Apri 1 11,1974 when a contract "Ii 11 be di scussed, bei ng seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. MISCELLANEOUS Mayor Severance stated that he has a letter form Mr. Hyatt Brown stating that the Department of Transportation has conducted a study, and found that the intersection at Ocean Avenue and U.S.#l failed to meet the requirements for a traffic light. He said that if we sent his office a Resolution similar to the resolution of February 5, No. 457 a study will be completed within two weeks and -5- o o the results will be made known to the City. Councilman Clinton duly made a motion to instruct the City Attorney to copy Resolution No: 457, changing the number and sending it to the necessary people, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. Councilman Clinton suggested that we stop all new buildings from connecting to water lines in Edgewater until we get this water situation cleared up. City Attorney Weaver stated that if we get some certification from the engineer that in fact we are not going to have sufficient water, to service the customers that we now have, we could do this but we need some justification. Mayor Severance stated that he will write a letter to Mr. Fernandez in regards to this. Councilman Clinton asked why can't the City put out some money to ne1p uniform these little league baseball players. Supplying them with uniforms, not just giving them a check. Mayor Severance stated that where the expense come in, is the Insurance. He stated that the Council will think this over and talk more on it at a later date. Councilman Clinton stated that the City should hire someone to take care of the maintenance around the City for City property. Take care of the City Buildings inside and out. There is plenty of work that will keep a man busy for 40 hours a week. Councilman Bevel duly made a motion that we give an advancement to Stanley Slates of $75.00 to attend the school on water pollution and water treatment in Silver Springs, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Bevel stated that the City of Edgewater has only one organization here that is sponsoring the Cancer Fund in any way, and that is the Volunteer Fire Department. He stated as citizens we should help support this. He stated that we should pass a proclamation or something to get this off of the ground. Mayor Severance stated that a Proclamation for next weeks meeting would be appropriate at this time, requesting other organizations to aupport the cancer fund drive and help the City of Edgewater. ANNOUNCEMENTS Mayor Severance stated that the Zoning & Planning Board will have a Meeting next Tuesday at 7:30 P.M. in the Mayor's Office. Mayor Severance announced that the Library Board will meet Wednesday at 7:30 P.M. at the Library. Mayor Severance stated that the Fire Department will meet Thursday at the Fire Station at 7:30 P.M. Mayor Severance stated that April 11, 1974. All people concerning Fire protection. Community Center. there will be a Workshop Meeting south of Edgewater are asked to attend, This meeting will be held in the Mr. Christy stated that there will be Bingo this coming Saturday at 7:30 P.M. in the Community Center. -6- :lo .. . , o o Mayor Severance stated that there is firemen's burned or damaged clothes. to take action, as far a reimbursing lose of his suit. no insurance covering The Council will have this Fireman for the Mayor Severance stated that each one of the Councilmen on their own will have to make contact with various agencies that construct or sell underground gas tanks for possible purchase. Fire Ohief Walls stated that he would like to report on the coorperation between the Pollce Department and the Fire Department on a fire that happened Sunday. A Couple building a home in Florida Shores had a small fire on a palm tree. This fire was started by someone. There was also a fire at 23rd and 24th on Royal Palm, this fire was also started. We went out Sunday morning and the fire was out, then at 2:30 in the afternoon it was on fire again. This proves that some arson is going on.
