A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, DECLARING VACANT
PROPERTIES LOCATED AT 103 EAST PINE BLUFF
STREET AND 107 NEW HAMPSHIRE STREET AS
SURPLUS AND AUTHORIZING DONATION OF THE
PROPERTIES TO SOUTHEAST VOLUSIA HABITAT FOR
HUMANITY TO BUILD AFFORDABLE HOUSING;
REPEALING ALL RESOLUTIONS IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY AND
APPLICABILITY, AN EFFECTIVE DATE, AND FOR
ADOPTION.
WHEREAS, the City foreclosed code enforcement liens on vacant residential properties
located at 108 East Pine Bluff Street and 107 New Hampshire Street and took title to the vacant
land properties (the Properties);and
WHEREAS, the Properties are not needed for a public purpose and have never been put
/meq to a public purpose and it is not contemplated that the Properties will be put to any public
purpose in the reasonably foreseeable future;and
WHEREAS,the City finds the Properties to be surplus properties;and
WHEREAS,the City has a need for affordable housing for its citizens;and
WHEREAS, the goal of Southeast Volusia Habitat for Humanity is to provide simple,
decent,and affordable housing to families in need;and
WHEREAS, vacant properties donated to Southeast Volusia Habitat for Humanity are
used for the construction of single family homes to be provided to families in need; and
WHEREAS, Habitat for Humanity has built homes in the City of Edgewater since 1990
and the Habitat homeowners remit tens of thousands of dollars in property taxes each year; and
WHEREAS, the Habitat program is a "hand up" not a hand out. In addition to
demonstrated need, a Habitat homeowner must have a steady, reliable source of income,
contribute between 350 and 500 hours of "sweat equity" and attend a series of homeowner

preparation classes. The Habitat program aims to prepare responsible neighbors who will take
pride in their property and become valuable community members; and
WHEREAS, the City has families in need of affordable housing and Habitat for
Humanity desires to partner with the City to meet this need; and
WHEREAS, the City Council finds that it is in the best interests of the City to surplus
the Properties and donate them to Southeast Volusia Habitat for Humanity for the public purpose
of constructing affordable housing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Edgewater,Florida:
Section 1. The above recitals are true and accurate and are hereby incorporated herein
and made a part of this Resolution.
Section 2. The City Council declares the properties located at 108 East Pine Bluff Street
and 107 New Hampshire Street to be"surplus property."
Section 3. The City Council authorizes the donation of the properties located at 108 East
Pine Bluff Street and 107 New Hampshire Street to Southeast Volusia Habitat for Humanity to
construct affordable housing for families in need.
Section 4. The Mayor is hereby authorized to execute quit claim deeds for the properties
to Southeast Volusia Habitat for Humanity and is further authorized to execute all associated
documentation necessary to fulfill the donation of the Properties.
Section S.All resolutions or parts of resolutions in conflict herewith are hereby repealed.
Section 6. If any portion of this Resolution is for any reason held or declared to be
unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this
Resolution. If this Resolution or any provisions thereof shall be held to be inapplicable to any

person, property, or circumstances, such holding shall not affect its applicability to any other
person, property, or circumstance.
Section 7. This resolution shall take effect upon adoption.
