Severance on Monday December 17, 1973 at 7:30 P.M., due to the illness of Mayor George Dimm. Upon roll call vote said motion CARRIED. OFFICERS REPORTS Certification of Posting Library Report Police Dept. Report Clerk's Cash Statement General Fund Budget Report COMMUNICATIONS The City Clerk read a letter addressed to Mayor Dimm and the -2- Q o Councilmen from J. W. Clark concerning the Quit-Claim Deed from Robert and Norma Fuller to the City of Edgewater. Councilman Bevel duly made a motion not to abandon or vacate the said road in question which runs off of Eaton Road, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mr. Clark stated that fourteen years had elapsed and that the property could be used by the City for road purposes only and that unless the City can show a use for the land that it should be returned to Mr. Fuller, as he does wish to utilize it. Mr. Clark asked if the City had any use for the land. Councilman Bevel stated that the City of Edgewater is growing and can't afford to give away any of its property until we find out which way our growth is going. Mr. Christy asked if there had been any time limit for the street to be built in the deed. City Attorney Weaver stated not in the deed and that is the only thing that is controlling at this point. Mr. Christy asked if there are buildings built there, how could the Police Dept. or Fire Dept. get into those buildings? Severance explained that they would have to come down Eaton Road then either north or south depending on where the problem area is. The City Clerk read a letter from Mrs. Frank Tuturro in regards to her driveway and the ditch in front of it which is on City Property. Vice Mayor Severance stated that they had discussed it at the Workshop Meeting to some extent. Councilman Lodico stated that he had been there and that it needs to be leveled off and filled in and will do this either Monday or Tuesday. When putting the shell there it should move the ditch up to the driveway and she should have normal drainage. The City Clerk read a letter from Police Chief Katez in regard to the trash on Royal Palm. The situation has been investigated and found who the property belongs to, who removed the trash from the property and put it on City property as well as private property. Ft was discussed at the Workshop Meeting that they would give the gentleman two weeks to clean it up or have the City do it charging the party involved. Councilman Bevel duly made a motion to instruct the City Clerk to notify the party involved by letter, that they have two weeks to get this cleaned up or the City will contnact it out at their expense, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. Vice Mayor Severance instructed the Police Chief to have one of the officers deliver the letter to them, and make a record of what date it was delivered. PROCLAMATIONS A PROCLAMATION CONGRATULATING THE NEW SMYRNA BEACH SENIOR HIGH SCHOOL FOOTBALL TEAM AND ITS COACHING STAFF ON ITS SUCCESSFUL SEASON, AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Proclamation was read in full by the City Attorney Weaver. Councilman Bevel duly made a motion to adopt said Proclamation being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Vice-Mayor Severance stated that there are a lot of young men, parents, and boosters in Edgewater that go to the New Smyrna football games, and that it's time -3- o Q that we acknowledge these people for their outstanding representation in this area and also for the boosters that support them. Councilman Lodico stated that that's why they're so good, some of them are from Edgewater. Mr. Christy asked for the City to give the football players a dinner. Vice-Mayor Severance stated that this would be taken under advisement. The City Clerk was instructed to make a copy of the proclamation for each member of the New Smyrna Beach Football Team and send them out. RESOLUTION RESOLUTION NO: 497 A RESOLUTION APPOINTING MEMBERS OF THE BOARD OF GOVERNORS OF THE COMMUNITY CENTER OF THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH THEIR TENURE AND PROVIDING THAT THE CITY SHALL PAY THEM NO COMPENSATION, PROVIDING FOR THEIR DUTIES AND RESPONSIBILITIES AND POWERS, AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Resolution was read in full by the City Attorney Weaver. Councilman Lodico duly made a motion to adopt said Resolution being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. RESOLUTION NO: 498 A RESOLUTION APPOINTING MEMBERS TO THE EDGEWATER LIBRARY BOARD. The above Resolution was read in full by the City Attorney Joseph Weaver. Councilman Clinton duly made a motion to adopt said Resolution being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. RESOLUTION NO: 499 A RESOLUTION DESIGNATING AND APPOINTING THE MEMBERS OF THE ZONING AND PLANNING BOARD OF THE CITY OF EDGEWATER, FLORIDA, PROVIDING THAT SAID MEMBERS SHALL SERVE WITHOUT COMPENSATION, AND FURTHER PROVIDING AN EFFECTIVE DATE THEREFORE. The above Resolution was read in full by the City Attorney Joseph Weaver. Councilman Bevel duly made a motion to adopt said Resolution being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. RESOLUTION NO: 500 A RESOLUTION EXCUSING MAYOR GEORGE M. DIMM FROM ATTENDANCE AT THREE REGULARLY SCHEDULED COUNCIL MEETINGS OF THE CITY OF EDGEWATER, FLORIDA FOR THE REASON OF HOSPITALIZATION DUE TO ILLNESS AND PROVIDING AN EFFECTIVE DATE THEREFORE. Upon roll call vote said motion CARRIED. Vice Mayor Severance stated that Mayor Dimm became ill again.and is confined to his bed at home. It is a charter law that you have a resolution to this effect excusing a member t~at'misses three regular meetings in row. He also stated that he hopes that he will be back with us soon. Councilman Lodico commented that Mayor Dimm had sharp pains and didn't want to go to the hospital because he wanted to attend this meeting so badly. Councilman Bevel stated that it is the cities loss that Mayor Dimm is sick now. The City is in the best hands that it has been in in quite a while. ORDINANCE ORDINANCE NO: 862 AN ORDINANCE AUTHORIZING AND DIRECTING THE EXPENDITURE OF FUNDS GREATER THAN $500.00 FOR THE PURCHASE OF A NCR ACCOUNTING MACHINE AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Ordinance was read in full by the City Attorney Joseph Weaver. This was the second and final reading. Councilman Bevel duly made a motion to adopt said Ordinance being seconded by Councilman Clinton. Upon roll call vote said motionCARRIED. ORDINANCE NO: 863 AN ORDINANCE DECLARING A CHRISTMAS BONUS OF $20.00 TO ALL FULL TIME EMPLOYEES OF THE CITY OF EDGEWATER, FLORIDA, AND A BONUS OF $10.00 TO ALL PART TIME EMPLOYEES OF THE CITY OF EDGEWATER, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Ordinance was read in full by the City Attorney Joseph Weaver. This was the second and final reading. Councilman Clinton duly made a motion to adopt said Ordinance being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. ORDINANCE NO: 864 AN ORDINANCE PROVIDING FOR THE REIMBURSEMENT OF THE COSTS OF THE PHYSICAL EXAMINATION REQUIRED FOR EMPLOYMENT BY THE CITY OF EDGEWATER, FLORIDA TO ALL FULL TIME EMPLOYEES WHO HAVE COMPLETED 90 DAYS OF SERVICE WITH THE CITY OF EDGEWATER AND TO ALL PART TIME EMPLOYEES WHO HAVE COMPLETED 30 DAYS OF SERVICE WITH THE CITY OF EDGEWATER, FLORIDA.AND PROVIDING AN EFFECTIVE DATE THEREFORE. Upon roll call vote said motion CARRIED. -5- o u ORDINANCE NO: 866 AN ORDINANCE SETTING MINIMUM BUILDING GRADES FOR THE FLOORS OF HOMES OF THE CITY OF EDGEWATER, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Ordinance was read in full by the City Attorney Joseph Weaver. Councilman Clinton duly made a motion to adopt said Ordinance being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. OLD BUSINESS Councilman Bevel stated that from the Florida Pollution Control Association we received a certificate as an award of honor to the management and employees of Edgewater Waterworks and Sewer System. Recognition to these people for working for almost a full year without any accidents. Safety is important to the City in many ways. Mr. Christy appoligized for the Chief of the Fire Department for not attending this meeting, and wanted to know what the City is going to do about the median in front of the Fire House. Rocks are still getting kicked up, and the Fire Trucks have to go slow as it is starting to gully in spots. Vice Mayor Severance stated that we will have to pave this. The City could go ahead and widen it but we must put it back in condition with certain specifications which are spelled out in writing. It was a project that the City undertook completely with the States approval and understanding that we would put it back in the condition that all of the median strips and turn offs are in. Mr. Christy asked if we could ask New Smyrna Beach to come down and pave the driveway as they have the equipment and pay them for it. Councilman Bevel made a suggestion that Mr. Lodico has a feeling that he might be able to get the State to do it, so we should make available to him all correspondence we have with the State concerning this project, and let Mr. Lodico contact the people he feels should be contacted and have him report for what he thinks he can get done by the next workshop and if he can't get it done then at that time we will draw up the specifications for it and have it ready to advertise for bids at the following meeting. Councilman Clinton stated that he doesn't think we should wait two weeks. Bevel requested that Councilman Lodico call Mr. Buck. Councilman Bevel brought up the Paving Program. He would like to see the City of Edgewater contact the City of New Smyrna formally and try to determine from them if we can reach some kind of agreement to the Paving Project. Are they able to do this with their ordinances and laws to leave their City Limits and do work for the City of Edgewater, if so what kind of charges would they make. Councilman Lodico stated that he did talk to them and they said that their city would come first but they could pave about 1 1/2 blocks of Florida Shores at a time. Councilman Bevel duly made a motion that the City of Edgewater make formal contact with the City of New Smyrna requesting the possibilities of entering into a contract of paving the City of Edgewater, being seconded by -6- u u Councilman Clinton. Upon roll call vote said motion CARRIED. NEW BUSINESS The City Clerk read the certification of bids for the new Fire Equipment. One bid was returned from the Bisquane Fire Equipment Company-Dick Sietner, for a total of $3,015.00. ORDINANCE NO: 867 AN ORDINANCE AUTHORIZING AND DIRECTING THE EXPENDITURE FUNDS GREATER THAN $500.00 FOR THE PURCHASE OF A FIRE HOSE DRYER, FIRE HOSE WASHER AND FIRE HOSE LOADING TABLE. The above Ordinance was read in full by the City Attorney Joseph Weaver. Councilman Bevel duly made a motion to adopt said Ordinance being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Councilman Bevel stated that he had heard some opposition from some of the Firemen to the purchase of this equipment and prior to the next meeting we should look into this more. Councilman Clinton stated that we should have Chief Walls come to the next Workshop Meeting and explain the need for the new equipment. Christy stated that the meetings of the Fire Statd6n and the Workshop meetings come on the same night. Vice Mayor Severance stated that Mr. Walls and members of the Fire Station come to the Workshop meeting and they would be first on the agenda and be out in time for their meeting. This Workshop Meeting will be held January 3, 1974. Councilman Bevel stated that there is to be a class which would assist the personal in giving them a chance in getting their operators license in the Sewer Department and the Water Department. He asked the Council if there were any objections to him contacting the personnel and tell them that the City would be willing to reimburse personnel who pass the course. Mr. Severance stated that there were no objections. Chief Katez stated that three men in the Police Department have been attending school. Officers Ziers, Ricke1man and Jones finished in the top ten of their class of 40 some students. Vice Mayor Severance stated that they should be accomidated for this. MISCELLANEOUS The Chi1dern's Christmas Party will be held next Thursday, December 20, 1973 at 2:30 P.M. For more information contact the Library. The Auditors will be at the Special Workshop Meeting on December 20, 1973 at 7:30 P.M. in the Mayor's Office. This meeting is to go over the auditor's report for the fiscal year 12-73. Garbage pickups for the eAtire City will be made on December 24, 1973 and December 31, 1973. All grabage must be to the -7- o u . . curb by 7:00 A.M. Councilman Clinton asked the Council about the situation with the Building Inspector and wanted to know when we are going to do something about it. The City Clerk stated stated that Mr. Westbury from the County Inspection Office assured her that there would be a man here tomorrow, and he needs the addresses of the homes the Council want him to inspect. Vice Mayor Severance stated that he was to look at all homes presently under construction in Edgewater. Councilman Bevel stated that he should look at the house on Fern Palm. His report will tell us whether or not we're going to continue on the present Building Inspector. Councilman Lodico stated that the Street boys are doing a good job. Councilman Clinton asked about the playground area on Riverside Drive. He wanted to know if we were going to put the fence back~around it or not. Vice Mayor Severance stated that they had started moving the fence. Councilman Clinton stated that we should look into buying an 8ft. fence due to it being so close to the road. Vice Mayor Severance instructed Mr. Clinton to check into the cost of the fence. Chief Katez said that for a safety precaution it should be 10 ft. Mr. Shambora expressed his appreciation for the way the streets look in Florida Shores. Vice Mayor Severance asked Chief Katez about his wife in the hospital. Police Chief Katez stated that she was operated on Saturday and doing fine. Mr. Christy asked about the Fire Chiefs jourisdiction over burning. Hew would like to see the City put a fine on Builders burning debris. The City Clerk was instructed to make a note of this for the next Workshop Meeting.
