THE CITY COUNCIL OF THE CITY OF EDGEWATER REGULAR MEETING HELD DECEMBER 3, 1973 The Regular Meeting of the City Council of the City of Edgewater, Florida was called to order by Vice-Mayor David C. Upon roll call vote said motion CARRIED. Councilman Bevel joined the members of the Council. Upon roll call vote said motion CARRIED. OFFICERS REPORTS Certification of Postings CO I,' r" U N I CAT ION S The City Clerk read a letter addressed to Police Chief Katez from Miss Edouina Gano thanking him for the way he handled her accident last December. She also wrote about the diseases you can get from dogs, cats, and rats, and that we should do something about the problem of too many dogs, cats and rats. Councilman Bevel stated that most of the animals with owners have rabies shots. City Attorney Weaver said that the owner of any animal that hurts someone is liable. Vice-Mayor Severance entertained the motion that we table this for further research. Councilman Lodico duly made a motion for this to be tabled being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. The City Clerk read a letter to Councilman Lodico from Mrs. Josephine Paladino requesting that something be done about the road situation in Florida Shores. Council- man Lodico stated that he had had no chance to look into this as yet but will do so soon. . The C i t Y Cl e r k r e ad ale t t e r from Mr. E. V. H a r well s tat i n g that they have no plans of closing down the Edgewater Post Office. Vice-Mayor Severance said we would acknow- ledge receipt of their letter. The City Clerk read a letter addressed to Vice Mayor Severance from Thomas C. Kelley stating that we would be able to retain under the ownership of the City, and under the conditions of the Contract, those articles purchased with City funds for the Library. Vice-Mayor Severance instructed the City Attorney to write them a letter telling them we acknowledge their letter and stating that we accept this letter as amendment to the -2- r u u existing contract. Councilman Bevel duly made a motion for the City Attorney to do this being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. The City Clerk read a letter addressed to Mayor George Dimm and Councilmen from Jefferson W. Clark concerning property. Vice-Mayor Severance stated that there was discussion on this at the last Workshop meeting, and instructed the City Clerk to write letters to both parties concerned and invite them to the next Workshop Meeting. Councilman Bevel duly made a motion to have this tabled being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. The City Clerk read a letter to the City Council from Robert Fisher, Secretary of the Zoning and Planning Board concerning the land for the Shopping Center. Vice- Mayor Severance stated that if anyone had anything to say concerning the Shoppdng Center, that they could speak now, with a limit of three minutes to each person pro- viding they had not previously had a chance to state their view. Councilman Lodico said that there were many who wanted this Shopping Center and many who did not. We must think of the benifit of the City. Councilman Clinton duly made a motion that the City Council accept the recommendation of the Zoning and Planning Board and deny this request for variance, being seconded by Council- man Bevel. Upon roll call vote said motion CARRIED. PROCLAMATIONS NONE RESOLUTIONS RESOLUTION NO: 496 A RESOLUTION ESTABLISHING A BOARD TO STUDY THE BUILDING CODE OF THE CITY OF EDGEWATER, FLORIDA, AND PROVIDING FOR THEIR DUTIES AND POWERS AND FURTHER PROVIDING AN EFFECTIVE DATE THEREFORE. The above Resolution was read in full by the City Attorney Joseph Weaver. Councilman Bevel duly made a motion to adopt said Resolution, being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mr. Gene Harris asked if the Building Code Committee will be able to go onto the property with the Building Inspector and check these homes. Councilman Clinton stated that they should be able to inspect these homes but not change anything, just inspect. City Attorney Weaver said that Mr. LaBonde could delegate someone to go along with him. Mr. Harris asked if one man is going to have all the say. Robert Christy stated that we should have a marker for -3- o u AfI" o o laying floors above sea level. City Attorney Weaver stated that we have a Building Inspector and it is his job to do the inspections. Fire Chief Walls said that we should put it into the New Building Code so we could have someone else to do some checking. Vice-Mayor Severance said that we should establish this committee and update the code and if ther is any question bring before the Council. ORDINANCES ORDINANCE NO: 865 AN ORDINANCE INCREASING THE SALARY OF THE CITY CLERK OF THE CITY OF EDGEWATER, FLORIDA DUE TO COMPLETION OF THE NINETY DAY PROBATION PERIOD AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Ordinance was read in full by City Attorney Joseph Weaver. Councilman Bevel duly made a motion to adopt said Ordinance being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. OLD BUSINESS Mrs. Murphy asked Vice-Mayor Severance if there had been a noise ordinance drawn up yet. Vice Mayor Severance stated that until we get more complaints on the noise in the City of Edgewater, there is no need for a noise ordinance. NEH BUSINESS Councilman Clinton duly made a motion for the City Clerk to advertise for bids for the remodling of the Old Fire Department for the Police Department, being seconded by Councilman Bevel. Upon roll call vote said motion CARRIED. A committee was appointed to study the load limit signs for various streets. This committee consists of Chief Katez, Joe Martine, Councilman Lodico and Councilman Clinton. Councilman Bevel duly made a motion to appoint this committee being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mr. Armstrong asked if there would be any trouble with the "Sunshine Law" with two councilmen serving on the same committee. City Attorney Heaver said he didn1t think so as they would report to the full Council before any final action was taken. Councilman Bevel stated that we should not replace the trees on the Armino property because the trees were on City property. City Attorney Weaver said that unless the Arminios could prove the right to be reimbursed, we shouldn't have to replace them. Councilman Bevel duly made a motion not to replace the trees, being seconded by Councilman Lodico. Upon roll call vote said motion CARRIED. -4- (.) Q Councilman Bevel stated that the City must clean up the property on Poya1 Palm Drive in Florida Shores. Vice- Mayor Severance instructed Police Chief George Katez to get in touch with Mr. Poland to clean the property. Councilman Clinton asked what we were going to do about this house on Juniper Drive that the floor is below the crO\'/n of the road. It is their problem. Vice-Mayor Severance said that there is nothing really that the City can do to fix this. Mr. Armstrong said that we should get a floor level and keep it. Council- man Bevel duly made a motion to inform Mr. LaBonde that is the council's decision that the floor on all construc- tion as of December 4,1973, be 16" above the crown of the road, being seconded by Councilman Clinton.
