THE CITY COUNCIL OF THE CITY OF EDGEWATER
REGULAR MEETING HELD
NOVEMBER 20, 1973
The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Vice Mayor David C. Severance on
Monday November 19, 1973 at 7:30 P.M. due to Mayor Dimm being
in the hospital.

Councilman Clinton duly made a motion to approve the minutes of
the Regular Meeting held November 5, 1973 and the motion was
seconded by Councilman Lodico. Upon roll call vote said motion
CARRIED. Councilman Lodico No, because he was not on the Council
at that time.

The City Clerk read a letter from the State Representative
Hyatt Brown in appreciation for Article V. City Attorney
Weaver stated that Mr. Brown was in the City Hall today with
State Representative Gary Cunningham. There is no local judge
to take our cases. Article V would cost the State one billion
dollars to fund. Including a local Judge, more attorneys, and
police officers. City Attorney Weaver stated that Article V
is here to stay. They talked over how they could help implement
Article V. We need a Judge and two more Ass1t States Attorneys
in South East Vo1usia. The County has to spend the money to
hire these people, it will also cost Edgewater, because we will
need a prosecutor and more police officers.
Police Chief Katez stated that the surrounding cities have
trouble with warrents on weekends, they cannot find a Judge to
sign them.
The City Clerk read a letter from the Magnuson Corp. complaining
about the streets and the weeds in Edgewater. Councilman Lodico
stated that we have the equipment but not enough help. Council-
man Clinton said that they should not down grade the Council
and the City and the Horkers because of a situation we cannot
help. Councilman (Vice Mayor) Severance stated that we are
making every effort to correct the situation and thought that
the Magnuson Corp. did not realize the situation or they would
not have written the letter.
The City Clerk read a letter from the Zoning & Planning Board
requesting that signs for load limit be put on Flagler Avenue.
Councilman Clinton said that there should be signs on every
street instead of just one. Councilman Clinton duly made a
motion to table the letter and have it brought up at the next
Workshop Meeting, being seconded by Councilman Bevel. Upon
roll call vote said motion CARRIED.

The City Clerk read a letter from the Zoning & Planning Board
on the five year road plan. Councilman Bevel duly made a

meet on th~s December 4, 1973 being seconded by Councilman
Clinton. Upon roll call vote said motion CARRIED.
The City Clerk read a letter from the Zoning and Planning Board
discussing Street Signs. Councilman Bevel said that we should
stick to one type of.sign. Councilman Lodico stated that this
would be a wonderful project for the Chamber of Commerce.
'Councilman Bevel duly made a motion to table this until the
Workshop Meeting being seconded by Councilman Lodico. Upon
roll call vote said motion CARRIED.
The City Clerk read a letter from the Zoning and Planning Boards
complaining about the broken down private docks along the river.
Fire Chief Walls stated that the sea wall was cracking and that
the water was getting in behind it. Councilman Bevel said that
we should r.epair the sea wall. City Attorney Weaver said that
there was no Ordinance to regulate private piers at this time,
and that he would look into this. Councilman Clinton said that
he had talked to the Marine Patrol and they said we should write
to their Department. Councilman Bevel duly made a motion to

give the City Attorney authority to look into this problem
being seconded by Councilman Clinton. Upon roll call vote
said motion CARRIED.
Councilman Lodico asked if we had the right to do this, City
Attorney Weaver stated that the state probably gave permits for
the piers at one time, and that they were a health hazard, so
maybe they could take some action.
The City Clerk read a letter from the Library requesting in-
formation for expansion of the library. Fire Chief Walls said
that there was no limit as to how far north you could expand,
that the right of way was on the west. Councilman Lodico
asked how far do we want to expand? Vice Mayor Severance
instructed the City Clerk to locate the map of the library and
contact the Library Board.
The City Clerk read a letter from the Library concerning the
equipment they have been trying to get. Attorney Weaver said
that he has made three trips to Deland and written two letters
to the Volusia County Library and has still had no answer.
Vice Mayor Severance instructed the Library Board to write
another letter to the Volusia County Library and the City will
also write to Mr. Kelley. All the people interested should
contact Mr. Beck and Mr Benedict, who are County Councilmen
from this district.
The City Clerk read a letter from(the Library requesting
$100.00 dollars for the Christmas Party for the children of
Edgewater. Councilman Bevel duly made a motion to give them
$100.00, being seconded by Councilman Clinton. Upon roll
call vote said motion CARRIED.

The City Clerk read a letter from the Postal Service saying
that they forwarded her letter to the person in charge. Council-
man Lodico said that we should send a letter direct to Washington,
that he will contact Mrs. Andrews to find the addresses necessary.
~, Councilman Bevel duly made a motion to pass a Resolution so
the Council will be recorded as being apposed to lOOSing the
Post Office, being seconded by Councilman Clinton. Upon roll
call vote said motion CARRIED. The City Attorney Weaver was
instructed to draw up this Resolution.
The City Clerk read a letter from the Office of the Secretary
of the Treasury. Councilman Lodico duly made a motion to table
this for further' study being seconded by Councilman Clinton.
After some discussion Councilman Lodico duly withdrew his first
with Councilman Clinton withdrawing his second. Councilman Bevel
duly made a motion to instruct the auditors to preform this
necessary audit, being seconded by Councilman Clinton. Upon
roll call vote said motion CARRIED.

RESOLUTION NO: 495 A RESOLUTION APPROVING THE APPOINTMENTS
OF THE EDGEWATER VOLUNTEER FIRE DEPARTMENT INC. AND NAMING AND
DESIGNATING OFFICERS OF SAID EDGEWATER VOLUNTEER FIRE DEPARTMENT,
INC., PROVIDING THEY SHALL RECEIVE NO SALARY, PROVIDING THEY
SHALL EACH SERVE FOR ONE YEAR, AND PROVIDING AN EFFECTIVE DATE
THEREFORE.
The above Resolution,was read in full by City Attorney Joseph
Weaver.
Councilman Bevel duly made a motion to adopt said Resolution
being seconded by Councilman Clinton. Upon roll call vote said
motion CARRIED.

ORDINANCE NO 862 AN ORDINANCE AUTHORIZING AND DIRECTING
THE EXPENDITURE OF FUNDS GRATER THAN $500.00 FOR THE PURCHASE
OF A NCR ACCOUNTING MACHINE AND PROVIDING AN EFFECTIVE DATE
THEREFORE.

MENT OF THE COSTS OF THE PHYSICAL EXAMINATION REQUIRED FOR
EMPLOYMENT BY THE CITY OF EDGEWATER, FLORIDA TO ALL FULL-
TIME EMPLOYEES WHO HAVE COMPLETED 90 DAYS OF SERVICE WITH
THE CITY OF EDGEWATER AND TO ALL PART-TIM EMPLOYEES WHO HAVE
COMPLETED 30 DAYS OF SERVICE WITH THE CITY OF EDGEWATER,
FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFORE.

OLD BUSINESS
It was sugessted that Vito Castellano's salary be raised from
$125.00 to $150.00 per month. Councilman Clinton duly made a
motion to raise his salary, being seconded by Councilman Bevel.
Upon roll call vote said motion CARRIED. Mr. Castellano will
not have to mow the lawn.

Mr. Shamboro stated that we should paint the Street Signs
instead of buying more. There was much more discussion made
about Florida Shores streets, lights, weeds, etc. The Streets
are not being grated properly, they should be grated at an angle
instead of level.

Mr. Jack Sauers from the Carter Trailer Park was recognized as
needing water and sewer lines in his trailer park. He has not
had these lines for 1/2 year now, and is beginning to loose
business. He asked to be annexed to the City with the under-
standing that these lines would be connected. Councilman Bevel
stated that Mr. Cory was looking into this now. City Attorney
Weaver stated that he had been in touch with the Environmental
Protection Agency and told them the City was working to get
the trailer park connected.
Councilman Clinton stated that the playground is going to be
moved to the north area of .the entrance of the Park and Pier,
with a fence around it. The present fence will be moved but
will not be installed by the City Crew.

Councilman Clinton suggested that the City purchase a chipper
to pick up the trash. It will illiminate dumping all the
trash, it will turn the trash into sawdust and put four to five
truck loads in to one load.

Vice Mayor Severance discussed the Christmas lighting. The
lights will be turned on December 19th to January 1st. Council-
man Bevel duly made a motion to instruct the City Clerk to
contact Joe Martine and Florida Power and light, being seconded
by Councilman Clinton. Upon roll call vote said motion CARRIED.
They will be turned on at dark and off at one. This time
represents a 50% reduction over the time the lights burned last
year.
Mayor Dimm did contact men to up grade the Building Code. There
was a motion for the City Attorney to draw up the necessary
paper work for Resolution. Co'uncilman Bevel duly made a motion
to~adopt said motion being seconded by Councilman Lodico. Upon
roll call vote said motion CARRIED.
Councilman Clinton stated that there should be a speed limit
in the river for the boats. The City should contact the
Marine Patrol. The City ~ttorney was instructed to write. them.

Police Chief Katez said for him to write to the Department
of Natural Resources.
Councilman Clinton stated that some one had called the
Humane Society about a dog that had been in the neighbor-
hood for several weeks. They came by her home but did not stop
and pick the dog up. Councilman ,Clinton stated that we
should not pay the Humane Society for not doing their job.
Councilman Clinton duly made a motion to withhold payments,
until the Council and Humane Socie~y could discuss the
problem, being seconded by Councilman Bevel. Upon roll call
vote said motion CARRIED. City Clerk was instructed to write to
the Humane Society President of the Councils action.
Mr. Shamboro brought up t'he Building Code again and stated that
all the Councilmen should check out each of these houses them-
selves to see if the Building Inspector is doing his job and
if not we should find a new inspector. The City Clerk was instructed
to have Mr. LaBonde check these houses and give a written report
at the next Workshop Meeting, which Mr. LaBonde should attend.
The City Clerk was instructed to call "Doc" Wesbury about
the Building Codes from the County.
ANN OU NC Er~ENTS
Vice Mayor Severance said that Mayor Dimm was in serious
condition. His only visitors are his wife, daughter,and
son. He did not have a heart attack. We are hoping and praying
that he will come through okay.
Councilman Lodico suggested that the City Clerk get a card
for all of the Council members to sign., She replied that
she has sent flowers.

being seconded by Councilman Clinton. Upon roll call vote
said motion CARRIED.
