OCTOBER 15, 1973
The Regular Meeting of the City Council of the City of Edgewater.
Florida was called to order by Mayor Dana T. Armstrong on Monday
October 15, 1973 at 7:30 P.M.

APPROVAL OF MINUTES
Councilman Bevel duly made a motion to approve the minutes of the
Regular Meeting held September 17, 1973 and the motion was seconded
by Councilman Severance. Upon roll call vote said motion CARRIED.
Mayor Dana T. Armstrong voted NO.
Councilman Bevel duly made a motion to approve the minutes of the
Special Meeting held September 24, 1973 and the motion was seconded
by Councilman Severance. Upon roll call vote said motion CARRIED.
Mayor Dana T. Armstrong and Councilwoman Crigger voted NO.
Councilwoman Crigger duly made a motion to approve the minutes of
the Special Meeting held September 28. 1973 and the motion was
seconded by Councilman Clinton. Upon roll call vote said motion
Carried. Councilman Severance voted NO.
Councilwoman Crigger duly made a motion to approve the minutes of
the Regular Meeting held October 1, 1973 and the motion was seconded
by Councilman Clinton. Upon roll call vote said motion CARRIED.
Councilman Severance voted NO.
Councilwoman Crigger duly made a motion to approve the minutes of
the Special Meeting held October 8, 1973 and the motion was seconded
by Councilman Clinton. Upon roll call vote said motion CARRIED.
Councilman Severance voted NO.

COMMUNICATIONS
The City Clerk read a letter of appreciation from Senator Gillespie
regarding his accident on Park Avenue. He thanked the Police and
Fire Departments of the City of Edgewater for the assistance they
gave him. Mayor Armstrong also thanked the Departments for the
good work.
The City Clerk read a letter from Mr. & Mrs. Robert Hammond stating
that they had recently moved to the City of Edgewater and needed
a Street light on their road. Councilman Severance duly made a
motion to put this request in with others for a Street li9ht, being
seconded by Councilwoman Crigger. Upon roll call vote sald motion
CARRIED.
The City Clerk read a letter form an Insurance Agency to the
J.E. Tumblin Agency regarding insurance for the Fire Department.
An increase from six thousand (6,000) to ten thousand (10,000),
as cost of $62 yearly. Councilman Bevel duly made a motion to
increase the insurance to this amount, being seconded by Councilman
Clinton. Upon roll call vote said motion CARRIED.

The City Clerk read a letter from the Friends of the Library
regarding the Folks Art Festival Saturday, October 20, 1973
from 10:00 A.N. to 5:00 P.M.
The City Clerk read a letter from the Indian River Baptist Church
regarding a request for a variance on tbe property in which
Roscoe's Italian Restaurant is located. They would like to build
a new church and Sunday School rooms. Mayor Armstrong referred
this to the Zoning and Planning Board. Councilwoman Crigger duly
made a motion to refer this to the Zoning and Planning Board
being seconded by Councilman Severance. Upon roll call vote said
motion CARRIED.
The City Clerk read a letter from Mr. Hilton regarding a trailer
he wants to put on property as a temporary office. The Mayor
recommended that a permit for the trailer be issued for 90 days
and may be renewed by the City Council at any time. Councilman
Severance duly made a motion being seconded by Councilman Clinton.
Upon roll call vote said motion CARRIED.
PROCLAMATIONS
The Mayor announced that there would be a Buddy Poppy Sale on
Veterans Day, and urges everyone to support them.
RESOLUTIONS
RESOLUTION NO 481 A RESOLUTION ESTABLISHING A SEWER CONSTRUCTION
ACCOUNT FOR THE NEW POLLUTION CONTROL FACILITY TO BE CONSTRUCTED
AT THE SEWER PLANT IN THE CITY OF EDGEWATER, FLORIDA AND FURTHER
PROVIDING THAT SAID ACCOUNT SHALL BE OPENED AT THE BANK OF NEW
SMYRNA, NEW SMYRNA BEACH, FLORIDA IN THE AMOUNT OF THIRTY FOUR
THOUSAND ($34,000.00) DOLLARS AND FURTHER PROVIDING AN EFFECTIVE
DATE THEREFORE.
The above Resolution was read in full by City Attorney Joseph
Weaver.
Councilwoman Crigger duly made a motion to adopt said Resolution,
being seconded by Councilman Severance. Upon roll call vote
said motion CARRIED.
RESOLUTION NO 482 A RESOLUTION GRANTING S. O. GOLDSMITH OF
325 NORTH CAUSEWAY, #B106, NEW SMYRNA BEACH, FLORIDA A PERMIT
TO SEAWALL, DREDGE AND CONSTRUCT A BOAT BASIN AND DOCK IN THE
CITY OF EDGEWATER, FLORIDA LYING ON THE FOLLOWING DESCRIBED
LAND: THE EAST 68 FEET OF THE SOUTH 43 FEET OF THE NORTH 193
FEET OF THE WEST 400 FEET OF LOT 4-L AND THE EAST PART OF THE
NORTH 240 FEET OF LOT 4-L SOUTH OF LAMONT STREET BEING 245.33
FEET ON NORTH LINE AND 268 FEET OF THE SOUTH LINE, EXCEPT THE
NORTH 100 FEET AND SUBMERGED AND SEMI-SUBMERGED LAND EXTENDING

Councilwoman Crigger duly made a motion to adopt said Resolution,
being seconded by Councilman Severance. Upon roll call vote
said motion CARRIED.

RESOLUTION-NO-483 A RESOLUTION OF INTENT TO ENTER INTO A LEASE
PURCHASE AGREEMENT WITH FLORIDA EQUIPMENT COMPANY OF ORLANDO,
7410 EAST COLONIAL DRIVE, ORLANDO, FLORIDA FOR THE LEASE AND
PURCHASE OF A MIX IN PLACE TRAVEL TILLER AND PROVIDING AN
EFFECTIVE DATE THEREFORE.
The above Resolution was read in full by City Attorney Joseph
Weaver.
Councilman Severance duly made a motion to adopt said Resolution
being seconded by Councilman Clinton. Upon roll call vote said
motion CARRIED.

OR~INANCE NO 857 AN ORDINANCE ESTABLISHING THE MONTHLY SALARIES
TO BE RECEIVED BY EMPLOYEES IN THE OFFICE OF CITY CLERK, POLICE
DEPARTMENT, WATER AND SEWER DEPARTMENT, STREET DEPARTMEMT AND
CUSTODIAN, AND PROVIDING AN EFFECTIVE DATE THEREFORE.
The above Ordinance was read in full by City Attorney Joseph
Weaver.
Councilwoman Crigger duly made a motion to adopt said Ordinance
being seconded by Councilman Bevel. Upon roll call vote said
motion CARRIED.
ORDINANCE NO 858 AN ORDINANCE ESTABLISHING A SALARY OF
$150.00 PER MONTH FOR THE MAYOR OF THE CITY OF EDGEWATER AND A
SALARY OF $100.00 PER MONTH FOR EACH COUNC1MAN FOR THE CITY
OF EDGEWATER, FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFORE.
The above Ordinance was read in full by City Attorney Joseph
Weaver.
Councilman Severance duly made a motion to adopt said Ordinance
being seconded by Councilwoman Crigger. Upon roll call vote
said motion CARRIED.
ORDINANCE NO 859 AN ORDINANCE REPEALING ORDINANCE NUMBER 830
WHICH CLOSED THE CITY DUMP TO THE RESIDENTS AND NON-RESIDENTS
OF THE CITY OF EDGEWATER, FLORIDA AND FURTHER PROVIDING THAT
THE CITY DUMP SHALL BE OAEN TO CITY OD EDGEWATER RESIDENTS ONLY
AND FURTHER PROVIDING THAT NON-RESIDENTS OF THE CITY OF EDGEWATER
SHALL NOT BE PERMITTED TO USE THE CITY DUMP AND PROVIDING
PENALTIES FOR VIOLATIONS OF ANY PROVISIONS HEREOF AND PROVIDING
AN EFFECTIVE DATE THEREFORE.
The above Ordinance was read in full by City Attorney Joseph
Weaver.
Councilman Bevel duly made a motion to adopt said Ordinance
being seconded by Councilman Severance. Upon roll call vote said
motion CARRIED.
OLD BUSINESS
A motion was made to put a trailer for the Night Watchman (Ricky
Cole) for the Cole Equipment. Councilman Clinton duly made a
motion to adopt said motion being seconded by Councilman Severance,

NEW-&USINESS
A recommendation was made by Mr. Bishop for the City to take
the firemen and their wives, and the Council out to dinner, to
show their appreciation for their good work. Councilman Clinton
duly made a motion to this being seconded by Councilwoman Crigger.
There was a discussion and Councilman Clinton withdrew the
motion and Councilwoman Crigger withdrew her second. The Mayor
suggested that the firemen discuss this and get back to the
Council later. Fire Chief Walls was present and said he would
let the Council know their decision.
The Public Hearing being held October 16, 1973 was discussed.
Thirty people that this meeting would effect were notified. It
was made clear that this meeting was free to the public.
The City Clerk was instructed to advertise for bids for a new
Billing Machine. Councilman Severance duly made a motion being
seconded by Councilwoman Crigger. Upon roll call vote said motion
CARRIED.
MISCELLANEOUS
It was brought up that the Atlantic Machine Works had not done
anything about the back of the shop. City Attorney Weaver said
that he had talked to Mr. King and that he will fix it.
Councilman Clinton brought up that we should be doing something
to up grade the houses being built in Florida Shores. Be made
a motion to have Mr. LaBonde go back in the Building Code and
update it and develope a board to study it. To make it equal
or superior to the Southern Building Code. Councilman Clinton
duly made a motion to adopt this being seconded by Councilman
Severance. Upon roll call vote said motion CARRIED. Councilman
Bevel asked City Attorney Weaver to look into the legal aspect
of stopp~ng the building of these homes now, or until we could
do some work on the code. Attorney Weaver said there was no
legal basis to stop permits at this time and requested a chance
to survey the law and report to the City on it.
ANNOUNCEMENTS
Absentee ballots are available but must be returned by 5:00
P.M. on October 22, 1973.
Public Hearing being held October 16, 1973 at 7:30 P.M.in the
Mayors office.
Council Meeting October 24, 1973 in the Mayor1s office at 4:00
P.M. to canvass returns and declare the results of the Primary
Election.
ADJOURN OR RECESS
Councilman Clinton duly made a motion to adjourn this meeting
being seconded by Councilwoman Crigger. Upon roll call vote
said motion CARRIED.
