REGULAR MEETING HELD
JULY 2, 1973
The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor Dana T. Armstrong on Monday
July 2, 1973 at 7:30 P.M.

APPROVAL OF MINUTES
Councilwoman Crigger duly made a motion to approve the minutes of
the Regular Meeting held June 18, 1973 and the motion was seconded
by Councilman Severance. Upon roll call vote said motion CARRIED.
Councilwoman Crigger duly made a motion to approve the minutes of
the Recessed Meeting held June 22, 1973 and the motion was seconded
by Councilman Severance. Upon roll call vote said motion CARRIED.
BILLS & ACCOUNTS
r1ayor Armstrong asked for the Councils permission to hold the approval
of these accounts until later in the meeting. The Council agreed
to this

COMMUNICATIONS
The City Clerk read a letter from the Volusia County Council
regarding our request for assistance in obtaining a Southeast
Volusia County dumping area. Mayor Armstrong stated he was happy
to hear that the County would discuss this when their budget
talks came up.
The City Clerk read a letter from Mrs. J. Paladino requesting
several items be fixed near her home in Florida Shores at 2319
Evergreen Drive. Mayor Armstrong said that in the next few days
we will get down there and do some grading and mowing in the
area, as far as the street light request was concerned this
would have to be discussed at budget time with the others.
Councilman Severance duly made a motion to acknowledge her
correspondence and do what we can to correct the conditions there,
being seconded by Councilman Clinton. Upon roll call vote said
motion CARRIED.

ORDINANCF. NO. 827 ORDINANCE VACATING PROGRESS STREET IN THE
CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA AND PROVIDING AN
EFFECTIVE DATE THEREFOR.

Councilman Severance duly made a motion to adopt said Ordinance
on the second readinv" being seconded by Councilwoman Crigger.

ORDINANCE NO. 828 AN ORDINANCE AMENDING THE FOLLOWING SECTIONS
OF ORDINANCE NUMBER 219 TO REFLECT THE PROPOSALS OF THE ZONING
AND PLANNING BOARDS OF THE CITY OF EDGEWATER, FLORIDA AND ADDING
THE FOLLOWING SECTIONS: SUB-PARAGRAPHS (q) AND (v) OF SECTION 1
SUB-PARAGRAPH (m) OF SECTION 2, SECTION 4, SUB-PARAGRAPH (4) OF
PARAGRAPH (a) OF SECTION 7, SUB-PARAGRAPHS (3) AND (5) OF PARAGRAPH

on the second reading, being seconded by Councilman Severance.

ORDINANCE NO. 831 AN ORDINANCE AMENDING SECTION 2 OF ORDINANCE
NUMBER 779 AS AMENDED BY ORDINANCE NUMBER 784. SAID ORDINANCE
NUMBER 779 BEING AN ORDINANCE APPROPRIATING REVENUES TO BE
COLLECTED FOR THE CITY OF EDGEWATF.R, FLORIDA FOR THE FISCAL
YEAR BEGINNING NOVEMBER 1, 1972 AND ENDING OCTOBER 31, 1973
FOR THE VARIOUS ITEMS OF THE CITY BUDGET.
The above Ordinance was read in full by City Attorney Weaver.
Councilman Severance duly made a motion to adopt said Ordinance,
being seconded by Councilwoman Crigger. Upon roll call vote
said motion CARRIED.
Councilman Severance duly made a motion to waive the second
reading, beinF, seconded by Councilwoman Crigger. Upon roll
call vote said motion CARRIED.
ORDINANCE NO. 832 AN ORDINANCE PROHIBITING COMMERCIAL ACTIVITY
WITHIN ANY RESIDENTIAL DISTRICT IN THE CITY OF EDGEWATER, FLORIDA
WITHOUT THE CONSENT OF THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA.
The above Ordinance was read in full by City Attorney Weaver.
Councilman Bevel duly made a motion to adopt said Ordinance,
being seconded by Councilman Clinton. Upon roll c~ll vote said
motion CARRIED.

ORDINANCE NO 833 AN ORDINANCE ESTABLISHING THE OFFICE OF
PUBLIC DEFENDER IN THE MUNICIPAL COURT OF THE CITY OF EDGEWATER,
FLORIDA FURTHER PROVIDING THAT SAID PUBLIC DEFENDER SHALL BE A
MEMBER IN GOOD STANDING OF THE FLORIDA BAR AND PROVIDING AN
EFFECTIVE DATE THEREFORE.

ORDINANCE NO 834 AN ORDINANCE APPOINTING JEFFERSON W. CLARK
AS PUBLIC DEFENDER IN THE MUNICIPAL COURT OF THE CITY OF EDGEWATER
FLORIDA SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, SETTING
FORTH HIS COMPENSATION THEREFORE AND PROVIDING AN EFFECTIVE DATE
THEREFORE.

ORDINANCE NO 835 AN ORDINANCE CHANGING THE FISCAL YEAR OF THE
CITY OF EDGEWATER, THE NEW FISCAL YEAR TO BEGIN ON OCTOBER 1st OF
EACH YEAR AND FURTHER PROVIDING THAT THE CURRENT FISCAL YEAR SHALL
END ON SEPTEMBER 30, 1973 AND THE NEW FISCAL YEAR FOR THE FISCAL
PERIOD 1973 THROUGH 1974, SHALL BEGIN ON OCTOBER 1, 1973 AND SHALL
END ON SEPTEMBER 30, 1974, AND FURTHER PROVIDING AN EFFECTIVE DATE
THEREFORE.

Councilwoman Crigger duly made a motion to adopt said Ordinance
being seconded by Councilman Clinton. Upon roll call vote said

Mayor Armstrong advised the Cnunci1 that now a motion would be
in order to approve the Bills & Accounts as we now have amended
the Appropriation Ordinance. Councilwoman Crigger duly made a
motion to pay said bills & accounts,being seconded by Councilman
C1into. Upon roll call vote said motion CARRIED.
Counci1woamn Crigger duly made a motion authorizing the City Clerk
to make payments for the Federal Revenue Sharing Fund where ever
applicable, being seconded by Councilman Bevel. Upon roll call
vote said motion CARRIED.

Councilman Bevel advised the Chief of Police that the heavy trucks
were still using the paved streets in Florida Shores. Mayor
Armstrong stated that we have had this problem before, I believe
the appropriate action would be to have Chief Katez speak personally
to the people driving the trucks and see if we can't get their
cooperation. Chief Katez informed the Council he would do this.
Mayor Armstrong informed the Council that Mr. Bernard Martin had
submitted his application for the position of Street Foreman, he
did have to give a 10 day notice where he is now working, if the
Council agrees we can recess this meeting to meet with Mr. Martin
and review his qualifications for the position. Mayor Armstrong
said he has several good qualifications, although he is not familiar
with Edgewater, this is something he could learn. He seems to be
capable of instruction and handling employees. Councilman Bevel
said he was willing to go along with the Mayors judgement. Mayor
Armstrong asked that that be put in the form of a motion. Councilman
Bevel duly made a motion authorizing the Mayor to use his judgement
in hiring Mr. Bernard Martin as Street Superintendent being-seconded
by Councilwoman Crigger. Upon roll call vote said motion cARRIEU.
ADJOURN OR RECESS
Councilman Bevel duly made a motion to adjourn this meeting being
seconded by Councilman Severance. Upon roll call vote said motion
CARRIED.
