OFFICERS REPORTS Certification of Posting Building Officials report for May, 1973 Mayor Armstrong stated the building in Edgewater is the highest ever recorded in a month and the year to date total is the highest it has ever been. C 0 ~1 M U N I CAT ION S City Clerk read a letter from Briley, Wild & Associates regarding authorizing them to file the necessary applications with the Environmental Protection Agency regarding Federal Grants for the future. Councilwoman Crigger duly made a motion authorizing the Mayor and City Clerk to sign the necessary papers giving Briley, Wild and Associates the authority to file the necessary applications, being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. City Clerk read a letter from Miller Wrecker Service requesting they be put on the rotation list with the Police Department. Mayor Armstrong stated that this letter was detrimental to him, the past administration adopted a policy unanimously, to cater to Edgewater wrecker services. I did talk to Mr. Miller, and told him if he would establish an address in Edgewater the City Council would be happy to put him on the rotation list. Mayor Armstrong stated he had not dictated to anyone, he had only carried out the policy of the entire City Council. City Clerk read a letter from the Department of Transportation regarding a five year plan of work regarding the construction and maintenance of roads and streets within the City limits. Mayor Armstrong stated this request will take some studying, it must be done though, as the Florida Statutes require we file this plan with the Department of Transportation. Councilman Severance duly made a motion to table this letter for the workshop for further discussion and that a copy of this go to the Zoning and Planning Board and let them also be working on the survey, being seconded by Councilman Clinton. Upon roll call vote said motion CARR[ED. City Clerk read a letter from Mr. & Mrs. Leslie V. Tindal requesting a street in Industrial Park area be abandoned, the street being Progress Street. Mayor Armstrong stated this is a forty foot non- existing street. We have checked the records and failed to find a deed giving this to the City of Edgewater. However, it is still necessary to go through the proper process. Later in the meeting we have a Resolution of intent regarding this item. City Clerk read a letter from the Edgewater Public Library Board acknowledging the receipt of a check in the amount of $963.12 from fue City of Edgewater. 2 . 8 o City Clerk read a letter from Sentry Alarm Systems requesting: permission to install an alarm monitor in the Police Department. Councilman Severance duly made a motion to refer this request to the City Attorney to research the Charter and see if this type of equipment is prohibited', and have his opinion at the next meeting, being seconded by Councilwoman Crigger. Upon roll call vote said motion CARRIED.. City Clerk read a letter of resignation from LeRoy Cutshaw, Superintendent of Public Works, to be effective June 14, 1973. Councilwoman Crigger duly made a motion accepting LeRoy Cutshaws resignation, being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. RESOLUTIONS RESOLUTION NO. 468 RESOLUTION OF INTENT TO VACATE PROGRESS STREET IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFORE. The above Resolution was read in full by City Attorney Joseph Weaver. Councilwoman Crigger duly made a motion to adopt said Resolution, being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. ORDINANCES ORDINANCE NO 825 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXPEND THE $5,000.00 ALLOCATED FOR POLICE DEPARTMENT SALARIES IN THE CITY OF EDGEWATER REVENUE SHARING FUND ACCOUNT FOR THE SALARIES OF THE POLICE DEPARTMENT EMPLOYEES AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Ordinance was read in full by City Attorney Joseph Weaver. Councilman Clinton duly made a motion to adopt said Ordinance being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. Councilman Severance duly made a motion to waive the second reading being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. OLD BUSINESS Mayor Armstrong announced that the City Council has discussed the problem of the Edgewater City Dump on several occasions, but have never solved the problem. We have had the City Attorney research the existing laws to find out if we have police powers at the dump. and he advises us that we do under Section 5, of Ordinance 611. Many evenings and weekends people are seen out there dumping trash, and the majority of them are from out of town. We have the only free, open land fill operation in South East Volusia County. At the rate it is filling up we cannot maintain an area for the entire County. It was agreed upon by the City Council that tonight we would make a decision about the situation. If anyone from the audience has any comments we would like to hear them. A gentleman from the audience ffiked what the penalty would be for anyone violating this Ordinance. Councilman Severance stated it would be subject to Section 1-8 of the City Code which carries a penalty of up to $500.00. Councilman Bevel duly made a motion authorizing the City crews to remove the Edgewater residents dumping sign at the City Dump and to immediately start enforcing Ordinance 611, being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. 3 . a u Councilman Bevel asked the City Attorney if we had received any word from Volusia County regarding increasing the equipment inventory in the Library. City Attorney Weaver stated he had received some word on this but needed to contact them and do a little more negotiating with them. Mayor Armstrong stated a few months ago we passed a Resolution authorizing a study be made at U.S. Highway 1 and Ocean Avenue for a traffic signal. The Department of Transportation submitted the results of their study to the City Council stating that the inter- section did not warrant a traffic signal. The City Council requested they go over the current accident records, which they did and advised us again that it still did not warrant a signal. Since the last letter there has been quite a bit of discussion regarding the matter, and as a result we have petitions with 127 signatures requesting te City of Edgewater pursue this dangerous situation. Mayor Armstrong stated we would like to thank all of the concerned Citizens for their time and intere~t in"thfs.problem. I believe we need to spell it out to the Department of Transportation in another Resolution. Councilman Severance duly made a motion to have another Resolution indicating everything implicated in this problem and submit it to the Department of Transportation. Being seconded by Councilman Clinton. Upon roll call vote said motion CARRIED. Mayor Armstrong suggested we have Boyd DeLoach research this problem ffid have him submit his opinion, also a letter from Fire Chief, anything referring to this as a problem area would have a great bearing on the Department of Transportation decision. Fire Chief Walls stated that Hurricane season is here now and he just uncovered a culvert by his home that was blocked up, he suggested the Council have someone check these out and get them cleaned out. Ray Shambora asked if there wasn't a way for the Council to control the littering problem. The cans and bottles in the Florida Shores area alone are really getting to be a problem. Mr. Christy brought a newspaper article to the Councils attention. The article pertained to a Mr. Miller who had received a traffic citation in Edgewater and was quite upset over the situation, stated to the press that there was a lot of graft in Edgewater. Mr. Christy said this implicates me, my family and everyone in Edgewater. Mayor Armstrong said irrespect of the outcome of the mans case in court what cause has the City of Edgewater got? City Attorney Weaver stated the article is in general terms a blanket condemnation, unless it reflects upon a particular person nothing can be done. Mayor Armstrong announced he challanged the mans statement, he is a liar if he doesn't come forward with proof of graft in Edgewater. Mayor Armstrong said he has a problem for the Chief of Police. It has been brought to his attention, with all due respect to the Edgewater Chamber of Commerce, near Silver Ridge entrance on the North side of the highway there is a school bus stop shelter, which creates a hazardous condition, as it obstructs the view of traffic when one is trying to enter the highway. I would like to have Chief Katez check this out and if we find it to be a hazard consult with the Chamber of Commerce and have it removed. 4. 8 o NEW BUSINESS NONE MISCELLANEOUS NONE ~ I ADJOUR OR RECESS Councilman Bevel duly made a motion to adjourn this meeting, being seconded by Councilwoman Crigger.
