Katez Present Present Present Present Present Present Present Present Present APPROVAL OF MINUTES Councilman Severance duly made a motion to approve the minutes of the meeting held October 16, 1972, and motion was seconed by Councilman Wiggins. Upon roll call vote, said motion CARRIED. As the meeting of October 19, 1972, was recessed for lack of a quorum. The minutes of said meeting are hereby entered as a matter of record. Councilman Severance duly made a motion to approve the minutes of the meeting held October 23, 1972, the date on the orginal minutes has been changed from the 19th to the 23rd due to a typographical error. Said motion was seconed by Councilman Wiggins with Councilwoman Crigger voting no. They had attached a list alphabetically listing the locations they thought were of most importance. Mayor Armstrong recommended this letter be tabled until the November 16, 1972 workshop meeting when the Florida Shores Property Owners Assoc. members and the City Council can get together and work out the most feasable plan for these lights. The City Clerk read a letter from the Florida Shores Property Owners Assoc. requesting the City Council correct the dog control" Ordinance. A recent incident in Florida Shores where a small dog was killed by a larger dog was briefly discussed. Mayor Armstrong stated this was unfortunate, however it lid wake us up to the fact that something does need to be done. The City Attorney said with the permission of the City Council I would like to re-work the five existing Ordinances pertaining to dogs and make one Ordinance with a little more control. This is a very delicate situation and will require careful preparation. Mayor Armstrong recommended the City Council instruct the City Attorney to draw up an animal control ordinance for their consideration at the next workshop meeting. Councilman Severance duly made a motion for the City Attorney to draw this ordinance, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. The City Clerk read a letter from the Edgewater Library Broard requesting a $100.00 Construction Fund be maintained in the City of Edgewater Budget. Councilman Wiggins asked if this request would conflict with Volusia County taking over the Library on October 1, 1972. Mayor Armstrong said it would not as we still owned the building. Councilman Severance duly made a motion to concur with the Library Board request, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. The City Clerk read a letter from the Volusia County Council of Governments requesting a current legal description of the corporate limits of the City of Edgewater. Councilman Wiggins duly made a motion to forward this information to the County Council, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. The City Clerk brought an order form blank" fr.om ~inn-Dixie to the attention of the City Council. They are inquiring if the City would be interested in purchasing Gift Certificates for the employees for Christmas. Councilwoman Crigger made a motion to table this for further discussion, possibly a cash bonus rather than Gift Certificates, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. The City Clerk read a letter from the State Attorney, office regarding the Seminar on Article V on November 15, 1972. Councilwoman Crigger asked who would benefit from attending this semi~ar. City Attorney Joseph Weaver stated the Chief of Police and Court Clerk have the most to do uith this problem. Councilwoman Crigger duly made a motion to send the Chief of Police and the Court Clerk,being seconded by Councilman Severance. Councilman Severance requested the Chief of Police report to the Council in summary form the findings of this seminar. Upon roll call vote, said motion CARRIED. 3 . / u u The City Clerk read a letter from Mr. Bill Cheek requesting the City assist in a golf course project. Mayor Armstrong stated he appreciated Mr. Cheek1s letter, but I don't know where there is a big enough piece of property to accomodate such a project. What could possibly be done is a private concern or corporation undertake a project of this size. Councilman Wiggins duly made a motion a letter be written to Mr. Cheek sU9gesting a private concern take on a project of this nature, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. The City Clerk read a letter from Mr. Robert Poland requesting a land fill permit for his property on Riverside Drive. City Attorney stated he had talked with Mr. John DuBoise of the Trustees of the Internal Improvement Fund and he agreed with us that we (the City) have to issue the permit, then forward it to the Trustees for their concurrence. Mayor Armstrong asked the City Attorney if the City Council was within jurisdiction to issue a permit of this type. City Attorney answered yes. Councilwoman Crigger duly made a motion to forward the application for permit to Mr. Poland, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. The City Clerk read a letter of resignation from Viola Deputy Clerk. Councilwoman Crigger duly made a motion the resignation, being seconded by Councilman Wiggins. call vote, said motion CARRIED. Councilman:Wiggins duly made a motion to accept the resignation with regret, being seconded by Councilman Severance, Upon roll call vote, said motion CARRIED. The City Clerk advised the City Council the owner of the Winn-Dixie Shopping Center property had made a verbal request to have the canal on the North side of the property cleaned by the City. City Attorney advised the Council he had checked the legal description of~this property and the shopping center property goes to the North corporate limits. Councilman Severance duly made a motion to advise the owner by letter that he owned the property in question, being seconded by Council\~oman Crigger. Upon roll call vote, said motion CARRIED. PROCLAMATIONS NONE RESOLUTIONS NONE ORDINANCES ORDINANCES NO 788 AN ORDINANCE TERMINATING VIOLA FREEMAN AS DEPUTY CLERK AND PROVIDI~IG AN EFFECTIVE DATE THEREFOR. The above Ordinance being read in full by City Attorney Joseph Weaver. Councilman Wiggins duly made a motion to approve said Ordinance, Being Seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. Councilman Severance duly made a motion to waive the second reading. Being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. 4. . v u ORDINANCES NO 789 AN ORDINANCE DESIGNATING AND APPOINTING JOHN JOSEPH ZIERS AS REGULAR PATROLMAN FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, SETTING FORTH HIS COMPENSATION FOR SUCH OFFICE, AND PROVIDING AND EFFECTIVE DATE THEREFOR. The above Ordinance being read in full by City Attorney Joseph Weaver. Councilman Severance duly made a motion to approve said Ordinance. Being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. Councilman Severance duly made a motion to waive the second reading. Being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. OLD BUSINESS Cornelia A. Kinsey, City Clerk, opened and read the bid for the speed timing device. The bid being as follows: Kustom Signals, Inc. 1010 W. Chestnut Chonute, Kansas $2,075.75 A certification of funds was read by the City Clerk. After a brief discussion regarding the operation of this type unit, Councilman Severance duly made a motion to accept said bid, being seconded by Councilwoman Crigger, with Mayor Armstrong voting No. Upon roll call vote, said motion CARRIED. NEW BUSINESS Mr. William Cairnie of the American Legion gave a brief speech and presented Mayor Armstrong with an American Flag from Mrs. William Sciscoe in memory of William Sciscoe who was a long time resident of Edgewater and a dedicated Legioneer. Mr. Cairnie requested Mrs. Sciscoe be called when the flag is going to be flown. Mayor Armstrong thanked Mr. Cairnie for himself and the City Council. A brief discussion was held regarding the closing of all City facilities Friday after Thanksgiving. Mayor Armstrong stated he was in favor of giving the employees a four day week-end. Councilman Ganta duly made a motion to let all employees but Police Dept. off the day after Thanksgiving, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. MISCELLANEOUS Chief Katez requested permission to advertise in all three local papers for a patrolman. Councilwoman erigger duly made a motion to have the City Clerk place the ad in three papers, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. Councilman Severance asked the City Attorney to Clarify for him Ordinance 677 giving Department heads permission to spend up to $100.00 and Resolution 421 authorizing the Mayor to conduct day to day business. City Attorney Weaver advised Councilman Severance the ordinance refers to money and the resolution refers to power, they are not talking about the same thing. Mayor Armstrong said what he wanted to know was if this expenditure was in compliance with the City Charter. Attorney Weaver said he would have to research this question. ADJOURN OR RECESS: 5 .
