Upon roll call vote, said motion CARRIED. OFFICERS REPORTS Certification of Posting COMMUNICATION City Clerk read a letter of resignation from Carl Griffin, patrolman, effective October 6, 1972. Councilwoman Crigger duly made a motion to accept the resignation with regret. Councilmen Wiggins seconded. Upon roll call vote, said motion CARRIED. The City Clerk read a letter from the East Volusia County Mosquito Control District requesting better drainage facilities. Mayor Armstrong stated Halter Braddock had called this to his attention and he advised Mr. Braddock to send his request in letter form to the City Council. There is a two to two and one half foot deep blanket of muck, which makes it impossible to get machinery in there to correct the problem. Mayor Armstrong said he would deed simple fee title to the City of Edgewater a 40' right of way, 600' long for the purpose of correcting this problem, only if they get the easement all the way to Pearl Street, which is a total length of 1500.. Councilman Wiggins duly made a motion to table this until such time as the entire Council has an opportunity to inspect the area. Councilman Severance seconded the motion. Upon roll call vote, said motion CARRIED. PROCLAMATIONS NONE RESOLUTIONS RESOLUTION No. 442 A RESOLUTION APPOINTING AN ELECTION CLERK, INSPECTORS AND A SPECIAL OFFICER FOR THE PRIMARY CITY ELECTION TO BE HELD IN THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, OCTOBER 24, A.D. 1972 AND THE GENERAL ELECTION TO BE HELD ON NOVEMBER 7, 1972. Councilman vliggins duly made a motion to adopt said Resolution, being seconded by Councilwoman Crigger. Upon roll call vote said motion eARRIED RESOLllTION NO. 443 A RESOLUTION DECLARING THE CANDIDATES FOR THE OFFICE OF COUNCILMAN FROM ZONES 2 AND 4 TO BE NOMINATED AT A PRIMARY ELECTION TO BE .IELD OCTOBER 24, 1972 AND DECLARING 'THE CANDIDATES AND NOMINATION OF A COUNCILMAN FROM ZONES 2 AND 4 TO BE VOTED UPON AT THE GENERAL ELECTION TO BE HELD NOVEr~BER 7, 1972, SAID CANDIDATES TO BE . VOTED UPON CITY WIDE, AND PROVIDING FOR THE PREPARATION AND PRINTING OF BALLOTS FOR SAID ELECTION; AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman l~iggins duly made a motion to adopt said Resolution, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. Mayor Armstrong said he has two questions for the City Atty. Re: Qualifying of the candidates. In order to protect any malfeasance act on the qoverning body, have you researched the two questions I asked you I a few weeks ago. Attorney Weaver stated he would certify that individ- uals shall not be in violation if he received no salary, he would have nol conflict of interest. ORDINANCES ORDINANCE NO. 779 AN ORDINANCE SETTING A TENTATIVE BUDGET AND APPROPRIATING REVENUES TO BE COLLECTED FOR THE CITY OF EDGEWATER VOLUSIA COUNTY, FLORIDA, FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 2 o o 1972 AND ENDING OCTOBER 31, 1973 TO THE VARIOUS ITEMS OF THE CITY BUDGET. The above Ordinance being read in full by City Attorney Joseph Weaver. Councilman Wiggins duly made a motion to approve said Ordinance. Said motion being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. Second reading to be held 10/16/72. ORDINANCE 780 AN ORDINANCE APPROPRIATING REVENUE TO BE ~LLECTED FOR THE W~TERWORKS AND SEWER SYSTEM OF THE CITY OF EDGE WATER, FLORIDA, FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1972 AND ENDING OCTOBER 31, 1973 TO THE VARIOUS ITEMS OF THE WATERWORKS & SEWER SYSTEM BUDGET. The above Ordinance being read in full by City Attorney Joseph Weaver. Councilwoman Crigger duly made a motion to approve said Ordinance. Said motion being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. Second reading to be held October 16, 1972. ORDINANCE No. 781 AN ORDINANCE ADOPTING AND ACCEPTING A CONTRACT BETWEEN TIlE CITY OF EDGEWATER, FLORIDA AND THE VOLUSIA COUNTY COUNCIL CONCERNING THE VOLUSIA COUNTY LIBRARY SYSTEM, AND PROVIDING AN EFFECTIVE DATE THATEFOR. The above Ordinance being read in full by City Attorney Joseph Weaver. Councilman Wiggins asked if the two changes were made in the revised contract sent out by Volusia County Library Board. Mayor Armstrong stated he talked with Mr. Kantor of the Volusia County Public Libraries and informed him without these changes we would have to turn it down and put it on a referendum Nov. 7, 1972. Councilwoman Crigger stated I understand we are the only City that has not adopted this contract. We can put it out on a lend-lease basis without giving the Library away. Councilman WiggiDs said our Library Budget sits at $8,9QO.00, how much of that will the County assume? Mayor Arm- strong said probably 3/4 of it. Paul Walls said we have a $1,200.00 book budget, this figure doesn"t begin to touch the actual cost. The Board is not professional, but they do a very good job. Going with the County system it will give us a great deal of professional assistance. Mayor Armstrong stated I agree with you providing we -don't run into a pitfall. Councilman Wiggins asked if this will be the Edgewater Library or the Volusia County Library? Mayor Armstrong said it will be Edgewater Library a branch of the Volusia County Library. Councilman Wiggins asked if signing the contract would be in violation of the City Charter, City Attorney stated it would not. Councilman Severance duly made a motion to approve said Ordinance. Said motion being seconded by Councilwoman Crigger. Upon roll call vote said motion CARRIED. Councilman Severance duly made a motion to adopt as read.and waive second reading. Councilwoman Crigger seconded the motion. The above Ordinance being read in full by City Attorney Joseph Weaver. 3 o o ORDINANCE NO. 782 AN ORDINANCE PROVIDING FOR A SALARY INCENTIVE PROGRAM FOR THE POLICE OFFICERS OF THE CITY OF EDGEWATER, IN COMPLIANCE tHTH THE REVENUE SHARING ACT OF 1972 OF THE STATE OF FLORIDA;SETTING FORTH THE AMOUNT OF ADDITIONAL MONTHLY SALARY TO BE PAID TO SAID POLICE OFFICERS, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Ordinance being read in full by City Attorney Joseph ~! e a v e r . Councilman Wiggins asked if the figure was $25.00 or up to $25.00 per month. Councilman Severance stated any advance education in reference to this must be in compliance with the Police Standards Board. John Bevel stated the Federal Government reimburses the full amount ~f this. It is not costing the taxpayer anything. Mayor Armstrong briefly discussed if anyone knew what the procedure is to receive this re- imbursement. City Attorney stated he would research this tomorrow and get with the City Clerk as to the proper forms, applications, etc. Councilman Severance duly made a motion to approve said Ordinance. Said motion being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. Councilman Wiggins duly made a motion to waive the second reading of the Ordinance. Being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. ORDINANCE No. 783 AN ORDINANCE EMPLOYING AND APPOINTING WILLIAM L. ROSS, JR. AS MUNICIPAL JUDGE OF THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH HIS SALARY, SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman vliggins duly made a motion to approve said Ordinance. Being seconded by Councilwoman Crigger. Upon roll call vote said motion CARRIED. Councilman vJiggins duly made a motion to ~aive the second reading. Being seconded by Councilman Severance. Upon roll call vote said motion CARRIED. ORDINANCE No. 784 AN ORDINANCE AMENDING ORDINANCE NUMBER 779 TO REFLECT ADDITIONAL ANTICIPATED REVENUES TO BE COLLECTED BY THE CITY OF EDGEWATER, FLORIDA, FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1972 AND ENDING OCTOBER 31, 1973 AND APPROPRIATING SAID ADDITIONAL ANTICIPATED REVEr/UES TO VARIOUS ITEt~S OF THE CITY BUDGET. The above Ordinances being read in full by City Attorney Joseph Heaver. Councilman Wiggins duly made a motion to approve said Ordinance. Said motion being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. Second reading of the Ordinance will be October 16, 1972. OLD BUSINESS Mayor Armstrong stated no date had been set for return of the bids on the radar unit. He recommended the City Council rephase the specifications so no one is purposely written out. If we advertise for a radar or similar devise the City Council can accept what is in the best interest of the City. Councilman Severance duly made a motion to rephase the specifications and have bids be returned by 11/6/72 4:30 P.M. Said motion being seconded by Councilman Wiggins. Mayor Armstrong stated we have a letter from Mr. Edwin H. Willis requesting postponement of the Public Hearing of vacating a portion of Flagler and Railroad Streets per Maule Industries request to a later date. Mr. Gene Hillson of Maule Industries 4 . u o is here with us and has a letter walvlng the objection from Mr. Edwin H. ~Iillis. Mr. Hi~lson stated Maule Industries have told Mr. Willis if Florida East Coast Railroad will not give him a crossing Maule Industries will. John Bevel asked if the City Council had an~ objection to giving this property to Maule Industries. They Stated No. Mayor Armstrong instructed the City Attorney to draw up the Ordinance vacating that portion of Flagler and Railroad Avenue to Maul~ Ind. Carmen Montesano asked when anyone was going to do anything about the ditches in Florida Shores. Mayor Armstrong urged the City Council to inspect these ditches. If anyone has a solution to this problem please present it to the Council Mayor Armstrong reminded everyone it is time to start thinking about Christmas d~corations. Mayor Armstrong stated working on putting this together three months to do this. - necessary to update a Charter Study Boardr the correct.way.
