3. APPROVAL OF MINUTES
A motion was made by Sherry Lester, second by Alice Haldeman, to approve the minutes
of the December 8, 2016 meeting. The MOTION was APPROVED by the following vote:

4. SWEARING IN OF WITNESSES
Chairman Wagner wanted this statement to be entered into the record to clarify why we are here.
The purpose of this Board is to hear cases presented to us by the Code Enforcement Officers to
determine if a violation exist and if so to set the appropriate fines. That is what we are here for and
that is what we will continue to do.

Hamilton Dr., Edgewater, FL; Mark Venables of 2015 Halifax Dr., Port Orange, FL; Tom Ryan of

5. PAID CITATIONS
Code Supervisor Division Chief Jeff Lariscy asked the Board to find the paid citation in violations
therefore the we can deemed them as repeat offenders. We would like to pull item B since the
property owner is present and hear A and C in an expedited fashion. The Board agreed to hear item
5 B.

Code Officer Robert Hazelwood presented the case to the Board. The citation was paid on January
10, 2017. Wayne Zielinski was present and wanted to make sure this was taken care of thru the sale.
The property is in compliance.

Chairman Ben Wagner read Case #16-111586 and Case #16-111889 in the record and concluded
with it appears after reviewing these cases that no one was present for any of the cases just read.
Pursuant to Section 10-348 and 10-345 subparagraph C 11 of the Code of Ordinances and the
statement that appears on the respective citation issued that failure to appear at the hearing means
the alleged violator has waived any right to contest the violation and that an order can be made for
the maximum applicable penalties that include but are not limited to administrative costs, fines, daily
fines and liens. Since however we have the benefit of the staff recommendations, the Board shall
entertain motions and take whatever actions are deemed appropriate.

Code Supervisor Division Chief Jeff Lariscy asked the Board to move agenda item H to be the first
case to be heard. The Board agreed with the changes to the agenda.

Chairman Ben Wagner read the below listed cases and concluded with it appears after reviewing
these cases that no one was present for any of the cases just read. Pursuant to Section 10-348 and

7. CODE COMPLIANCE REPORT
Code Supervisor Division Chief Jeff Lariscy stated that for the month of December code had 147 new
cases, 240 working cases, 55 NOV, 19 courtesy, 99 resolved cases and 92 notices. We have hired
Officer Hazelwood full time as of January 3.
8. PUBLIC COMMENTS
Patricia Silvestro of 1726 Queen Palm Dr., Edgewater, FL gave a brief statement regarding property
they purchase and commended Officer Kevin Pogany for his assistant.
Nikki Hughart discussed the presentation at the City Council meeting regarding the Code Board and
shared her opinion to the comments made at the meeting. Also Chairman Ben Wagner made remarks
to the topic as well.
Code Supervisor Division Chief Lariscy gave a brief overview of the City Council meeting.
