A motion was made by Alice Haldeman, second by Sherry Lester, 1) Within 30 days to
apply for permits and submit plans to the City 2) The plans will be presented to the
Board in the next meeting. The plans should have been reviewed by the City Engineer
and approved by the City Engineer. 3) An expectation that the work would be completed
in 60 days from todays date (February 9, 2017) and 4) that the portions that is
endangering public safety be fixed by February 13, 2017. The MOTION was

The case was presented by Code Officer Kevin Pogany to the Board. Case #111827 A, B, and C
were dismissed. Attorney Tanner Andrews of 112 W. New York Ave. #203; Deland, FL was present
and representing Mr. Ingles. Pictures were presented and discussed.
City Attorney Michael Ciocchetti would like to table this until next month meeting.

Chairman Ben Wagner read the below listed cases and concluded with it appears after reviewing
these cases that no one was present for any of the cases just read. Pursuant to Section 10-348 and
10-345 subparagraph C 11 of the Code of Ordinances and the statement that appears on the
respective citation issued that failure to appear at the hearing means the alleged violator has waived
any right to contest the violation and that an order can be made for the maximum applicable
penalties that include but are not limited to administrative costs, fines, daily fines and liens. Since
however we have the benefit of the staff recommendations, the Board shall entertain motions and take
whatever actions are deemed appropriate.

8. CODE COMPLIANCE REPORT
Code Supervisor Division Chief Jeff Lariscy stated that for the month of January: 162 new code
cases and 151 resolved cases. Code Board Members can report violations but not while on the dais
from the State Attorney General opinion.
