Mr. Hamilton testified and presented Exhibit A (an email) and Exhibit B (a jump drive) with pictures & videos for the Special Magistrate to review. City Engineer/Deputy Director of Public Works Randy Coslow was present and testified providing information regarding this case. b.Case #17-113233 B Citation #5703 (Hazelwood) William A. Hamilton - 2904 Unity Tree Dr. Sec. 10-84 Easements or ROW Special Magistrate James Stokes stated based upon the evidence that he has heard and seen finds William A. Hamilton in violation of Section 15-4 and 10-84 of the Code of Ordinances, assessing the citation fine of $75.00 each and $50.00 per day additional fine for each day the violation exists past January 31, 2018 also for a lien to be placed on the property if not satisfied. i.Case #17-112892 Citation #6111 (Hazelwood) Linda C. Rogers - 2914 Yule Tree Dr. Sec. 21-36.02 General regulations Code Officer Robert Hazelwood presented the case. Dennis Rogers was present and testified that he has removed the shed. Mr. Rogers states that he was involved in an accident and that caused delay in the removal. The shed has been removed and is for sale. Katherine Rivera was present and testified. Mrs. Rivera stated that they contacted someone to remove the shutters but they were caught by the hurricane in Puerto Rico but they finally removed them. Special Magistrate James Stokes stated based upon the evidence finds in violation of Sec. 10-239 temporary storm protection assessing the $75.00 citation fine. Mclaughlin - 2520 Umbrella Tree Dr. Sec. 10-402 Alternate method of enforcement Special Magistrate James Stokes read the above cases and concluded with it appears after reviewing these cases that no one was present for any of the cases just read. Pursuant to Section 10-348 and 10-345 subparagraph C 11 of the Code of Ordinances and the statement that appears on the respective citation issued that failure to appear at the hearing means the alleged violator has waived any right to contest the violation and that an order can be made for the maximum applicable penalties that include but are not limited to administrative costs, fines, daily fines and liens. Since however we have the benefit of the staff recommendations, the Special Magistrate shall entertain motions and take whatever actions are deemed appropriate. 9.
