CALL TO ORDER 2. PURPOSE/PROCESS OPENING STATEMENT Special Magistrate James Stokes gave a brief overview of the purpose/process opening statement. 3. APPROVAL OF MINUTES Special Magistrate James Stokes approved the minutes of the February 8, 2018 meeting. 4. SWEARING IN OF WITNESS(ES) Sworn in were Kevin Patel & Steve Patel of 2340 S. Ridgewood Ave., Edgewater, FL; Bruce Crew, Dianne Kroeger Crew, and Scott Crew of 1303 Victory Palm Dr., Edgewater, FL; Code Officer Robert Hazelwood and Code Officer Kevin Pogany. 5. Bruce, Dianne Kroeger Crewe and Scott Crewe were presented. Scott Crewe stated that he is currently employed and not operating a business at this time. Special Magistrate James Stokes requested evidence to prove the business is closed. Special Magistrate James Stokes finds in violation of Section 11-2 and 11-9 and he needs to show proof the business is closed by March 15, 2018 from the State of Florida Division of Corporations and the phone company an additional fine of $100.00 per day per violation. g.Case #17-113067 Citation #6120 (Hazelwood) Shree Siddhivinayak Krupa LLC-2340 S Ridgewood Section 21-54-02 Installation Standards Code Officer Robert Hazelwood presented the case. Kevin Patel was present and stated that the property had some damage from the storm. With no assistance from the insurance company nor government they are trying to fix the property. Kevin stated that 71 trees needed to be added which was the highest number of landscape for this property. Special Magistrate James Stokes provided these options: 1) work with the City to map out a new site plan and get it approved by the City by June 7th. If the new site plan is approved this will go away. or 2) four sections of the property will be completed in three month increments. The first stage on the south end of the property being completed by June 7, 2018. The second stage on the east side of the property being completed by September 7, 2018. The third stage on the north side of the property being completed by December 7, 2018 and the fourth stage which is next to stage one and stage two being completed by March 7, 2019. Additional fine of $50.00 per day per stage the violation exists and property can be lien presumed to the schedule. 8. OLD BUSINESS-PUBLIC HEARING a.Case #17-113109 Citation #5682 (Pogany) Theresa A. McCoy - 2203 Queen Palm Dr. Sec. 10-98 Property maintenance Sworn in were John Bouchelle and Paula Farrell of 2203 Queen Palm Dr., Edgewater, FL. Code Officer Kevin Pogany presented the case. Code Officer Pogany stated the property is in compliance and the citation is outstanding. John Bouchelle testified and provided letters from neighbors labeled exhibited A to the Special Magistrate. Special Magistrate James Stokes finds in violation of Sec.10-98 property maintenance and reduce the citation fee to $25.00. Special Magistrate James Stokes read the following cases and concluded with it appears after reviewing these cases that no one was present for any of the cases read. Pursuant to Section 10-348 and 10-345 subparagraph C 11 of the Code of Ordinance and the statement that appears on the respective citation issued that failure to appear at he hearing means the alleged violator has waived any right to contest the violation and that an order can be made for the maximum applicable penalties that include but are not limited to administrative costs, fines, daily fines and liens.
