The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor Dana T. Armstrong on Monday,
August 7, 1972 at 7:30 P.M.

APPROVAL OF MINUTES
Councilman Wiggins duly made a motion to approve the minutes of
the meetings held July 13, July 17~ and July 26~ 1972, and motion
was seconded by Councilman Ganta. Upon roll call vote, said motion
CARRIED.

Councilman Wiggins duly made a motion to pay said bills and
accounts, being seconded by Councilman Ganta. Upon roll call
vote, said motion CARRIED with Councilman Severance voting No.

Library Report for July, 1972

The City Clerk read a letter from the Edgewater Planning Board
recommending a Plaque be presented to the Edgewater Fire Depart-
ment for their outstanding performance of the July 4th celebration.
The Planning Board requested that Joseph E. Weaver, City Attorney,
be present at the meetings of the Edgewater Planning Board.
They also requested that a Public Hearing be held with regard to
a location for the Recreation Area.
Mayor Armstrong recommended the Planning Board be abolished as
they are nine months into this fiscal year and haven't gotten off
the ground.
Councilman Severance said if they had the tools, meaning maps,etc.,
they could accomplish their job. Mayor Armstrong said they have
maps available on the wall at City Hall anytime they wish to use
them.
Councilwoman Crigger made a motion the Planning Board letter be
tabled until next workshop meeting when all City Council Members
can be present. Said motion being seconded by Councilman Wiggins.
Upon roll call vote, said motion CARRIED.
Mayor Armstrong advised the City Clerk to notify the Planning
Board the date this letter will be discussed.
The City Clerk read a letter from C. H. Pointer requesting re-
zoning of his property. Mayor Armstrong stated that Mr. laBonde
had checked this property and reports that no re-zoning is necess-
ary.
Councilman Ganta duly motioned that the letter be tabled, and
Councilman Wiggins seconded the motion. Upon roll call vote,
said motion CARRIED.
The City Clerk read a letter of resignation from William J.
Bussinger, Patrolman. Councilman Wiggins duly motioned the
resignation be accepted with regret and the motion was seconded
by Councilman Severance. Upon roll call vote, said motion CARRIED.

The City Clerk next read a letter of resignation from Carolyn D.
Schedler, Deputy City Clerk. Councilwoman Crigger duly motioned
the resignation be accepted, but with regrets. Councilman Wiggins
seconded the motion, and upon roll call vote, said motion CARRIED.
ORDINANCES
ORDINANCE NO. 763: AN ORDINANCE DESIGNATING AND APPOINT-
ING THOMAS RAMENDA AS REGULAR PATROLMAN FOR THE CITY OF EDGEWATER,
VOLUSIA COUNTY, FLORIDA, SETTING FORTH HIS COMPENSATION FOR SUCH
OFFICE, AND PROVIDING AS EFFECTIVE DATE THEREFOR.
The above Ordinance being read in full by City Attorney Joseph
Weaver.
Councilman Wiggins duly made a motion to approve said Ordinance.
Said motion being seconded by Councilman Severance. Upon roll
call vote, said motion CARRIED.
A motion to waive the second reading was duly made by Councilman
Wiggins and seconded by Councilwoman Crigger. Upon roll call
vote, said motion CARRIED.
ORDINANCE NO. 764: AN ORDINANCE DESIGNATING AND
APPOINTING LARRY W. WESTFALL AS REGULAR PATROLMAN FOR THE CITY
OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, SETTING FORTH HIS COMPEN-
SATION FOR SUCH OFFICE, AND PROVIDING AS EFFECTIVE DATE THEREFOR.
The above Ordinance being read in full by City Attorney Joseph
Weaver.
Councilman Ganta duly made a motion to approve said Ordinance.
Said motion being seconded by Councilwoman Crigger. Upon roll
call vote, said motion CARRIED.
A motion to waive the second reading was duly made by Councilman
Ganta and seconded by Councilwoman Crigger. Upon roll call vote,
said motion CARRIED.
ORDINANCE NO. 765: AN ORDINANCE EMPLOYING AND APPOINT-
ING ROBERTA M. BOSWELL AS DEPUTY CITY CLERK FOR THE CITY OF EDGE-
WATER, FLORIDA, SETTING FORTH HER TENURE, SETTING FORTH HER COMPEN-
SATION FOR SUCH OFFICE, SETTING FORTH HER DUTIES AND RESPONSIBILITIES
AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above Ordinance being read in full by City Attorney Joseph
Weaver.
Councilwoman Crigger duly made a motion to approve said Ordinance.
Said motion being seconded by Councilman Wiggins. Upon roll call
vote, said motion CARRIED.
A motion to waive the second reading was duly made by Councilman
Wiggins and seconded by Councilman Ganta. Upon roll call vote,
said motion CARRIED.
ORDINANCE NO. 766: AN ORDINANCE REALTING TO OCCUPATIONAL
LICENSE TAXATION; LEVYING AN OCCUPATIONAL LICENSE TAX FOR THE
PRIVILEGE OR ENGAGING IN OR MANAGING ANY BUSINESS, PROFESSION OR
OCCUPATION WITHIN THE CITY OF EDGEWATER; REGULATING THE TERM OF
OCCUPATIONAL LICENSES, PROVIDING FOR THE REVOCATION OR SUSPENSION
OF SUCH LICENSES; PROVIDING A SCHEDULE OF OCCUPATIONAL LICENSE
TAXES; PROVIDING EXEMPTIONS; REQUIRING CERTIFICATES OF COMPETENCY
FOR CERTAIN OCCUPATIONS; PROVIDING FOR THE REPEAL OF ALL OTHER
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING
FOR PUBLIC NOTICE OF THE SECOND READING OF THIS ORDINANCE; AND
PROVIDING AN EFFECTIVE DATE.

Councilman Severance duly made a motion to approve said Ordinance.
Said motion being seconded by Councilwoman Crigger. Upon roll call
vote, said motion CARRIED.
In compliance with Section 205.042 Florida Statutes, the Ordinance
will be published in a newspaper of general circulation. Fifteen
(15) days from date of publication, second reading will be held.
ORDINANCE NO. 767: AN ORDINANCE APPROVING THE REZONING
OF THE CARMEN MONTESANO PROPERTY FROM "COMMERCIAL" TO "INDUSTRIAL"
FOR THE PURPOSE OF DISMANTLING AUTOMOBILES, AND PROVIDING AN
EFFECTIVE DATE THEREFOR.
The above Ordinance being read in full by City Attorney Joseph
Weaver.
Councilman Wiggins duly made a motion to approve said Ordinance.
Said motion being seconded by Councilman Severance. Upon roll call
vote, said motion CARRIED.
A motion to waive the second reading was duly made by Councilman
Wiggins and seconded by Councilman Severance. Upon roll call vote,
said motion CARRIED.
ORDINANCE NO. 768:

AN ORDINANCE APPROVING THE REZONING
FROM RESIDENTIAL TO RESORT-RESIDENTIAL
PUD), AND PROVIDING AN EFFECTIVE DATE
The above Ordinance being read in full by City Attorney Joseph
Weaver.
Councilman Wiggins duly made a motion to approve said Ordinance.
Said motion being seconded by Councilman Severance. Upon roll
call vote, said motion CARRIED.
A motion to waive the second reading was duly made by Councilman
Wiggins and seconded by Councilman Ganta. Upon roll call vote,
said motion CARRIED.
Mayor Armstrong asked Mr. Howard to show the artist's conception
of the proposed dwellings. Upon completion of his presentation,
a short question and answer period followed.
RESOLUTIONS A RESOLUTION ACCEPTING THE MAINTEN-
ANCE BY VOLUSIA COUNTY, OF CERTAIN STREETS WITHIN THE CORPORATE
LIMITS OF THE CITY OF EDGEWATER, FLORIDA, AND SETTING FORTH THE
NAMES OF THE STREETS TO BE MAINTAINED.
The above Resolution being read in full by City Attorney Joseph
\~eaver.
Councilman Wiggins duly made a motion to approve said Resolution.
Said motion being seconded by Councilwoman Crigger. Upon roll
call vote, said motion CARRIED.
OLD BUSINESS
Mayor Armstrong referred specifically to Ordinance 602 regarding
swimming in City owned lakes. This Ordinance will be strictly
enforced due to the fact that these lakes are infested with
snakes and some with alligators, thus endangering the lives of
our children.
Mayor Armstrong requested that a motion be made to phase out
Municipal Court which will take approximately 13 months to complete.
Councilman Wiggins duly made a motion to instruct the City Attorney
to proceed with the phasing out process. Said motion being seconded
by Councilman Ganta. Upon roll call vote, said motion CARRIED.

OLD BUSINESS cont".
Mayor Armstrong showed pamphlet with regard to The State Solicitation
Law. Any charitable or non-charitable organization must register
with the Secretary of State. City Council members and the Police
Department have a copy of this ruling if anyone wants to read it
over.
NnJ BUSINESS
Mayor Armstrong stated that the Community Center roof could not be
patched properly and asked for a motion authorizing the City Clerk
to advertise for bids for re-roofing the Community Center.
Councilman Wiggins duly made a motion to give the City Clerk
this authorization. Said motion was seconded by Councilman
Severance. Upon roll call vote, said motion CARRIED.
Mayor Armstrong brought up the misuse of public streets by heavy
equipment.
City Attorney Joseph Weaver said the most plausible solution was
to erect signs which would bring about discontinuing the use of
residential streets as short cuts, and direct traffic to the
thruways.
Mayor Armstrong delegated this to Police Chief Katez.
Fire Chief Paul Walls informed all present that they are in
excess of 600 hours on the new Station. The shrubbery has been
planted and being taken care of.
Mayor Armstrong suggested to Fire Chief Walls that a thank you
letter is in order to Mr. Carlson for the palm trees.
Mayor Armstrong reminded all present that the Public Hearing at
the Community Center for the purpose of giving users, tenants,
etc., an opportunity to be heard concerning the amendment of
present rates of Municipal Water or Sewer System, will be
