Said motion was seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. OFFICERS REPORTS Certification of Posting Clerk's Cash Statement for June 1972 Budget Report, June 1972 Police Report for June, 1972 Library Report for June, 1972 COMMUNICATIONS The City Clerk read a letter from the Edgewater Library requesting the Council purchase book shelves for the Library. Mayor Armstrong recommended the Council buy the book shelves for the Library. Councilman Wiggins duly made a motion to purchase the book shelves for the Library, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. ORDINANCES ORDINANCE NO. 760: AN ORDINANCE TERMINATING LLOYD A. SMITH AS MUNICIPAL JUDGE AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Ordinance was read in full by City Attorney, Joseph Weaver. Councilman Wiggins duly made a motion to approve the said Ordinance, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED with Councilman Ganta voting No. A motion to waive the second reading was duly made by Councilman Wiggins and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED with Councilman Ganta voting No. ORDINANCE NO. 761: AN ORDINANCE EMPLOYING AND APPOINT- ING DANA T. ARMSTRONG AS MUNICIPAL JUDGE OF THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH HIS TENURE, SETTING FORTH HIS SALARY, SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The Ordinance was read in full by City Attorney, Joseph E. Weaver. A motion to approve the above Ordinance was duly made by Council- woman Crigger and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED with Councilman Ganta voting No. -2- ~ I , u ~ ~ u o ORDINANCES, cont Councilwoman Crigger duly made a motion to waive the second reading, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED with Councilman Ganta voting No. Councilman Severance stated the Council has been discussing in the workshop meetings about the municipal courts and that by 1977 we will have to become part of the County Judicial Court. He also stated it would take thirteen months to convert over to the system and the City will see more funds rebated through this system so this is part of the reason for going this route now. ORDINANCE NO. 762: AN ORDINANCE ANNEXING THE PROPERTY OF JOHN J. SAUERS AND THERESE A. SAUERS AND REDEFINING THE BOUNDARY LINES OF THE CITY OF EDGEWATER, FLORIDA, TO INCLUDE THE NEWLY ANNEXED PROPERTY, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The Ordinance was read in full by City Attorney, Joseph E. Weaver. Councilman Ganta duly made a motion to approve the Ordinance subject to a second reading. Said motion was seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. Mayor Armstrong stated the Ordinance had to be published in the news- paper each week for four consecutive weeks before it can be passed. RESOLUTIONS RESOLUTION NO. 437: A RESOLUTION OF INTENT TO HOLD A PUBLIC HEARING ON AUGUST 10, 1972, AT THE COMMUNITY CENTER IN THE CITY OF EDGEWATER, FLORIDA AT 7:30 P.M., FOR THE PURPOSE OF GIVING ALL USERS, OWNERS, TENANTS OR OCCUPANTS OF PROPERTY SERVED OR TO BE SERVED BY THE MUNICIPAL WATER OR SEWER SYSTEM AN OPPORTUNITY TO BE HEARD CONCERNING THE AMENDMENT OF PRESENT RATES IN ORDER TO PROVIDE FOR A DEPRECIATION FUND NECESSARY TO PROVIDE FOR THE UPDATING AND MAINTENANCE OF THE PRESENT SYSTEMS. Councilwoman Crigger duly made a motion to adopt the said Resolution, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. RESOLUTION NO. 438: A RESOLUTION AUTHORIZING THE APPOINT- MENT OF THE TURNEY AND DUPREE, CERTIFIED PUBLIC ACCOUNTANTS, AS THE AUDIT AGENCY FOR THE CITY OF EDGEWATER FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1971, AND ENDING OCTOBER 31, 1972. A motion for adoption of said Resolution was duly made by Councilman Wiggins and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. Mayor Armstrong explained the reason the auditors were being appoint- ed now is in compliance with the 1972 Revenue Sharing Act that a resolution has to be passed appointing auditors before the State will recognize them as the City Auditors. OLD BUSINESS Cornelia A. Kinsey, City Clerk opened and read the bids received for a mechanical aeration unit for the Sewage Treatment Plant. The bids being as follows: Lee Construction Company $12,400.00 A certification of funds was read by the City Clerk. Councilman Severance duly made a motion to accept the bid from Lee Construction Company. Said motion being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED with Councilman Ganta voting No. -3- ~ r (J -. u (,,) u OLD BUSINESS. cont Councilman Wiggins duly made a motion accepting Carmen Montesano's certificate incompliance with Ordinance 581. Said motion was seconded by Councilman Severance. Upon roll call vote. said motion CARRIED. A motion was duly made by Councilman Severance approving the issuance of an auto salvage business license to Carmen Montesano subject to Ordinance 581 requiring a fence be built within 60 days or the license will be revoked. Said motion was seconded by Councilman Wiggins. Upon roll call vote. said motion CARRIED. Councilman Wiggins duly made a motion to have the City Attorney draw up an ordinance granting Carmen Montesano's variance to rezone his property from commercial to industrial. being seconded by Councilman Severance. Upon roll call vote. said motion CARRIED. MISCELLANEOUS After a brief discussion on updating the City Charter to make it more flexible. Mayor Armstrong suggested the Council compose a letter to the different civic organizations in the City asking for suggestions on appointing members for a Charter Study Board. There being no further business. Councilman Wiggins duly made a motion to adjourn, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. TIME OF ADJOURNMENT: 8:37 P.M.
