CALL TO ORDER Special Magistrate Jacob Schumer called the meeting to order. 2. PURPOSE/PROCESS OPENING STATEMENT Special Magistrate Jacob Schumer gave a brief state of the purpose/process opening statement. 3. APPROVAL OF MINUTES Special Magistrate Jacob Schumer approved the minutes of March 12, 2020 meeting. 4. SWEARING IN OF WITNESS(ES) Sworn in were Douglas Cowell Jr. of 3111 Vista Palm Dr., Edgewater, FL; Brandon Whiteman of 3308 Sabal Palm Dr., Edgewater, FL; City of Edgewater Code Enforcement Officer Robert Hazelwood and City of Edgewater Code Enforcement Officer Kevin Pogany. 5. Douglas Cowell was present and testified. Mr. Cowell denied the violation. Special Magistrate Jacob Schumer finds the property in violation of Section 10-80 Outdoor storage of the City of Edgewater's Code of Ordinances and assessed the citation fine of $75.00. An additional fine of $100.00 per day, for each day the violation exists past June 21, 2020 and for a lien to be placed on the property if not satisfied. d.Case # 20-115663 (Repeat) Citation # 2101 (Pogany) Diana Whiteman Est - 3308 Sabal Palm Drive Section 10-402 Alternate Method of Enforcement City of Edgewater Code Enforcement Officer Kevin Pogany presented the case. Brandon Whiteman was present and testified. Mr. Whiteman admitted to the violations. Code Enforcement Officer Kevin Pogany stated everything was in good standing other than some gutter on the side of the home. Special Magistrate Jacob Schumer finds the property in violation of Sec. 10-402 Alternate method of the Code of Ordinances and assess the citation fine of $150.00. The violation has been corrected. e.Case # 20-115664A (Repeat) Citation # 5415 (Pogany) Diana Whiteman Est - 3308 Sabal Palm Drive Section 10-113 Inoperable/ Wrecked Vehicle City of Edgewater Code Enforcement Officer Kevin Pogany presented the case. Brandon Whiteman was present and testified. Mr. Whiteman admitted to the violations. Code Enforcement Officer Kevin Pogany stated everything was in good standing other than some gutter on the side of the home. Special Magistrate Jacob Schumer finds the property in violation of Sec. 10-113 Inoperable/wrecked vehicle of the Code of Ordinances and assess the citation fine of $150.00. The violation has been corrected. f.Case # 20-115664B (Repeat) Citation # 5415 (Pogany) Diana Whiteman Est - 3308 Sabal Palm Drive Section 10-80 Outdoor Storage City of Edgewater Code Enforcement Officer Kevin Pogany presented the case. Brandon Whiteman was present and testified. Mr. Whiteman admitted to the violations. Code Enforcement Officer Kevin Pogany stated everything was in good standing other than some gutter on the side of the home. Special Magistrate Jacob Schumer finds the property in violation of Sec. 10-80 Outdoor storage of the Code of Ordinances and to correct the violation by June 18, 2020 assessing a citation fine of $150.00 and an additional fine of $200.00 per day, for each day the violation exists past June 18, 2020. Pursuant to Section 10-348 and 10-345 subparagraph C 11 of the Code Of Ordinance and the statement that appears on the respective citation issued that failure to appear at the hearing means the alleged violator has waived any right to contest the violation(s) and that an order can be made for the maximum applicable penalties that include but are not limited to administrative costs, fines, daily fines and liens.
