U o ~ ',.~ o o THE CITY COUNCIL OF THE CITY OF EDGEWATER SPECIAL MEETING HELD MAY 5, 1972 The Special Meeting of the City Council of the City of Edgewater, Florida was called to order by Mayor Dana Armstrong on Friday, May 5, 1972, at 5:20 P.M. after a verification of the legality of the procedure used to call the meeting. McCall, Sr. Present Present Present Present Present Present Present Absent ORDINANCES ORDINANCE NO. 750: AN ORDINANCE APPOINTING AND CON- FIRMING JOSEPH E. WEAVER AS CITY ATTORNEY FOR THE CITY OF EDGEWATER, FLORIDA: SETTING FORTH HIS RETAINER AND PROVISION FOR ADDITIONAL COMPENSATION: PROVIDING HE SHALL SERVE AT THE WILL OF THE CITY COUNCIL: PROVIDING FOR HIS POWERS AND DUTIES AND PROVIDING AN EFFECTIVE DATE THEREFOR. The said Ordinance was read in full by Joseph E. Weaver. Councilman Wiggins duly made a motion to adopt the said Ordinance, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. A motion to waive the second reading was duly made by Councilman Severance and seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. RESOLUTIONS RESOLUTION NO. 433: A RESOLUTION EMPLOYING AND APPOINT- ING ALFRED GREEN SPECIAL COUNSEL TO DEFEND THE CITY OF EDGEWATER, FLORIDA IN THE LAWSUIT BROUGHT BY HAROLD H. HALL AGAINST THE CITY OF EDGEWATER, FLORIDA, TO SERVE AT THE WILL OF THE CITY COUNCIL, SETTING FORTH HIS COMPENSATION, SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Resolution was read in full by Joseph E. Weaver, City Attorney. Councilwoman Crigger duly made a motion to approve the said Resolution, being seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. Councilman Ganta asked why Mr. Green had to be hired to represent the City in the lawsuit when the City now has an Attorney. The City Attorney, Joe Weaver, explained that he had been the defense counselor for Mr. Hall at the beginning of the lawsuit and the insurance company has a lawyer who will represent the City. Councilman Ganta also asked why the insurance company does not represent the City on the entire lawsuit. Mr. Weaver explained the~e were two charges against the City of Assault & Battery and False Arrest. The insurance company will not provide defense or be responsible for the false arrest charge.
