Armstrong, on Monday, December 6, 1971, at 7:30 P.M. Mayor Armstrong asked Reverend HArdin for a prayer of Invocation. ROLL CALL Mayor Dana T. Upon roll call vote, said motion CARRIED, with Councilman Severance voting No. Councilwoman Crigger duly made a motion to approve the minutes of the Special Meeting held November 22, 1971. Said motion was . seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. Mayor Armstrong stated the Council did not order the signs men- tioned in the bills but suggest the bill for them be paid. Mr. Jacob Lodico addressed the Council and stated Councilman Ganta and Councilman Wiggins were on the previous Council; ask them if the previous Council ordered any signs. Stop blaming the previous administration. Mayor Armstrong stated he wasn't blaming anyone but did not know who ordered the signs. OFFICERS REPORTS Certification of Posting COMMUNICATIONS A letter from the Florida Shores Property Owners Association re- questing the City place street lights throughout the Florida Shores area was read by the City Clerk Cornelia A. Kinsey. Mayor Armstrong suggested the letter be acknowledged and tabled for further study to see if there are any surplus funds in the budget for this purpose. Councilman Wiggins duly made a motion to table the letter for further study. SAid motion being seconded by Councilman Severance. Councilman Wiggins duly made a motion to accept the resignation of Officer Bucher with regrets, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. ORDINANCES ORDINANCE NO. 723: AN ORDINANCE SETTING TIMES AND PLACES FOR INFORMAL WORKSHOP MEETINGS OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA~ PROVIDING THAT ALL MEETINGS SHALL BE OPEN AT ALL TIMES TO THE PUBLIC; PROVIDING THAT PARTICIPATION, IF ANY, BY THE PUBLIC AT ANY INFORMAL MEETING MAY BE LIMITED BY THE CITY COUNCIL; PROVIDING NO FORMAL ACTION SHALL BE TAKEN BY THE CITY COUNCIL AT AN INFORMAL WORKSHOP MEETING; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman Severance duly made a motion to adopt the said Ordinance, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. A motion to waive the second reading of the Ordinance was duly made by Councilman Ganta and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 724: AN ORDINANCE SETTING FORTH A MAN- DATORY AGE OF RETIREMENT FOR ALL FULL-TIME OR PART-TIME EMPLOYEES OF THE CITY OF EDGEWATER, FLORIDA; REQUIRING ANY AND ALL PROSPECTIVE CITY EMPLOYEES TO UNDERGO A PHYSICAL EXAMINATION AS A PREREQUISITE TO EMPLOYMENT BY THE CITY OF EDGEWATER, FLORIDA; PROVIDING THAT THE CITY SHALL HAVE THE RIGHT TO REQUIRE PHYSICAL EXAMINATION OF ANY EMPLOYEE AT ANY TIME DURING HIS OR HER COURSE OF EMPLOYMENT; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilwoman Crigger duly made a motion to adopt the Ordinance, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. Councilwoman Crigger duly made a motion to waive the second reading. Said motion being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 725: AN ORDINANCE APPOINTING ELIZABETH J. CROUSER AS DEPUTY CLERK FOR THE CITY OF EDGEWATER, FLORIDA; SETTING FORTH HER COMPENSATION; PROVIDING THAT SHE SHALL SERVE AT THE WILL OF THE CITY COUNCIL; PROVIDING FOR A PROBATIONARY PERIOD; SETTING FORTH HER DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman Ganta duly made a motion to adopt the Ordinance, with said motion being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. A motion to waive the second reading was duly made by Councilman Ganta and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 726: AN ORDINANCE ACCEPTING' THE RESIG- NATION OF KENNETH BUCHER AS PATROLMAN FOR THE CITY OF EDGEWATER, FLORIDA, TERMINATING HIS EMPLOYMENT, AND PROVIDING AN EFFECTIVE DATE THEREFOR. A motion for adoption of the Ordinance was duly made by Councilman Wiggins and seconded by Councilman Severance. ORDINANCE NO. 727: AN ORDINANCE EMPLOYING AND APPOINT- ING WILLIAM BUSSINGER AS A FULL TIME PATROLMAN FOR THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH HIS RATE OF PAY, PROVIDING FOR HIS TENURE, PROVIDING FOR A PROBATIONARY PERIOD, SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. A motion for adoption of the Ordinance was duly made by Councilman Ganta and seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. Councilman Ganta duly made a motion to waive the second reading being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 728: AN ORDINANCE TERMINATING DAVID SHANNON AS MUNICIPAL JUDGE FOR THE CITY OF EDGEWATER, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFOR. I Councilman Wiggins duly made a motion to adopt the Ordinance. SAid motion being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. A motion to waive the second reading was duly made by:Councilman Wiggins and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 729: AN ORDINANCE EMPLOYING AND APPOINT- ING JOE WEAVER AS MUNICIPAL JUDGE OF THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH HIS TENURE, SETTING FORTH HIS SALARY, PROVIDING FOR A PROBATIONARY PERIOD, SETTING FORTH HIS DUTIES AND RESPONSIBILITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman Severance duly made a motion to adopt the said Ordinance, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. A motion of waivure on the second reading was duly made by Councilman Wiggins and seconded by Councilman Severance. Upon roll call vote, said motion CARRIED. RESOLUTIONS RESOLUTION NO. 424: A RESOLUTION APPOINTING HAROLD D. DOUNHOO, AS CHIEF OF POLICE, AS SANITATION OFFICER FOR THE CITY OF EDGEWATER, FLORIDA; PROVIDING FOR HIS TENURE AS SUCH SANITATION OFFICER AND SETTING FORTH HIS DUTIES AS SANITATION OFFICER AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman Wiggins duly made a motion to adopt the Resolution, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. RESOLUTION NO. 425: A RESOLUTION APPROVING THE APPOINT- MENTS OF THE EDGEWATER VOLUNTEER FIRE DEPARTMENT, INC. AND NAMING AND DESIGNATING OFFICERS OF SAID EDGEWATER VOLUNTEER FIRE DEPART- MENT, INC., PROVIDING THEY SHALL RECEIVE NO SALARY, PROVIDING THEY SHALL EACH SERVE FOR ONE YEAR, AND,PROVIDING AN EFFECTIVE DATE THEREFOR. A motion of adoption on the Resolution was duly made by Councilman Severance and seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. -4- o o Q o c . RESOLUTION NO. 426: A RESOLUTION OF INTENT TO SEEK A DOCK PERMIT FROM THE ARMY CORPS OF ENGINEERS FOR THE CONSTRUCTION OF A DOCK OR FISHING PIER ADJACENT TO LAND OWNED BY THE CITY OF EDGEWATER, FLORIDA; PROVIDING THAT THE SAID DOCK OR FISHING PIER SHALL BE USED ONLY FOR PUBLIC RECREATION AND SHALL NOT BE USED FOR ANY COMMERCIAL PURPOSE BY THE CITY OF EDGEWATER, FLORIDA; AUTHORIZ- ING THE CITY CLERK TO TRANSMIT A COpy OF THIS RESOLUTION TO THE ARMY CORPS OF ENGINEERS; REVOKING AND REPEALING ALL RESOLUTION IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE THEREFOR. Councilman Wiggins duly made a motion to adopt the Resolution, being seconded by Councilwoman Crigger. Upon roll call vote, said motion CARRIED. RESOLUTION NO. 427: A RESOLUTION URGING THE GOVERNOR OF THE STATE OF FLORIDA, AND THE FLORIDA LEGISLATURE TO RETURN FIFTY PER CENT OF THE CORPORATE PROFITS TAX TO CITIES AND COUNTIES BASED ON THE POINT OF COLLECTION; AUTHORIZING THE CITY CLERK TO TRANSMIT COPIES OF THIS RESOLUTION TO THE GOVERNOR OF THE STATE OF FLORIDA AND TO EACH MEMBER OF THE LEGISLATIVE DELEGATION FROM VOLUSIA COUNTY, FLORIDA AND TO THE FLORIDA LEAGUE OF CITIES, AND PROVIDING AN EFFECTIVE DATE THEREFOR. A motion for adoption of the Resolution was duly made by Council- woman Crigger and seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. A motion to adopt the resolution urging the Governor of Florida to take off 10 Mill limit on Municipal Tax was duly made by Councilman Wiggins. SAid motion died for lack of second. NEW BUSINESS Councilman Ganta suggested the City check into rental cars when they go to purchase new cars for the police department. Mayor Armstrong stated that would be a good idea and the City could advertise for bids. Councilman Severance stated that cities could rent police cars through the County with special police equipment on the cars. Mayor Armstrong said under State Statue, if the County has a bid on rental cars then the cities have bid price perogative. Mayor Armstrong asked Vice Mayor Crigger to take the seat of Mayor while he duly made a motion for the department heads to sign with the City Clerk when they order commodities for their department. Said motion died for lack of second. MISCELLANEOUS There was a brief discussion concerning a merit system and review board for city employees which was explained by the Mayor that it could be done by amending the City Charter. Mr. Paul Wall announced the Library would have a Christmas party for the children on December 23, 1971. Mayor Armstrong acknowledged the good job the firemen are doing with the conva1ascent equipment. They go out of their way to help. Mr. Lodico: Councilman Severance wanted a correction in the minutes at the Workshop Meeting. Mayor Armstrong: The minutes have already been voted on tonight. This isn't done at the workshop meeting. I believe it was only a minor correction. Councilman Severance: I was marked present at the Special Meeting on November 22 at which I was not present. -5- o o o o i .. '. '\ .
