THE CITY COUNCIL OF THE CITY OF EDGEWATER
REGULAR MEETING HELD
OCTOBER 18, 1971
The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie on Monday,
October 18, 1971, at 7:30 P.M.

Before the minutes were approved, Councilman Lodico questioned
the legality of Mayor Cairnie serving as Mayor at the meeting since
he has sold his house and it has been recor ed at Deland.
Councilman Lodico asked the Attorney to read the Charter which
states IImembers of the City Council shall have the qual ifications
of electors and shall be taxpayers on real property within the
city limits. Any member who ceases to posess any of the qualifi-
cations required shall forfeit his office.
City Attorney Charles Hall stated the Mayor can resign or the
Council could have an Ordinance drawn requiring him to resign which
cannot be done before the next meeting and that is the Mayor's
last meeting anyway. Attorney Hall suggested that the Mayor not
vote or take any legal actions during the meeting.
Councilman Lodico asked Attorney Hall to ask Mayor Cairnie if he
had recorded the deed.
Mayor Cairnie stated since Mr. Lodico does such a good job of
checking around, let him check it out.
APPROVAL OF MINUTES
Councilman Wiggins duly made a motion to approve the minutes of
the Regular Meeting held on October 4, 1971. Said motion was
seconded by Councilman Fugate. Upon roll call vote, said motion
CARRIED with Mayor Cairnie Abstaining.

A motion was duly made by Councilman Wiggins to pay said bills and
accounts, being seconded by Councilman Fugate. Upon roll call vote,
said motion CARRIED with Mayor Cairnie Abstaining.

COMMUNICATIONS
Councilman Lodico asked the City Clerk to read a letter written to
Mayor Cairnie from Mr. John Gross.
A letter was read by the City Clerk from Florida Water & Pollution
Control Operators Association requesting Paul Ream's presence at
the Annual Awards Luncheon to receive a safety award.
Councilman Ganta duly made a motion for the City to send Paul Ream
to the Convention.
After some discussion, Councilman Ganta withdrew his motion and
duly made a motion to table the letter until the next meeting to
see if Paul Ream would be interested in going. Motion died for
lack of second.

A letter from Kenneth May regarding rezoning of residential pro-
perty was read by the City Clerk.
Councilman Wiggins duly made a motion to refer the letter to the
Zoning Board, being seconded by Councilman Fugate. Upon roll call
vote, said motion CARRIED with Mayor Cairnie Abstaining.
ORDINANCES
ORDINANCE NO. 703: AN ORDINANCE AMENDING SECTION 2 OF
ORDINANCE 667, THE SAME BEING AN ORDINANCE APPROPRIATING REVENUES
TO BE COLLECTED FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA
FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1970 AND ENDING OCTOBER
31, 1971, TO THE VARIOUS ITEMS OF THE CITY BUDGET.
Councilman Fugate duly made a motion to adopt the said Ordinance
and seconded by Councilman Lodico. Upon roll call vote, said
motion CARRIED with Councilman Ganta voting Nay and Mayor Cairnie
Abstaining.
A motion was duly made by Councilman Fugate to waive the second
reading of the Ordinance. Said motion seconded by Councilman Lodico.
Upon roll call vote, said motion CARRIED with Councilman Ganta
voting Nay and Mayor Cairnie Abstain{ng. .
ORDINANCE NO. 704: . AN ORDINANCE ABOLISHING THE POSITIONS
OF COORDINATORS FROM THE CITY COUNCIL PROVIDING THAT THERE SHALL
NO LONGER BE COORDINATORS FROM THE CITY COUNCIL TO WORK WITH THE
VARIOUS DEPARTMENTS OF THE CITY, REPEALING ALL ORDINANCES AND
RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE
DATE THEREFOR.
Councilman Fugate duly made a motion to adopt the Ordinance, being
seconded by Councilman Wiggins. Upon roll call vote, said motion
CARRIED with Councilman Ganta voting Nay and Mayor Cairnie Abstaining.
Motion for waivure of the second reading was duly made by Council-
man Wiggins and seconded by Councilman Fugate. Upon roll call
vote, said motion CARRIED with Councilman Ganta voting Nay and
Mayro Cairnie Abstaining.
RESOLUTIONS
RESOLUTION NO. 414: A RESOLUTION HIRING AND APPOINTING
HAROLD D. DOUNHOO AS CHIEF OF POLICE FOR TflE CITY OF EDGEWATER,
FLORIDA, SETTING FORTH A PROBATION PERIOD, PROVIDING FOR HIS TENURE,
SETTING FORTH HIS COMPENSATION, SETTING FORTH. A CONDITION FOR HIS
CONTINUED EMPLOYMENT, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
Councilman Fugate duly made a motion to adopt the said Resolution,
being seconded by Councilman Wiggins. Upon roll call vote, said
motion CARRIED, with Mayor Cairnie Abstaining and Councilman Ganta
voting Nay.
OLD BUSINESS
Mr. Cutshaw reported on the equipment needed and the cost of build-
ing the sidewalks at the school which would be approximately $2,556.00.
Mayor Cairnie stated the City is not permitted to do any work over
$500.00 without bids.
City Attorney Charles Hall suggested the Council give Mr. Cutshaw
the authority to work on the sidewalks with $500.00 of material
at a time until the sidewalks are built, then bids would not be
necessary.
Councilman Wiggins duly made a motion to build the sidewalks as
stated in the letter from the sidewalk committee. Said motion was

CARRIED with Mayor Cairnie Abstaining.
NEW BUSINESS
The certification of bids received for resurfacing Riverside DRive
were read by Elsie Ward, City Clerk. Bids being as follows:

Councilman Fugate duly made a motion to table the bids for further
study, being seconded by Councilman Wiggins. Upon roll call vote,
said motion CARRIED with Mayor Cairnie Abstaining.

MISCELLANEOUS
Councilman Lodico duly made a motion to have the Attorney check
into the legality of a Quit Claim Deed dated 11-15-51 to City owned
permanent park land. Said motion being seconded by Councilman
Fugate. Upon roll call vote, said motion CARRIED with Mayor Cairnie
Abstaining.
Councilman Wiggins informed the people that someone has been stuffing
paper in the toilet bowls and the City is having to clean the
restrooms afterwards.
Councilman Wiggins duly made a motion for the Council to authorize
Mr. Carl Shell to be responsible for the building at the Shuffleboard
Court. Said motion was seconded by Councilman Fugate. Upon roll
call vote, said motion CARRIED with Mayor Cairnie Abstaining.
There being no further business, Councilman Fugate duly made a
motion to recess until 4:00 P.M., Wednesday, October 20, 1971 to
canvass absentee ballots and declare winners of Primary Election.
Said motion being seconded by Councilman Wiggins. Upon roll call
vote, said motion CARRIED, with Mayor Cairnie Abstaining.
