REGULAR MEETING HELD
AUGUST 2, 1971
The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie on Monday,
August 2, 1971, at 7:30 P.M.

Councilman Wiggins duly made a motion of approval of the minutes
of July 19, 1971 meeting. Said motion was seconded by Councilman
Fugate. Upon roll call vote, said motion CARRIED.

A motion was duly made by Councilman Fugate to pay said bills and
accounts, being seconded by Councilman Wiggins. Upon roll call
vote, said motion CARRIED.

Library Report for July
COMMUNICATIONS
A letter from the Planning Board recommending the variance request-
ed by Mr. McGinnis for the purpose of erecting a storage building
be granted was read by the City Clerk, Mrs. Ward.
The City Clerk read a request from Maule Industries for paving
Flagler Avenue.
Councilman Fugate duly made a motion to table the request for next
yearls paving list, being seconded by Councilman Wiggins. Upon
roll call vote, said motion CARRIED.
The resignation of Mr. Claypool, the meter reader for the Water
Department, was read by the City Clerk.
A motion to accept the resignation was duly made by Councilman
Ganta and seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
The resignation of MRs. Leona Carden, Librarian, was also read.
Councilman Fugate duly made a motion to accept Mrs. CArden1s resig-
nation with regrets, and seconded by Councilman Wiggins. Upon
roll call vote, said motion CARRIED.
ORDINANCES
ORDINANCE NO. 695: AN ORDINANCE AMENDING SECTION 2 OF
ORDINANCE NO. 684 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER,
FLORIDA RELATING TO THE DEFINITION OF FULL TIME REGULAR POLICE
OFFICERS FOR THE PURPOSE OF CALCULATING ACCRUED VACATION TIME AND
PROVIDING AN EFFECTIVE DATE THEREFOR.
The above Ordinance was read in full by the City Attorney, Charles
A. Hall.
A motion for adoption of the above Ordinance was made by Councilman
Ganta and seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
Councilman Fugate duly made a motion to waive the second reading,
being seconded by Councilman Wiggins. Upon roll call vote, said
motion CARRIED.

ORDINANCES, cont
ORDINANCE NO. 696: AN ORDINANCE AMENDING SECTION 3 OF
ORDINANCE NO. 661 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER,
FLORIDA, RE-DEFINING THE NUMBER OF HOURS THAT PATROLMEN AND POLICE-
MEN FOR THE CITY OF EDGEWATER, FLORIDA MUST WORK BEFORE RECEIVING
OVER TIME PAY AND PROVIDING AN EFFECTIVE DATE THEREFOR, EXCLUDING
THE CHIEF OF POLICE.
Councilman Fugate duly made a motion to adopt the above Ordinance,
being seconded by Councilman Wiggins. Upon roll call vote, said
motion CARRIED with Councilman Ganta votin~ Nay.
A motion of waivure of the second reading was duly made by Council-
man Fugate and seconded by Councilman Wiggins. Upon roll call
vote, said motion CARRIED.
ORDINANCE NO. 697: AN ORDINANCE APPROVING THE RECOM-
MENDATION OF THE EDGEWATER ZONING BOARD PERTAINING TO THE APPLI-
CATION OF DAVID K. McGINNIS FOR A VARIANCE FROM THE EXISTING
ZONING UPON PROPERTY OWNED BY HIM; GIVING AND GRANTING UNTO THE
SAID DAVID K. McGINNIS A VARIANCE FROM RESIDENTIAL TO COMMERCIAL
UPON THE SAID PROPERTY, AMENDING SECTION 6 OF ORDINANCE NO. 219 AS
AMENDED BY SECTION 1 OF ORDINANCE NO. 368 PROVIDING AN AUTOMATIC
TERMINATION OF THIS VARIANCE AND PROVIDING AN EFFECTIVE DATE
THEREFOR.
A motion for adoption of the above Ordinance was duly made by
Councilman Fugate and seconded by Councilman Wiggins. Upon roll
call vote, said motion CARRIED.
Councilman Wiggins duly made a motion to waive the second reading
being seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
RESOLUTIONS
RESOLUTION NO. 401: A RESOLUTION RAISING THE SALARY OF
CAROLYN DIANNE SCHEDLER AS DEPUTY CLERK FOR THE CITY OF EDGEWATER,
VOLUSIA COUNTY, FLORIDA TO THE SUM OF $325.00 PER MONTH AND PRO-
VIDING AN EFFECTIVE DATE THEREFOR.
Councilman Fugate duly made a motion to adopt the above Resolution
anG seconded by Councilman Wiggins. Upon roll call vote, said
motion CARRIED.
RESOLUTION NO. 402: A RESOLUTION HIRING JEROME C.
WALKER AS CHIEF OF POLICE FOR THE CITY OF EDGEWATER, FLORIDA, SETT-
ING HIS TENURE AND HIS COMPENSATION, SETTING FORTH THE CONDITION
OF HIS CONTINUED EMPLOYMENT, AND PROVIDING AN EFFECTIVE DATE.
A motion to adopt the Resolution was duly made by Councilman Fugate
and seconded by Councilman Wiggins. Upon roll call vote, said
motion CARRIED.
NEW BUSINESS
A Proclamation calling for Primary and General Election for November
2, 1971 was read by City Attorney, Charles A. Hall.
Councilman Wiggins duly made a motion to accept the Proclamation
being seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
A Proclamation for increasing the salary of Mayor and Councilman
was read by the City Attorney.
Paul Wall addressed the Council and stated the people have been
turning the Proclamation down each election and it might help if
it was put in separate questions on the ballot.

NEW BUSINESS, cont
Councilman Wiggins duly made a motion to accept the Proclamation,
being seconded by Councilman Fugate. Upon roll call vote, said
motion did not Carry with Councilman Ganta voting Yea.
A motion was duly made by Councilman Fugate for the City Attorney
to draw up a new Proclamation showing the monthly salary of the
Mayor and Councilmen instead of yearly. SAid motion was seconded
by Councilman Wiggins. Upon roll call vote, said motion CARRIED,
with Councilman Ganta voting Nay.
A Proclamation for the Council to be allowed to make expenditures
to the amount of $1,000.00 without a competitive bid Itlas read by
the City Attorney.
A motion was duly made by Councilman Wiggins to accept the Procla-
mation and seconded by Councilman Fugate. Upon roll call vote,
said motion CARRIED, with Councilman Ganta Voting Nay.
Mr. Armstrong addressed the Council and suggested the Council
make a new charter changing the qualifications of homeowners or
a business to protect the Edgewater homeowners from the 18 year old
running for an office.
The City Attorney, Charles Hall, stated that would be unconsti-
tional.
Mayor Cairnie suggested that the City Attorney check into the
legal matters.
~lISCELLANEOUS
Mr. Fred Garlick announced there would be a benefit bingo for the
fireman with cancer.
Mr. Garlick asked the City Clerk to write a thank you note to
Mrs. Clark for painting the picture on the wall of the stage in
the Community Center.
There being no further business, Councilman Fugate made a motion
for adjournment and seconded by Councilman Wiggins. Upon roll call
vote, said motion CARRIED.
