2022-O-07 - Redistricting ORDINANCE NO 2022-0-07 AN ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA REDISTRICTING THE CITY OF EDGEWATER FOR THE PURPOSE OF ELECTING CITY COUNCIL MEMBERS; PROVIDING FOR CONFLICTING PROVISIONS SEVERABILITY AND APPLICABILITY PROVIDING FOR AN EFFECTIVE DATE AND FOR ADOPTION. WHEREAS the City Council of the City of Edgewater Florida has made the following determinations: 1. Article III of the Charter of the City of Edgewater establishes four (4) voting districts for the purpose of electing the four (4) members of the City Council. 2. Article III of the Charter of the City of Edgewater requires that within six (6) months after official publication of the decennial census the City Council shall by ordinance adjust the district boundaries as required to provide for four (4) districts as nearly equal in population as possible. 3. The City was redistricted after the 1980 census pursuant to Ordinance No. 92-0- 10, after the 1990 census pursuant to Ordinance No. 92-0-90, after the 2000 census pursuant to Ordinance No. 2001-0-102 and after the 2010 census pursuant to Ordinance No. 2011-0- 10. 4. On December 6, 2021, City Council adopted Resolution No. 2021-R-33, establishing a redistricting committee to work in concert with City staff to determine where the district boundaries should be located based on the US Census. 5. The GIS Department utilizing the 2020 decennial census prepared three proposed redistricting maps, on January 11, 2022, the Redistricting Committee met with staff and voted to recommend City Council adopt Map"A". For the purpose of carrying out the provisions of Article III of the Charter, the City Council of the City of Edgewater desires to change the voting district boundaries as recommended by the Redistricting Committee. NOW THEREFORE BE IT ENACTED by the City Council of the City of Edgewater Florida. PART A. REDISTRICTING THE CITY OF EDGEWATER FOR THE PURPOSE OF ELECTING CITY COUNCIL MEMBERS. Pursuant to the recommendation of the Redistricting Committee; City Council District Map "A" is hereby adopted and attached as Exhibit"A". PART B. AUTHORITY. The City Council of Edgewater has the authority to adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida, Chapter 166 Florida Statutes and Article III of the Charter of the City of Edgewater. PART C. ESTABLISHMENT OF DISTRICT BOUNDARIES. The four (4) voting districts of the City of Edgewater are hereby established as follows. Voting District I Voting District 1 shall include that portion of the City generally described within the following boundaries East of S Glenwood Road, South of 10th Street East to the Easterly City limits, thence South to Hardin Place, thence West to Edgewater Drive, thence South to Eaton Road, thence West to Industrial Drive, thence South to 16th Street, thence West to Willow Oak Drive, thence West to the City limit line of Air Park Road, thence North along the City limit line S Glenwood Road to the Point of c....�passages are deleted 2 Underlined passages are added #2022-0-07 Beginning, and including an area South of Taylor Road and west to S Glenwood Road. Voting District 2 Voting District 2 shall include that portion of the City generally described within the following boundaries: All properties South of the Southern boundary of Voting District 1 to the Eastern City limits, thence South to the North boundary line of the Pelican Cove East subdivision, thence West along the Northern boundary line of the Pelican Cove east subdivision,thence South along US Highway 1 to the Southern boundary line of the Pelican Cove West, thence West to Guava Drive, Thence South to 24th Street, thence West to a point midway between Umbrella Tree Drive and Victory Palm Drive, thence North to 23`d St, thence West along 23rd Street to the Western City Limits, thence North along the Western City Limits to the City limit to 22nd Street to include all property West of Air Park Road and West of the western boundary line of the Florida Shores subdivision to the western most City limit line to the Point of Beginning, and including an area South of 22"d Street, West of Silver Palm Drive and North of 25th Street. Voting District 3 Voting District 3 shall include that portion of the City generally described within the following boundaries: All properties South of the Southerly line of Voting District 2, East of the City limits line, thence South to the Northerly boundary line of the Edgewater Landing Strt passages are deleted 3 Underlined passages are added #2022-0-07 subdivision, thence North along Ranken Drive, continuing West along the Northern boundary line of the Edgewater Landing subdivision, thence due West to the Western right-of-way line of US Highway 1, thence South to Roberts Road, Thence West Along Roberts Road to 30th Street, thence West along 30th Street to a point midway between Yule Tree Drive and Woodland Drive, thence South to 31" Street, Thence west to the Western City Limits, thence North along the Western City Limits to the thence West along the City limits line to the South of the Southerly line of Voting District 2, to the Point of Beginning. Voting District 4 Voting District 4 shall include that portion of the City generally described within the following boundaries: All properties from the Southern boundary of Voting District 3 to the Southerly City limits. See Exhibit "4" Voting District Map for further detail. SECTION 3. Voting District Map. The voting district map of the City of Edgewater shall be placed in a conspicuous location within City Hall depicting the voting districts described in this ordinance. SECTION 4. Conflicting Provisions. All conflicting ordinances and resolutions including Ordinance No. 82-0-10, Ordinance No. 92-0-90, Ordinance No. 2001-0-102 and Ordinance No. 2011-0-10, are hereby superseded by this ordinance to the extent of such conflict. SECTION 5. Severability and Applicability. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. SECTION 6. Effective Date. This ordinance shall become effective immediately upon adoption.
