The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie, on Monday,
July 19, 1971, at 7:30 P.M.

Councilman Wiggins duly made a motion to accept the minutes of the
Regular Meeting on July 5, 1971, being seconded by Councilman
Fugate. Upon roll call vote, said motion CARRIED.

A motion was duly made by Councilman Lodico that the said bills and
accounts be paid. Said motion was seconded by Councilman Wiggins.
Upon roll call vote, said motion CARRIED.

COMMUNICATIONS
A letter from Arthur S. Griffith requesting zoning variance, due
to a street not being named which he is going to build a house on
lot 435, Hawks Park of the unnamed street, was read by the City
Clerk, Elsie L. Ward.
Mayor Cairnie stated the proper thing to do is to turn it over to
the Zoning Board.
Councilman Wiggins duly made the motion to turn the request over
to the Zoning Board. Councilman Fugate seconded the motion. Upon
roll call vote, said motion CARRIED.
A letter from Rev. Boettner of New Smyrna asking that the City con-
sider not having fireworks on Sunday when the.occasion arises in
the future as they did the 4th of July fireworks.
Paul Wall, one of the firemen, stated the fireworks were held on
Sunday to make it possible for all firemen to be present.
Councilman Fugate duly made a motion to turn the letter over to
the Fire Department, being seconded by Councilman Wiggins. Upon
roll call vote, said motion CARRIED.
ORDINANCES
ORDINANCE NO. 691: AN ORDINANCE ALLOWING REIMBURSEMENT
TO CITY COUNCILMEN FOR OUT-OF-POCKET EXPENSES AND MILEAGE INCURRED
IN FURTHERANCE OF CITY BUSINESS; SETTING THE AMOUNT OF OUT-OF-
POCKET EXPENSES REIMBURSABLE AND FIXING THE MILEAGE RATE, PROVIDING
THAT PRIOR TO BEING REIMBURSED FOR OUT-OF-POCKET EXPENSES AND MILE-
AGE, ANY COUNCILMAN MUST PREPARE AND TURN IN TO THE CITY CLERK A
VOUCHER; FURTHER PROVIDING THAT ALL PAYMENTS FOR REIMBURSEMENT FOR
OUT-OF-POCKET EXPENSES AND FOR MILEAGE MUST FIRST BE APPROVED BY
THE CITY COUNCIL AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above Ordinance was read in full by City Attorney Charles Hall.

Councilman Ganta duly made a motion to adopt the said Ordinance,
being seconded by Councilman Lodico. Upon roll call vote, said
motion CARRIED.
A motion to waive the second reading of the Ordinance was made by
Councilman Fugate and seconded by Councilman Wiggins. Upon roll
call vote, said motion CARRIED.
ORDINANCE NO. 692: AN ORDINANCE PROVIDING FOR REGULAR
FORMAL MEETINGS OF THE CITY COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA; SETTING THE TIME AND PLACE OF SAID REGULAR MEETINGS' AND
FURTHER PROVIDING THAT ANY REGULAR MEETING DATE WHICH FALLS ON A
NATIONAL HOLIDAY SHALL BE CARRIED OVER TO THE NEXT ENSUING DATE AT
THE SAME TIME AND PLACE AND PROVIDING AN EFFECTIVE DATE THEREFOR.
Councilman Fugate duly made a motion to adopt the Ordinance and was
seconded by Councilman Wiggins. Upon roll call vote, said motion
CARRIED.
Councilman Wiggins duly made a motion to waive the second reading,
being seconded by Councilman Fugate. Upon roll call vote, said
motion CARPIED.
ORDINANCE NO. 6g3: AN ORDINANCE PROHIBITING DOGS WITH-
I~ A FIFTY (50) FOOT PERIMETER OF ANY PICNIC TABLE IN THE PARK AND
PIER AREA ACROSS FROM THE CITY HALL IN THE CITY OF EDGEWATER,
FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
A motion was duly made for adortion of the said Ordinance by
Councilman Wiggins and seconded by Councilman Fugate. Upon roll
call vote, said motion CARRIED.
Councilman Fugate duly moved to waiver the second reading of the
Ordinance, said motion seconded by Councilman Wiggins. Upon roll
call vote, said motion CARRIED.
ORDINANCE NO. 694: AN ORDINANCE DEDICATING AND DESIG-
NATING CERTAIN LAND IN EDGEWATER, VOLUSIA COUNTY, FLORIDA AS A
PUBLIC STREET NAMING THE SAME AND PROVIDING AN EFFECTIVE DATE
THEREFOR.
Councilman Fugate moved for adoption of the said Ordinance, said
motion seconded by Councilman Ganta. Upon roll call vote, said
motion CARRIED.
A motion for waiver of the second reading was duly made by
Councilman Wiggins and seconded by Councilman Fugate. Upon roll
call vote, said motion CARRIED.
RESOLUTIONS
RESOLUTION NO. 400: A RESOLUTION ACCEPTING THE RESIG-
NATION OF DONALD GILLESPIE AS A MEMBER OF THE EDGEWATER PLANNING
BOARD AND PROVIDING AN EFFECTIVE DATE THEREFOR.
Councilman Fugate duly moved to accept the Resolution with regrets,
being seconded by Councilman Lodico. Upon roll call vote, said
motion CARRIED.
Mr. Paul Wall, stated Mr. Gillespie was one of the original members
of the Recreational Planning Board selected by a Resolution also.
Mrs. Ward, City Clerk, stated she would look up the Resolution and
have it ready for the next regular meeting.

Mr. Bebbington addressed the Council stating the boats are still
in the lakes in Florida Shores after which an Ordinance was passed
prohibiting this. He asked if it was up to the citizens to com-
plain or are the Police to enforce the Ordinance.
Councilman Fugate stated the new boats which are in the lakes that
were brought in after the Ordinance was passed can be made to move.
Attorney Charles Hall suggested the people come to City Hall and
sign complaints.
There being no further business, Councilman Fugate duly moved for
adjournment, said motion seconded by Councilman Wiggins. Upon roll
call vote, said motion CARRIED.
