Upon roll call vote, said motion CARRIED. OFFICERS REPORTS Certification of Posting Clerk's Cash Statement for April, 1971 Budget Report for April, 1971 Police Report for April, 1971 COM r~ U N I CAT ION S A letter from the Edgewater School Patrol Thanking the City for the One Hundred ($100.00) Dollars donated for their trip to Tallahassee was read by the City Clerk. The letters of resignation from Samuel R. Boger, Chief of Police, Henry Midkiff of the Water Department, and Frank Voland, Community Center Custodian were read by the City Clerk. A letter from the American Legion requesting a wreath for Memorial Day from the City was read by the City Clerk. Councilman Lodico stated he would like to donate the wreath if it was alright with the Council. Councilman Fugate duly made the motion to let Councilman Lodico buy the wreath, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. A letter from Magnuson Corporation recommending that Indian River 81vd. be rezoned fer light business was read by the City Clerk. Councilman Wiggins duly made a motion to refer the letter to the Planning Board and seconded by Councilman Ganta. A member of the Zoning Board suggested that the Zoning Board meet with the Planning Board since it is for rezoning. The motion was withdrawn by Councilman Wiggins and Councilman Ganta. Councilman Wiggins then duly made a motion to refer the letter to the Planning Board and Zoning Board. Said motion was seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. A petition from the residents of Needle Palm Drive requesting the street be paved was also read by the City Clerk. -2- r. u o o ~ u COMMUNICATIONS, cont Councilman Lodico duly made a motion that the request be put in the paving file for 1972, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. ORDINANCES ORDINANCE NO. 687: AN ORDINANCE ACCEPTING THE RESIG- NATION OF HENRY MIDKIFF OF THE WATER DEPARTMENT AND TERMINATING HIS EMPLOYMENT OF THE WATER DEPARTMENT FOR THE CITY OF EDGEWATER, FLORIDA EFFECTIVE MAY 31, 1971. The Ordinance stated above was read by the City Attorney, Charles A. Hall. Councilman Lodico duly made a motion to adopt the Ordinance, being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. Mayor Cairnie suggested that the City Clerk write a letter to Mr. Midkiff, thanking him for his eleven years service to the City and have each Councilman Sign the letter. A motion for waivure of the second reading was made by Councilman Lodico and seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. ORDINANCE NO. 688: AN ORDINANCE REQUIRING ANY AND ALL PROSPECTIVE CITY EMPLOYEES TO UNDERGO A PHYSICAL EXAMINATION AS A PREREQUISITE TO EMPLOYMENT BY THE CITY OF EDGEWATER, FLORIDA, RE- QUIRING SAID APPLICANT TO FURNISH RESULTS OR FINDINGS OF SAID PHYSICAL EXAMINATION TO THE CITY COUNCIL PRIOR TO SAID EMPLOYMENT, PROVIDING EXPENSES OF SAID PHYSICAL EXAMINATION SHALL BE BORNE BY THE PROSPECTIVE EMPLOYEE, FURTHER PROVIDING PHYSICAL EXAMINATION FORM SHALL BE ONE FURNISHED BY OR APPROVED BY THE CITY, AND PRO- VIDING AN EFFECTIVE DATE. The above Ordinance was read by the City Attorney, Charles Hall. A motion for adoption of the above Ordinance was made by Councilman Wiggins and seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. Councilman Ganta moved to waive the second reading of the above Ordinance being seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. RESOLUTIONS RESOLUTION NO. 395: A RESOLUTION ACCEPTING THE RESIG- NATION OF FRANK W. VOLAND AS COMMUNITY CENTER CUSTODIAN FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA"AND TERMINATING HIS EMPLOYMENT EFFECTIVE MAY 31, 1971. Councilman Ganta duly made a motion to adopt the above Resolution being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. RESOLUTION NO. 396: A RESOLUTION ACCEPTING THE RESIG- NATION OF SAMUEL R. BOGER AS CHIEF OF POLICE FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA AND TERMINATING HIS EMPLOYMENT EFFECTIVE MAY 7, 1971. Councilman Fugate duly made a motion to adopt the said Resolution, being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. -3- u o o " u , , RESOLUTIONS, cont Councilman Fugate stated the Council was under the impression Mr. Boger had all of his qualifications subject to State approval. When the State was notified of his employ~ent, they informed the City that he wasn't qualified by the State to be a Policeman. Mr. Boger resigned so he could get his qualifications cleared by the State. RESOLUTION NO. 397: ARCIERI AS PART TIME PATROLMAN SETTING FORTH THE CONDITION OF PROVIDING AN EFFECTIVE DATE. A RESOLUTION HIRING KENNETH J. FOR THE CITY OF EDGEWATER, FLORIDA, HIS CONTINUED EMPLOYMENT, AND Councilman Fugate moved for adoption of the said Resolution and seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. OLD BUSINESS Councilman Wiggins mentioned that Escoe had brought down their equipment and they are working on the Seawall. MISCELLANEOUS Mayor Cairnie stated the rest rooms at the ball park are in terrible shape. Councilman Lodico stated he would be in favor of an Ordinance to hold the parents liable for damage of City property. City Attorney, Charles Hall, advised the Council there is a State Resolution holding parents responsible up to $500.00 damage to public property. There being no further business, Councilman Wiggins moved to ad- journ, being seconded by Councilman Fugate. Upon roll call vote, said motion CARRIED. TIME OF ADJOURNMENT: 8:16 P.M.
